Is a mutual separation document duly agreed and signed signed by the husband and wife is enough.

MY QUS IS THAT -IF THE SON IS DEAD OF A PARENT BUT THE SON IS HAVING WIFE CAN THE FATHER OF THE BOY ASK FOR MAINTANANCE FROM HIS SON'S WIFE RESP IF (YES THEN WHY AND NO THEN WHY) PLS EXPLAIN THIS QUERY.....

my qustion to all of you is that.....
1) if the father is dead of a child then can he ask maintanance from his grand father whot does not have property but the pension is going on resp.think and answer pls.......

Dear Expert members,
I have filed for divorce against my wife on the grounds of cruelity but I dont have any proofs of the same. In the same petition, I have also mentioned that we are staying apart from more than 2 years but I have taken this as the ground of divorce. So in this case when the cruelity ground is not proved and the dessetion is proved, can I get divorce on the basis of facts described on dessertion - pls note that I have not mentioned dessertion as the ground , so can judge give the decree on dessertion though I have not given it as ground?

My clients both are Hindu, and Bride is 28 years and Bride groom is 22 years, approach me for Registration of their marriage under Hindu Marriage Act, before the Marriage Officer only, they have not interest to perform their marriage prior in any Temple, my clients have interested to do before the marriage officer only.
I went to the Register office and enquired they told that prior notice should be compulsory later 30 days of submission of their application, then Marriage officer will do the Registration. then i asked application form but they dont have application.
Respected Sir, if any body have INTENDED TO DO MARRIAGE UNDER HINDU MARRIAGE ACT, 1955.
I am asking all forms with regards intended to marriage (I mean 30 days later the marriage officer shall do the register the marriage) and procedure please tell sir, thank you for all experts in advance, i am waiting for your valuable replies sir.

I have filed a case under IPC 498A, against my husband in ahmedabad. now i m stay with my parents (due to their ill health) in another city of gujarat.
i would like to know if i would be able to transfer my case to my parent's city from ahmedabad?
If yes, i would like to know how? and what could be approx. time duration for the same?

i have got ex -party devoice at family court lucknow, after 2 years.
Now, she is trying restoration of ex -party devoice after 110 days.
1). weather restoration application against ex -party devoice after 110 days is mentinable or not.
2).where she can file family court/district or high court?
3). what should i do to save my self from this cancer which is coming again ? stil I have not got Decree of divorce and re marriage. I have already been paying/giving 125- crpc mantinance Rs. 7500/- per month.
pl. suggest me.

My client has been awarded Rs.2000/- Monthly maintenance from her husband in proceeding 125 Cr.pc. My clients husband is government employee, he is earning 25thousand per month. My client wanted to file civil suit against her husaband to get atleast 10 thousand rupees as monthly maitenance. May I know from experts about suit valuation ,court fee . Whether my client have to zttend court on every hearing or not.

Dear Experts,
We got married in august 2008 according to hindu traditions, but since september 2009, me and my wife have been living separately. She for without any reasons is living with her parents now. The reason I suspect is that she wants to be in close company with her former boyfriend which is not possible in her in-laws home. I came to know about their affair when I saw romantic messages in her cell phone sent by him. Although I could have filed for divorce on the ground of adultery, but I feared that she might file a false 498 against me and ruin my career. However, on February 22nd, she did file a fabricated 498 A petition in a PS, but the CI there was quick to realise this and no FIR was filed against me as both the parties have agreed for a settlement amount and divorce by mutual consent. I have a few queries in this regard:
1. Is mere filing of 498 a petition (and not FIR) in a PS enough for hindering my travel abroad in future or in creating any problems in me getting a decent job in India (I'm a doctorate from abroad).
2. Although the girl's family has agreed for mutual consent divorce, do I need to take any precautions so that I'm not harassed by them again as I do not trust them at all at this stage. Please advise me what all has to be done to avoid any hassles in future!
3. Even after getting a divorce decree, is it possible that the other party can still file some fake cases against me ? If so, within how many months after divorce?
4. From the date of divorce decree, when can I get legally get married again ?
5. As her cell phone is still with me as an evidence, what would be the ideal period to return it to her, that is whether after filing for mutual consent divorce or after getting the decree. Please advise me so that me and my family can overcome this turmoil!
