Hi,
Need a legal suggestion from experts on this. My sister got married in last month. She was staying with her husband since then. But within a month she got bitten up from her husband so much that she got inner injuries. He is kind of angry person who immediately get angry on small small things. Now she is with me, and i want teach her husband a lesson. Please let me know what i should do legally?

Hi All, Need your guidance, actually i m a muslim boy and loves a hindu girl we both are 25 years old and enough maturd and ready to marry with each other Currently we both are working in MNCs n our econmcl condition is good to survive our life after marriage .We both told to our families about this relation .....my family is ready but her family is not ready so we have decided to marry under specil marriage act as we both don't wnt to chnage our religion and respect each other's religion.....Now the problem is that her father have given threat us that he will kill us...and he will sent my family into jail .please suggest what can we do for our protection....we both belongs to Meerut nd her father is lawyer and has good admnstrativ power.

My divorce case is in Calcutta high court. As per my lawyers, the 2 judges have almost made up their minds on going ahead and granting divorce on grounds of cruelty, after all evidences are provided to the court (including 498A done by my wife).
Now, along with the divorce, the judges wants to suo motto and order me to provide a onetime amount for the child (my daughter, who is 6 years old i and in class 1)for her upbringing who will stay with her mother (my wife), though my wife in her application has not asked for anything.
My wife is very well employed and highly paid, so she is not eligible for any compensation.
The court on asking my wife, how much she thinks is justified, she claimed an absured amount of 40 lakhs. Though the judges dismissed this figure, they insisted my lawyers and her's to settle this amount by mutual discussion. On repeated parleys by my lawyer with her's, now she is asking 25 lakhs.
Neither of these is something which I can pay. I have told the court that the maximum I can pay is 8 lakhs. My lawyers have told the judges that let the court decide a fair amount, since the absurd amount claimed by my wife can't be met my me. Outside court discussions makes no sense. But it seems that the judges are are also not clear on what the figure should be and didnot take a position.
The judges gave the next date on 14th, which is this Thursday. As per my lawyer, its highly likely the order is given on this day, but again there are chances that its postponed by the court by another date.
I have even said to the court that if my wife is finding it so difficult to raise my daughter without 25 lacs, let the court give the custody to me and I will raise her up without any compensation or aid from my wife.
My question is, aren't there any scienfic method of calculating the compensation (one-time) which the judges can apply and come to a reasonable figure?
In this situation, what should me and my lawyers do?

My son has applied for judicial separation on 30th May 2011. The first hearing is fixed on 29th August 2011. Wife is working with a package of 5.18lacs p.a. In retalliation of our petition she has prayed to the court for maintenance of Rs 15000/-p.m and litigation expenses of Rs 33000/-. My son has no assets in his name except of a car. Will he have to pay this maintenance?

My client applied for divorce in OP No._____ of 2007 and subsequently her husband applied for conjugal rights in OP No._____2008 and the proceedings was going on. During April 2010 he along with his counsel convinced my client and applied for divorce with mutual consent. During sigining they had asked my client to withdrawn the main OP No._____2007 which she had done. Subsequently on the final hearing of 13B the husband has not appeared in the court and the court has dismissed the petition. The husband has wantonly done this.
Is it possible to restore the main OP____2007 which was withdrawn by the wife under wrong guidance.
Kindly suggest, if possible cite relevant judgement on restore of petition.

sir, me and my wife live saperately since 4 yrs. she had with me only 2 month after our marriage . we had a baby girl 3 years old.she had done sec-125 against me . she is under totaly command of her mother so she had done like that . But i want she and my child so i had done H.M.P. against her to come with me and live with me. she had done sec-24 against this application.After so many interruptions of our family friends and my lawer she had come with me but she had refuse to withdraw her cases ,though i aggreed because to save my married life and for the future of my child.But after living with me only 23 days she returned to her house and put Sec- 498 a against me.I was shocked at that time. In court ,in case of sec-125 in cross-questioning, she had refused to come with me.So i had withdrawmy H.M.P.but her lawer did not agreed to withdraw my application and finally court had ordered 2000/= p.m. from the starting of the case.Sir, she is working as a teacher and getting 5000/=p.m. and after 2 yr. she will get 14000/= p.m. Sir, my salary is Rs.40000/= 1.SIR SUGGEST ME WHAT SHOULD I DO? 2. DURING MY CROSS-QUESTIONING HER LAWER ASKED ME TO SUBMIT MY PANCARD COPY AND MY LAST 3 YR IT RETURN. SIR SHOULD I HAD TO SUBMIT THAT ? SIR, REPLY ME SOON . I M VERY TENCED.

My marriage was carried out on 29 May 2011, engagement was on 23rd May and intercaste with arranged through Marriage beauro.
After reception (on 30th May) we both came to brides home and 3rd day we have to go to my house.
But she was not interested to come with me to my home so myself only gone.
From the second day onwards she is asking for divorce, i really shocked what went wrong.
I asked so many times but she didnt told anything for the first one week.
Some friends and her close relatives had influenced then she diverted her attitude.
After that she started scolding and rude laungage because i kept silent and asked her to tell the reason then i will agree for your request.
Then every time one new reason is telling, she says 'i am not having properties', not handsome, not having a car and etc.
But what ever the information is to convey all those things i clearly informed before marriage to the girl, to her parents, to the marriage bearo aboutmy Salary, company, qualification, property 9new house constructing), village house status, life style, food habits, health condition (i have sugar), when we
met through marriage beauro she agreed for all my qualities. Based on that i though t she understood everything then only we moved further.
Her father was not present at the time of first discussion because intercaste.
Then she forcibly managed to convince their family memebers, otherwise she was in a state to arrange a step father for Kanya danam.
Beauro person was stored all the messages and discussions of the girl before the marriage. She agreed for the marriage.
She was told not interested in sex on first night then we didnt had and i did not forced too. She required some time, I agreed.
On engagement day due to miscommunications to their family members the function was delayed.
We straight way told that if you are ready for marriage within a week then come for discussion otherwise stop.
They were agreed for that but their relatives changed the situation and bit delayed. On the day her phone was lost, we dont know how.
After marriage they raised the phone issue, she suspects that phone was stolen by my sister.
Then i put a police complaint on bearo girl since on that time she was there. After discussions with police i taken back the complaint.
Now the problem is she dont want to live with me and requires divorce.
Her parents says take her to my home and she is not ready to come. That too we also cannot take her forcibly.
I have changed my house to other area to start new life, but i am moving here and there since family man without wife.
If i take her or do not take her to my home what will be the future life consequences with this type of attitude and behaviour. dont know

Hi this is sravanthi. I got marraiged in 2008 oct 28th. now i am 5th month pregnent. My husband is asking for divorce. when my parents asking for the reason he is saying that "our attitudes are not matching so i want divorce". basically i dont want divorce at any case. His parents also encouraging him. He is staying at my mother-in-laws home only. So what can i do. If i book case on him i think he wont come back. Is there any chances to come back. I dont want money. I want him thats all. please can u please suggest me the proper suggetion.
