Nominees right

Dear Expert,

My father died last year.

He has a Fixed Deposit in bank. He had shown my mother as a nominee.

Now Will get any share of that FD,eventhough my name is not mentioned as nominee by my father.

Or only my mother will get it?

i dont wanna give my wife divorce...but they took advantage of my frustration & made me sign on dummy paper that both the party r ready for MCD & will file petition for same in future...THEY ALSO TOOK SIGNATURE ON VAKALATNAMA...is this enough for filing petition for divorce...

Legal heirs

dear sir

My mother(Hindu) having some properties

from her father(Not father in law)(died in

2002).

my mother having only five son.first done

died recently.

Now my mother died in-tesitate then who are

legal heir of my mother to share the above

properties.

legal heir of my mother

(1) widow daughter in law (No Child)

(2) Remaining four children

female died in-tesitate class 1 heir is son and daughter not daughter in law.

is correct?

Null&void marriage - mental agony

As stated in my previous query, My husband has send me summom throu court for Null&Void Marriage.
Can I ask for Money (defamation) for making me mental agony as he has disssolved my marriage which was arranged by my parents with 25lak?

Returning of gift articles after reaching compromise in caw

Hi All,

Please suggest do's n don't for returning all gift articles to wife on reachning compromise in CAW, where some witness and we both signed that we are agree on these points..
1. One time amount
2. Return gift articles
3. Mutual divorce filling and withdrawal of all cases.
Pls suggest on legal terms, to avoid any conflict from there side in future.

Null & void marriage

my husband has put Null and Boid of marriage. Grounds that he has used is - 1. we have forced him for marriage. 2. He is not interested in marrying me. 3. Before marriage i got notice from lawyer that he is not interested in marriage.

But he is a cheater. He loved me for 8 years and married me unprofessionaly and cheated. So i complained in police station for marriage. Marriage happened after that. In-laws made us to spend 25lak for marriage.

Now i have got the summon for Numm& Boid of marriage?And he deserted me. How to proceed for it?

Surname after marriage

Hello,

M having matrimonial dispute with my wife. She has just enrolled with bar council of Delhi.
She used to write her surname of her father. is it correct to write her surname of her father instead of her husband.

Appropriate applicability of sec. 482 & 483 cr.p.c.

Kindly advise me the following:

1. Whether any time bar is applicable to file under sec. 482 Cr.P.C. quash petition at High Court against false u/s.498A of IPC cases?

2. Whether the filing before charge sheet or after charge sheet?

3. Whether 482 quash order permit to file malicious prosecution?

4. In case totally false 498A case, which is recommended 482 or 483 Cr.P.C. in terms of filing of Malicious prosecution?

Divorce

I have filed a divorce suit under Section 13 of HMA under mental cruelty and desertion against my wife after 33 years of marriage. I have sufficiently good grounds of mental cruelty and desertion.
She draws a salary of 75K per month.My son is 30years old and working well and supporting himself in Mumbai.I stay with my very old bedridden 95 years old mother who supports her instead of me beccause she is not prudent,she is uneducated,she has no knowlege of legal succession process,she has a destructive behaviour of disowning her own daughter 15 years ago etc etc. Dear experts how can a old mother affect this divorce suit though it is a husband-wife issue.The property is to come on my name after her life time. Mother has no transferable rights.
