Sir,
I am decree holder for the property of my late mother and my sister used to stay on the property by virtue of permissive possession. I filed a suit for partition and got my share in the property. I got status quo order refraining her from further construction and changing the nature of the property. Now she has constructed the house during the pendency of the suit and in due course partition suit was pronounced in my favour and other share of the same property to her.
My sister has not abided the court order and proceeded to construct the building. Status quo order was not vacated by my sister in the court nor she explained to the court for construction of the house.
Is it allowed in the constitution when there is a partition suit pending in the court and shares have not been declared.
Now merely constructing the house on my rightful share of the property can she claim the right on my share of the property. What are the rights available for me to proceed. How the advocate Commission appointed by the court will decide partition of the suit.
Please advise suitably I will be grateful for you.

Me and my husband are staying seperately, i have been thrown out from my matrimonial house. My husband is not a bad person but he is under influence of his mother. He is planning to file for divorce. Iam not ready for divorce at any cost because i love my husband. Iam not working, not earning and fully dependant on my parents. so in this case iam afraid that it will be hard for me to afford a lawyer and his expense. And moreover iam not ready for divorce. So my question is ....
1) If my husband files for divorce, can i appeal to court for a conciliation or somthing to disqualify my husband's divorce petition. So that the court doesn't proceed with my husband's divorce case.
2) And if something like this is possible,then what is the procedure ??? and can i do all this myself without taking help of a lawyer ????

I have been deserted from my matrimonial house , its is 3 months i have been staying with my parents, my husband or my inlaws doesn't call me at all, and they have no intensions to accept me back and make this marriage successful. From last 2-3 months i have written several messages ,emails to my husband, but he doesn't reply, my parents had also tried for a reconciliation process through protection officer, but my inlaws didn't supported. As my inlaws are not ready to accept me back, i have now filed a 125 crpc maintenance case, but now my inlaws are saying that i left their house on my own wish, i had packed my bags much before and they have managed their neighbour to say this that yes i left their house on my own wish,and i had packed my bags much before and she had seen all that. but this is false .
My hearing is dated next week and iam afraid that what will happen, if my inlaws and their neighbours start claiming that i left their house on my own,and as witness their neighbour was there. Altough i have all the sent messages,and emails in which i have said that i don't want divorce and i love my husband etc.
But iam scared about my inlaws false claims and their neighbours statements. How will i prove to the court that i was thrown out of my matrimonial house,and what so ever my inlaws are saying is false. (Iam not working)
Plz help me.......

My wife has told she does not want any alimony or maintainence in past/present/future in the MOU.
But can she ask for my movable and immmovable assets in the future? if so under which section.?

Dear experts,
4 years back i got married a srilankan guy. After a month i came to know his real habits. He is from srilanka iam from chennai. Then i went to srilanka to live with my husband. i realised very bad experiance in srilanka. There parants took my all jewels,money send back to chennai. Mean time i have one kid. Last 2 years i have no contact with him. Even i dont know where is he.
2 Years back he came to chennai he started fighting with my parents so we went to police. in police station he write in hand writing he is not going to disturb in the future
I want to apply for diverse what i have to do? . What is procedure to do ? How long will take to get? where should i go to apply in chennai ?
Both of us from hindu. Marriage in temple & registed in chennai. After marriage we stay in chennai for 2 months then we went to srilanka stay for 6 months. After that i dont know where is he but not in india

My father died without making a Will. When we brothers splited 12 yrs back My father has taken his part from our family assetts. Now father died without making a Will. I am living abroad. Before 2 months of the death my brother has transfered father's all assetts on his name. I came to know after death of father. Now what may I do to claim my portion from father's assetts ?. Can I go to court ?,During whole life father was 10 percent partner of A cotton ginning mill. May be before the death of father My brother might have transfered on his name. We are two sisters and married. We do not have a brother but have cousins. they are my father's brother's sons and we are in bad terms and do not want the ancestral property to go to them. What can i do to stop my father from transferring the property to them.

my case is as follows
my mother's father expired(1983) without giving any share to her daughters in the registered will
his daughters after his death(1984) in a separate legal document has renounced any claims in his property
now can they still ask for a claim in his HUF PROPERTY
(p.s : the property is currently the place where my grand fathers sons(dad along with uncles reside) .
