My wife left 2 childrens with me in Dec. 2007 under her family influence. I tried my best to get her back home but failed. I also tried to file a petition u/s 9C. As my inlaws are working in Judiciary they came to know about this and by cheating before filing under Sec. 9C they file 498-A against me and my mother in June 2009 and there after another criminal case u/s 323. i was arrestted both time and was sent to jail for 12 days and 4 days. there after i filed a divorce petition on ground of mental cruelty in Nov. 2009 and summon were serviced in March 2010. More 15 months has passed thereafter she has never come to court nor replied to my divorce petition. Judges are under her family influence and intensionally by fault Judge has given more than 6 dates for re-concillation at gap period of 2 months. i have been appearing on every date. Judge and their lawyer are delaying the case intensionally to harrass me. I wish to ask how i can get divorce. and upto how many chance a judge can give for re-concillation. And if she does not arrive in next date what should i do to get early divorce.

Is it possible to make a father-in-law a party to the proceedings before family court.
Can the petitioner add him as a respondent before a counter is filed by the spouse respondent.
Should this be done as a amendment to the petition.
Please answer. Thanks.

Sir(s),
Interim maintenance orders passed against me payable from time of filing litigation. I can pay continuously from now but cannot pay lump sum amt from date of filing, however, I can pay that also slowly. My question
1) Can Court make installments for payment of arrears i.e. from date of filing till date of orders as I really donot have lump sum amt for payment.
2) If I voluntarily paid every month some amount of money by cheque to my wife during pendancy of 125 petition, can I claim adjustment of it in the interim orders for the said period since I have been directed to pay maintenance to my wife , which I was already paying?
Thanks in advance

Learned COunsels,
Can a marriage be annuled without trial by the consent of the parties in a petition filed under section 12(1c) of hindu marriage act.
If any suppression of fact is admitted for annuling the marriage can the court proceed to annul the marriage by the consent of parties. Or is it mandatory for the court to appreciate the evidence in all cases.
Thanks in advance for answering.

section 9 after file the divorce case
My client is belongs to gwalior his marriage is conducted in Ujjain where his husband was living with his family members.
Due to major family crises my client registered 498A case against his husband with his family members in may 2009 in ujjain and come back to her native palce i.e. Gwalior. In Gwalior she has been filed the divorce case, section 406 and section 125 case against her husband in may 2009.
But her husband is also file the section 9 case against her in july 2009 in Ujjain.
My question is that, Can husband file the case under section 9, when wife already file the case of divorce against him prior to husband? If she will not attend the section 9 hiring of ujjain what will be happened? If she go at Ujjain can she will claim the spending money from husband?
