Thanks sir. but i am unable to understand that since now sons are under no such obligation why they r required to pay as under sec-6(4) courts can not proceed against them ?? can they refuse to do so where the debt was taken by the karta for personal benefits . should not it be discharged from the property of father only primarily.kindly clear my doubt sir..

Dear Sir,
my query is that certain ancestral land some of which is partitioned and the rest is not partitioned but still remains in the name of the father as he is the karta. Can the will be written by the father of the complete ancestral land which is not partiotioned ? can the father again change the distribution of the ancestral land earlier allotted to another member in partition by writing a will ?
Sir please do enlighten me.

According to Hindu Marriage Culture in U.P. We always do the Child Marriage.
But after marriage Mostly we gives the break of 3 to 5 yrs till the child become young and Mature. to bring the wife at home.
due to this if the wife,
Q. 1)
Refuse to live with Husband after completation of 3 to 5 yrs. period then what it can be understood whether it is divorced or not?
Q.2)
As the Child marriage, it doesn't have any Registration then is it neccessary to take Divorce from court if any one want to take divorce.
What is required in such cases for self protection.
if another person want to do Marriage?
Q.3)
If Husband /Wife ( any One) File cases for Divorce in young age then it is neccessay to pay him any compensation of marriage or not? or any one can demand of compenstation of marriage like , Dowry, Marriage Cost Etc.
Q.4)
Is there are any rules to file case against Wife if she cheating with Husband and her family supporting to her.

What kind of Rights have Husband According to Hindu Marriage Act and Supereme court of india if the wife refused to live with Husband and refusing to Give the Divorce then can a husband file any case against this in such situation .

My wife had Filed petition for decree of Retitution of conjugal rights under the provision section 281 of mohammedan law.. now the case was dismiss in family court stating that "As per Mohammedan Law the For part of restitution of Congugal rights is not filing. Hence it is Dismis, as not tenable"
as she was not able to find the previous judgement on this case, that could run this petition
Now she went to appeal in high court FCA
i want to know what step should i take to dismiss this case?
Whether Retitution of conjugal rights under the provision section 281 of mohammedan law, is applicable , i mean previous judgement is given in wifes favour before or case is admitted?
if yes where can i find a copy of this judgement?

I feel shame to tell that my marriage was a love marriage and I stayed with her for last twelve years.
Now I want to get rid of her.
I am an ex-serviceman from Indian Air Force, now working in private secotor in Chandigarh though my old parents stay in Kolkata. I have to take the decision to stay in Chandigarh because of my wife.
From the very beginning me and my parents are not satisfied with the behaviors and nature of my wife. Though it was different before marriage. We tried to rectify her but failed to do so. We filed a divorce case against her in 2004 at Kolkata and after getting the letter from court she agreed to lead a normal life like others and it is in paper(a copy is with me). So we did not proceed the case.
After a month or two she began the same thing and as the day progress she is becoming more and more arrogant and desperate. Now I am frustrated and want to get rid of it.
Everyday go outside at 9 o’clock at night and returned around 10 o’clock, then started cooking.
After dinner around 11-30 at night started talking with someone (I have heard some male voice).
One day I heard her smile at 2.00 am also. This is the new developments.
Wake up around 10 a.m. Don’t send my 9 year child to school. Because to make her prepared for the school, she has to wake up early. Her attendance in the school is very poor (School attendance report can be collected).She never allow my girl to go outside and mix with others.
Without any reason suddenly shouting radically.
Now a day she started abusing me and my family members and threatened me to put 498A to punish me and my old parents.
Now a days it is very difficult to stay together with her but the law in our country which always favors the women I am helpless. Please tell me how can I get rid of her?
498a Case
Hi,
I am a muslim male. My wife filed a 498a case against me, my mother and 2 sisters in 2007. Now the hearing for the case has started a month back. My wife has approached me and asking me to divorce her.
When i told her to withdraw the case before i give her divorce, she told me that as per provision in law, once we are divorced, the case will stand cancel. But i am not sure of it and is reluctant to divorce her, for the simple reason that if the case is not withdrawn I will continue to suffer.
Pls advice whether if I give her divorce as per muslim law, will the 498a case against me and my family will be withdrawn or any other way the case can be amicably settled.
