Divorce

Husband is taking divorce from wife in family court. Wife earns more than husband and hence maintenance factor would not be necessary. They stay in flat with very very old mother of husband who is not prudent bcos of her very old age. Flat was self acquired by late father of husband and presently in name of mother. Mother is heavily dependent in old age on wife.After mother flat is bequeathed to husband (or son of mother). Under such circumstances what options are available to husband for divorcing his wife???

Good evening experts. In a divorce case can wife claim maintenance when
(i)she's earning little more than husband.
(ii)what documents should be called for by husband to prove this in court.

Maintenenace

Wife is earning 4500/- p.m. so she is able body and she left home with her independent decision and than she had withdrawn mutual consent divorce petition without husband's knowledge and ex-parte with her mother. And than she has filed 125 for maintenance but she not stoped here and harassment was continue from her at husband's work place so husband has filed divorce petition and after the service of notice of HMP than she has filed DV case? Is it maintainable? Please provide some judgments about able body is no entitled to get maintenance and divorce judgments in favour of husband.

Ex Husband mentions fake items

I had filed a case against my ex claiming my belongings. He did not appear in the court till the last hearing and on the final hearing day he appeared in court with a paper mentioning a list of itmes he can give back. I had claimed jewellery and furniture back but he has written the things not at all mentioned by me.And those are his own throw away and used items (as i knew about them during marriage). Those things dont belong to me and i dont need them as they are already perish or broken while i was in the house itself. How can i fight my case claiming the same items and its value not the items as such?The judge told me to take the items but they are of depreciating value and also perished. I want the equivalant amount.

Alimony

My father has not been paying alimony even after court order. My parents got divorced in 1992. They were married for 8 years. We filed a case a few years back. But unfortunately we did not find a good lawyer. I am a student and my mom is a home-maker. We ahve no osurce of Income. Please guide us.

i am on bail. how to protect my money in the bank

i am under 498a and DV.
I put money in mutual funds through online trading account which is not connected to the salary account(separate bank) to avoid blocking of the money and funds.

Steps after Mediation Failed in 498A case

Hi,

My sister has been through a bad phase of Dowry torture by the Groom side for last 2 years. Finally, we had to register a case under section 498A in Ghaziabad. The case was directed to Mediation Center by Allahabad High Court after the Groom side filed petition in High Court to Quash the charges against them. The case had FAILED IN MEDIATION and the report is sent back to the High Court where further hearing is yet to happen.
Question:-
1. In this case when the Mediation is failed, will the Court dis-ban the Stay ordered for Arrest of the Culprits (Groom + Family members named) ?
2. What will be next step from court and Police in this case as there was no action by the Police after the case went to Mediation?
3. Does Police Investigating Officer has dependency on Court's Order to submit their Final Report?

Please suggest.

termination of engagement on the ground of concealment of facts

One of my frind recently engaged with a girl with due Hindu rituals.After some day he came to know that the girls's mother was 2nd wife(not married according to Hindu rituals) of her deceased father and also her caste is un-known.Now after knowing the fact my friend wants to cancell the engagement and donot want to proceed for marriage.But he is apprehending that once he will express his desire to the girls's family, they may file dowry demand FIR against his family.I may request you to suggest what precautions shlould my friend take before terminating the engagement.
