In an annulment proceedings can a petitioner produce the marriage registration certificae in which the solemnization of marriage as per hindu customary rites was accepted but claimed in the annulment petition that the marriage was not solemnized according to hindu rites.
Submiting a document that confirms that the marriage was solemnized but claiming that it was not soleminized in the petition.
Is it not barred by estopple.

my wife has lodged a complain against me and my family(father69yrs, mother67yrs,brother & sister in law, and married siste) to local police station that i m asking for 5 lacs and beat her occasionally.also taken his jewelery.
real thing is that jewelery has been taken by her after one day of my marriage(married on 2006 april)and being kept in her father's locker.she was at her fathers home from 23 march2008 to 09 june2010.after that she came to my house live for 42 days 10 june'10 to 22aug2010 and again gone to her home with all his goods with his father and lodged his complain. belive me no violence , no hot talk. she simply said i came here to make my case strong. i can not live with u people. u all r low level.
i m working in kolkata and my father is a brain stroke patient living in varanasi(up)with my mother. my brother is living in delhi with his wife. all r victim. please sugest whwt to do on this matter.

My wife has lodged a false complaint against me and my family regarding dowry harrassy in Crime against women cell in delhi and accordingly the Cell has summoned me through a request letter.The summon asked me to appear before it for reconciliiatory proceedings.But I am a officer in Bank posted at Ahmedabad.So , I cant appear before it in delhi.But my parents will appear accordingly as asked to show our side of facts.
Dear all ,Actually my wife left me without informing me and without any reason from Ahmedabad on 21.04.2010.(My marriage date is 29.11.2009)She also took away her STRI-DHAN AND some cash amount with her.I tried my best to bring her back by sending two legal notices but in vain.In Fact , she replied the notices imposing false and baseless allegations on me and my family.Her parents are also supporting her and threatened of false cases agsints us and demanded Rs. 10 lacs then.After that .We tried to end this matter and asked them for mutual divorce by paying Rs 5 lacs.But they insisted on Rs. 10 lacs and did not reply positively.Thereafter, They became silent and after a gap of 5 months they have lodged a complaint against me and my family.
Dear all the fact is that we had not taken any dowry nor demanded anything from them.What we wanted a simple girl who could take care of me and my family.But they shattered all our dreams and hopes.
Her parent wish is that the girl would neither leave her job and nor delhi and would not go Gujarat which is her matrimonial home as per law also.
When i further enquired about the reasons fo her for not leaving job and delhi I found that She is having affair with her colleagues before marriage but her parents compelled her to marry me which she has confessed many time during our family meetings.
Sir/Madam ,I have proof of e-mails which shows her involvement with somebody.
Sir Actually I have been cheated.And My all dreams have been shattered.
So,Please advise me how i can save myself and my family from these shrewd people?

Please advise and help me out as i dont want to live with the character-less and irresponsible lady for my rest life?

husband comatosed since last 6 months with a non traumatic brain injury without any hope of life.married for two years only.can support him financially but cannot leave career and stay with him near his bed side as a glorified home nurse.what to do?if agreeing to pay him money monthly any chance of getting divorce?i am 26 yrs and i am mentally depressed and on drugs

Dear All Experts,
I am going through mutual consent divorce (actually forceful divorce with help of fake 498a) through my wife’s advocate. We have filed our case 2 months ago at district sessions court. Also as per my advocate’s words we (both parties) have paid total fees of Rs.21000 as advocate fees.
Now after 2 months also advocate is not providing me any details of my case processing, hence I visited court for case status, then I came to know that my hearing date is in Jan 2011 (where I will get final decree of divorce). I have enquired about first hearing in court, counseling process, cooling period, etc, but didn’t get any proper info.
In my petition, advocate has mentioned almost 99% fake reasons of divorce & my fake residential address. Also all incidents cited in petition are imaginary. I had to shut my mouth due to 498a demon.
We have completed 1 year as staying separate & completed 1.5yrs for marriage.
We have not exchanged any cash to each other as alimony or maintenance or stree-dhan, which is mentioned in petition. I need full & final divorce from my wife which can not be revoked by her in any circumstance.
1) Now my concern is, is above mutual divorce process legal (or as per law), as we skipped few steps (might be power of money we paid to advocate)?
2) If not then, After passing final decree of divorce, Can any of petitioner cancel above said divorce on basis of wrong method of handling of divorce?
3) After passing final decree of divorce, Can my wife file 498a against me (even if I don’t contact her by any media)?
4) Also my wife had filed 2 fake NC cases against me last year, are those cases dropped automatically as we have filed mutual divorce case in court? (this was told me by her advocate)

if a lady lives 6 month with her husband &lives 1.5 year with her parents without consent of her husband &doing this repeatedly .as per law desertion period 2 yr is required filing a divorce case.the law has given liberty to a lady live any where upto 2 year,your husband can not do any thing.IS I AM CORRECT?
what one should do,to take divorce in such a condition as it is very difficult for man to prove cruelty by ladies
