sir i m nautical officer in m. navy.i got married on july2010.it was a arranged marriage.but things got drastically wrong after the marriage.my wife is doctor by profession.she started misbehaving with my parents in all ways possible-whenever resented threatning to commit suicide.my father filed an fir in the local police station in august-10.after that misbehaviour got to its height(example:calling them names,abusing them,treating them as slaves).my repeated confrontation doesnot end this.so i shifted out of house to a rented house in the same city.now misbehaviour started towards me-ill-treating me,damaging my laptop,causing all shorts of hindrance to my preparation for exams.vitually she moved out to her father house in oct-10.now i decided to return to my parents.after about 20 days her father came along with her to my house to accomodate for a mutual understanding.ultimately an understanding was reached verbally.everything was ok for about a week.after that again tantrums started.one day on 24th dec tantrums were so loud that my neighbours intervened.she then called the police accusing us of harassing her by calling the neighbours.police came to our house and me and my father were summoned to the police station.my mother in law is politically affluent and she was waiting with oc in police station.we were verbally threatened by police-and was told to bring my wife home and we should oblige to all her demands.if she complains again we will be put under bars.NO COMPLAINTS WERE REGISTERED AGAINST US.i brought her home and she now lives as a queen ordering everyone to her knees.now i decided to leave the house again to somewhere rented,but she refused to go and will stay in my house even in my absence.sirs,i am a mariner and i have to go for sailing in every few months for 4-5 months.my parents are old and ailing.my wife is notorious and can frame them with rape and murder or may poison them also.PLZ ADVISE WHAT LEGAL COURSE I SHOULD TAKE TO PROTECT MY PARENTS IMMEDIATLY AND EVENTUALLY DIVORCE THIS WOMAN.

Dear Sir/Madam,
Just to brief you on my problem, I got married to a lady named Rekha on 16/01/2009. She was previously married to a Muslim guy and got divorce from him on 31/12/2008. so that means within 16 days of divorce we got married as per hindu law. Secondly she had converted to Muslim and accepted Muslim religion and Muslim name as Shaina (instead of Rekha) but before marrying me she never converted back to Hindu. This girl was working in a Dance Bar in Dubai. I got carried away and got married to her on the above mentioned date. I also sponsored this girl in dubai on spouse visa. After sometime i realised that we cannot get along due to her mentality and her nature and now i want a separation from her.now this girl is asking for money and to take separation. Firstly is the marriage legal?? Can i challenge the validity of the marriage? Kindly advise any other solution to problem

Dear Sir, We got married in 1st sep 2008. and we got separed when we go to christmas to her home on the same year 2008.After that i hav to return alone and we have not met till now.Now we hav a 1.5 yrs old baby boy.I saw him when he was 4 months old.Actually they had not informed us abt his birth.After whenever we tried to see him we had very bad experiance.So we havn't seen him after that.She is coming for neither divorce nor unity.And she is black mailing us in the ground of crulety.When we were together i have noticed that she got sms messages from ex boy friend.Can i get that from telephone service provider and can i use it for my case.
Can any one please guide me on this,few years back i had studied a new delhi high court judgement for divorce on the ground of hiding ugly skin(which means because black moles or black skin)problem to the husband before marriage.I need the judgement details.if anyone knows plz let me know.

one month before my wife has gone with her parents for holiday trip . where she has been forced to see a boy and blaickmailng her that if she won't left me and marriage with that boy they will kill themself and her sister will be left by her husband as my marriage is an inter caste marriage . i have no proof about balckmailing but i have the proof that they saw her a boy . now in family pressure she told me to leave her as she is not adjusting with me and their parents has taken away her to some unknown place ans i am not able to talk to her also . please tell me what can i do .

I am staying in US. I got married in India on 24th July,2008. She is from very poor family. I have plans to come back to India completely so I did not take her to US. After marriage I used to come to India once in 4 months.But we never had good time together. She never used to talk to me. she behaved as if she is not interested in this marriage. Slowly I lost interest in her and marriage. Last time when I came India she was with me for one month but there was no change.I told her if she is like this we can not live together. Then I came back to US. After coming back she filed dowry harrasment, Voilence case against me and my family. Now she is demanding 1 crore to give divorce. Now I am not able to comeback to India because of this case. Can anybody suggest me how can I proceed further in this sitation

wife left house in Dec-08 and filef FIR u/s 498A.
Husband filed RCR in January-09 but the same was taken back by the husband in June-09 as one of relative from girl side interfared in the same by saying to take her back by panchayat.
In July-09 Wife filed Maintinance.(The same has not been decided till now)
Can husband file divorce as sapration of two years as two years has been completed in December-10. as there are lots of trying from husband even in front of court
(while appearing in 125 CRPC), she is not ready to rejoin.
If husband file divorce, does he had to pay alimony to her? (if yes, can she still claim for maintinance under crpc125)

I want to know some points about lawyers and dealings as i want to file a case on my husband.
1)- lawyers fees is a one time fees or on every hearing i will have to pay my lawyer??
2)- My friend who is already fighting a case said that lawyers take the fees of the case, and every case have different expense or charge( rate). Like a divorce case and 125 crpc, PWDV case have different charges. Is it like that ???
3)- I will have to pay for just the case charge ( on filing a particular case) or for the hearings also, like before every hearing will i have to pay my lawyer ???
Please explain me the procedure, is it a one time thing or again and again i will have to give money to my lawyer.

i had applied special merriage act under adc office.my wife american chritshan and i am jatt sikh.we both were present in adc office with 3 witnesses and also with nambrdar.ön 2nd of aug 2010.and 30 days notice expired without no objection.but know they are not giving certificate to me. They are saying both should present there to collect certificate. Can i take certificate witout my wife.and they also want unmarriad certificate of my wife..but my wife and me its first merriage .they are giving too much harshment since last last 4 mnts .can u help me soon as possible

If husband purhcases some property on joint name with wife, without any contribution from wife. Property was sold off. After few months divorce filed and wife started claiming on money receivied from property. Can wife claim on money receivied from property where she did not spend any money? If wife claims for same money during divorce filed by husband is correct?

Please go through the following case and give suitable suggestion/opinion according to law and on merits.
Mr.Shamsuddin a muslim man aged 38 years already married and having issues. While so, he fell in deep love with an unmarried Hindu girl, Ms.Aarthi aged 36 years and on the written promise by Shamsuddin that he would give talak after his sister marriage and marry her under Special Marriages Act, she accepted to live with him under one roof, considering her age to beget a child. After three years of family life, Shamsuddin refused to keep up his promise and has been compelling Aarthi to marry him without insisting for Talak. As she started living with him and Shamsuddin refusing to give talak in order to avoid threats from the first marriage relations, Aarthi is now compelled to marry him without talak. In such circumstances, what would be the consequences for the following acts:
i) According to which custom and convention they can marry?
ii) Without talak to first wife, whether Shamsuddin can marry Aarthi?
iii) If possible, under which custom and convention, second marriage can be performed?
iv) Being a Muslim, Shamsuddin can marry a Hindu girl while first marriage is subsisting?
v) In case Aarthi converts as a Muslim and after one year or so, whether she can marry Shamsuddin and is it valid under law?
vi) In general, if a woman converts Muslim, after how many years, she can marry a muslim man?
vii) What are the legal impediments if they proceed to marry each other while subsisting first marriage?
viii) What would be the legal status of the children born from and out of wed-lock of Shamsuddin and Aarthi?
ix) Whether Shamsuddin can seek divorce through Court and under what grounds?
