SONS

can the sons aged 11 and 13 yrs file a suit in court against mother for neglecting them and abandoning them and requesting the court to come back home? The mother left them to suffer one month before their final exams. They did not have proper food and were living alone at home as the father had to go to work. The family returned only last year from abroad to settle in India and the sons cannot speak the local language. PLEASE ADVISE

partition suit time frame.

Thank u for replying to my previous questions. Still have some more queries

My father married my mother without divorcing his first wife. my father expired 28 yrs ago.
when my father died i was 5 yrs old and my elder brother 10 yrs old. we moved to the city and never returned back to our village till now.
My step brother wud send us some money by money order initially and then later on he wud come and give us cash. He stopped giving us money after 2001.

Im 33 yrs old now and my elder brother is 38.
We had always known that our father had left behind some properties.
After my fathers death my step brother got all the property transferred in his name.


Questions

1)Does the 12 yr time limit for filing the partition lawsuit applies to us since i turned 18 yrs old in 1995 and shud have filed the partition suit by 2007?

2)can we still file for partition?

3)If we cant file partition suit, what else can i do?

Marriage

Dear Sir,
My name is Ashish Joshi. My age 27 years. I love one girls last 2 years. She is 25th years old. There parents are not ready for this marriage. My parents is ready for marriage. We dont want to marry in court. We want to marry in arya samaj. Can this is possible. After marriage it will take some issues in her home. We are not denyed for registration of marriage. We will register our marriage through registrar.
Is this valid. Arya samaj marriage ceritifcate is valid.

can we obtain succession certificate in case of immovable property

If not than in case of immovable property where a person is died intestate than what is the procedure to bring on record his legal heirs

RCR

Can a court ORDER the wife to go and live with husband and sons (11 and 13 yrs) if she has left the matrimonial home without genuine reason. When the husband is now taking care all alone of the sons in their studies and other activities and husband wants the wife to return immediately, and if wife is not willing, can she seek more counsellings and time? Can the court "ORDER" the wife to leave her parents home and return to her matrimonial home immediately to look after the sons needs? PLEASE ADVISE

How to challenge Sessions court order

I would like to know the procedure for challenging orders of (a)Sessions court order of Sessions Court/Mumbai. (b) High Court order of single bench judge/Mumbai.

Someone told me that an high court order of single bench can be challenged in muti bench. However I am not very clear on this. Please guide.

PLEASE REFER CASE LAW

Honourable members there are several case laws in 125 Cr.P.C. that where husband performs second marriage, subsisting his first wife, second wife is not entitled for maintenance under 125 Cr.P.C.-

But I require- wife whose husband is alive,if remarriage with a widower and asking maintenance under 125 from that widower. She can't claim maintenance.

That lady has hypnotized the man and had included her name in his pension record also. Please help.
