If I can not get a degree of judicial Separation
and 2 years are completed of separation between me and my wife
then i case a file of divorce on desertion

Dear Sir,
With respect to you , Mr Ravikant Soni and other expers' valuable opinion,Firstly I would like to thank all of you. As the case is proceeding in high court, last month I got little reprive. According to temporary judgement,husband has to bring and leave the child to my costudy, 3 times weekly(4hrs per visit)as observation period.Whether I can wait until clear the habias case and then freshly file the case for maintenance and custody of child, if he is not willing to compromise and stay with me? His mother is not accepting me to stay with them from beginning and we were staying in rented house only. Since June 2011, my parents are sending money for rent and other things. On this arrangement, I can't prolong present situation and ask more money from parents, kindly advice me the economically feasible way to proceed with. Please tell me what is DV act.

rESPECTED Experts,
I am very frustrated as I am not getting any quick relief under this Act which I filed on 18th Jan'11.
On july 4th I filed for interim maintenance but My FIL filing diff misc cases and delaying the whole process.I am in shared household of my husband which is made by husband with bank loan and as the land was in FIL'S name he is also a co loanee.
In last petition in Augst FIL stated that the court should be changed and hence it should be transfererd to CJM from the subordinate court.But it was just about to be decided by the CJM where to send the case FIL filed that it was his mistake to apply for changing the Court.Will it be in favour that CJM has sent it back to the same court again.
He has several times doing this kind of things.Files, kills time and then withdraws the case which is causing lot of problems to me as i have to paying money to my lawyer unnecessary dates.
What must be their intention behind doing so?Can I claim compensation for causing so trouble to me and wasting valuable time of hnrble Court?

Sir,
My wife's father died intestate about 10 years ago. He is survived by 2 sons and 4 daughters.
He had some self acquired property and while acquiring the property he had purchased land in both the sons names (minor at time of purchase).
One of the sons is right now enjoying the property and doesn't want to part with the equal share with any of his sisters.
He has also sold some of the land to a developer without the consent of the others.
We were given to understand that there is a recent supreme court judgement that there is a time limitation (12 years) for filing the partition suit.
Will you please let us know if there is any such time limitation?

I have given a 3 notices to join the conjugal society to my wife. They have given a reply that i have taken dowry and domestic violence but they know that they have not given a dowry apart from that they have also sent a lawyer notice to my organization as a maintenance and many things which is not real in fact.The college has given reply that is purely a family issue and is not related to organization.I issued notice to join but what they expecting from me i am not able to guess. I have filed a petition against them under dowry ,harrassment that to deny i have not taken.Since my spouse is preganant i told that in Islam its husband responsibility to take for delivery and i told to join and stay with me but they refused to do so.To resolve this issue under muslim and civil law what is a proper suggestion and also i have kept this word in our jamat ulema they have rejected to discuss on this issue

IF ONE WOMAN ILLEGAL RELATION WITH OTHER MALE BUT SHE DID NOT RELIEVING HIS FIRST REAL HUSBAND DUE TO A LOT OF PROPERTY IN FIRST HUSBAND CUSTODY. HER FIRST HUSBAND WANT TO DIVORCE HIS WIFE DUE ILLECT RELATION OF OTHER AND HIS BIRTH CHILD MIS MATCH OF DNA FACTOR WITH FATHER DNA. WHAT GROUND HE FILE THE DIVORCE APPLICATION FOR DIVORCE. Is declaration of Marriage as Null and Void on the ground of recurring mental disorderliness (Schizophrenia) of a spouse possible?
Does suppression of fact as regards mental condition of a spouse enable the other spouse to have their marriage declared as Null and Void if the mental disorderliness referred to in previous question gets cured?

Dear Sir,
I am hindu girl, married to muslim boy for 5 years and having 2girls. on 08.06.2011, my husband absconded with my elder daughter age:(3yrs). As I reported to police, they regd FIR and I requested to high court for habias corpus, then he appeared to court with girl. Later case referred to family court, but he did not agreed to compromise. Now the case(habias corpus) in High court and every month I am appearing to court, as per the date. Since I am staying in rented house along with my 1 year old daughter and living with the help of money sent by parents. How long the case will continue and when I can get my daughter back, if he want to divorce me. Now I am in very distressed status. Kindly suggest any speedy solution to my problem.

Respected Sir,
Can Dowry and Domestic Violence cases be filed after filing Divorce case by wife itself.
Marriage took place in Feb 2010, RCR case filed in Jan 2011 and Divorce case filed in March 2011.
Husband and wife lived together for only two months after marriage.
