Ld counsels,
Husband pleaded the family court for the withdrawal of RCR petition after filing a separate petition for annulment. Wife is filing an IA on that petition for RCR praying for the decree of nullity based on the admission made in the RCR petition.
Wife also filed an annulment petition before husband pleaded the court for withdrawal of RCR petition.
Can the court get into the merits of the case when the RCR petition itself is getting withdrawn. Is the IA maintainable. Should the husband file a counter in the IA although he is withdrawing main RCR petition.
Please clarify.

Dear Sir,
Recently my family is facing some social problems.
My brother's wife fall off from terrace and she tried to suicide but luckily survived.
She given statement during medical treatment that she was slip away and fall off. Once Medical treatment over, she decided to went back to her house. There was no sight of any negative action.
Now she put complaint that my father pushed her from terrace however he wasnt at home at all as my neghbours phoned him to come soon.
She also put Fir that my family members asked for Dowry & harrashed her.
Now my family members are away from home and trying to present in front of megistrate as soon as possible with some gurantors.witnesses and lawyer.
At this stage have fear that Megistrate may not release them immediately and they may have to stay at police custory.
Please advice the best action to do initially for peace of mind and went back to home then will carry on matter in court.

I am going through a court matter in the family court for a divorce. My wife had on her own accord without my knowledge left the house and filed the divorce.
Is it easy to get a record of sms's of mine from the service operator and would it be easy to prove in court and would it be legally accepted by the court.

My wife left the house without telling me and filed a divorce as per muslim law. We are shia's. This has been over a year and the case is still pending in the family court.
As she has left me and as per shia law could I have an affair with another lady. Would it affect the case.

I am contesting an Annulment/Divorce case filed by wife on ground of my impotency just one month after marriage. Counselling and mediation already failed. She somehow produced virginity certificate in her evidence session, and I will also produce my potency certificate in my evidence session. In such a context what will be the fate of this case? What will be the judge's next move? What else could I do to defend myself? plz help

RESPECTED EXPERTS,
My wife left me in 2002,now living in her parental house.Since then we have no relation as wife and husband.On 2007 he claimed maintenance for herself and child(one girl child) and court allow the maintenance petition and am paying them maintenance since then as per court direction.We are Hindu by religion.
AND in 2010 I filed Divorce Petition from her which I lost and did not get the divorce.
As I am already 46 years now, in depression as neither she accept divorce nor want to come back to me.
MY QUERIES:-
1.-What is best possible way out for me from this trouble.??
2-I am thinking for another Divorce Petition in place where I am serving(I am serving in a State other then our native state ).Is my Second Divorce Petition will be maintainable in Court.
3-What could be the legal effect of my concealing the fact that 'i have lost one Divorce Case earlier' in my intent Divorce Petition.

Mr Y (75) married X1(65) and has got daughter A (45) and A has married and got one son and 2 daughter.
Then X1 is divorced from Y and living with A and her husband. However this divorcement is not leagal. as per village punjayat, 40 years before they had got divorce. right now we do not have that paper. (it is small bit of paper)
Then Y married X2(60) and has got daughter B1(40) and son B2(35).
Now Y has passed away without writing will.
Some of his property (self earned) has transferred to B2. some of the is not.
Question is , is there any share for daughter A1 on property of the Y self earned and ancestral property

Sir,
I booked 498A and DVC againt my husband and in-laws. I have 3 years son. After case
they came on bail and came for compramise.I was staying his father's named (self acquired) house.
My husband with his lawyers plan when maintenance case running he
has given money. The same i informed to judge when he asked and i am living in his house. The judge closed the case after the day he stopped comming to me and not giving any money. In DVC i informed the same. Now DVC is in trial. In DVC he claimed that he not having any property on his name and no job he is daily worker (We are unable to show the evidence of given dowry,gold). Now my parents are feeding me and to my son. Now for my son study also need money how can i claim? If i live in his father named how can he refuse to give maintenance to me and my son. If he say that he is daily labour court will tell to give maintenance? Pl. advise me how to claim maintenance to me and to my son ( for study purpose also.

The case is of my sister,she got married five years ago and after having a child problems start in her life. We have filed application under DV act and also filed 498A complaint.
My brother in law has given evidence that he has no job and doing free lance work and not earning much to pay maintenance.
My sistedrhas 4 year old boy child. Court fixed Rs.2000 interim maintenance, but brother in is not paying it regularly.
He placed a letter from his present employer that he is terminated from services. we are no having any proof of his income. He is earning Rs.25000/- pm and working with the company since last 10 years. He is not ready to take child with him and even not ready pay single pie.
We have created fake id as recruitment consultant and send him job opening mail, in which he has sent reply along with his Resume and also mentioned that his current CTC is Rs.25000 pm. He also appeared for Interview and submitted personal history form along with academic certificates. We have also taken videography of his interview. Can it be considered as evidence ?
