I am Scheduled Caste Hindu Balmiki by birth but I like Christianity by faith. My marriage is solemnized in Church because my wife is Christian by birth. Now, we both are in matrimonial dispute. She leave my home from last 1.5 years. I put conjugal rights u/s 32 of Divorce Act 1869 on her. We have a girl child aged 2 years who is presently with her. My conjugal rights case is on evidences. Can my wife challenge my religion in this petition? She says you are Christian which is covered under Backward Class, but I said that I an SC by birth, I have only faith on Christianity. Please help me on this issue. Send some citation so that I defend this in the Court.

I am a divorcee and one man has given me commitment to marry and was in relationship with me for more than 8 years. Can anyone say how to take it legally to make him marry me as it will be a bad name and a scar on me. After I informed everybody he has backed out. Kindly let me know whether I can file a case against him for cheating and giving false promise and lead a live in relationship with me. what sort of case can be given. In Marriage petition if petitioner wife fails to prove allegations and hence she want to withdraw the case. Can the Court will allow her to withdraw the case? Is my consent is necessary for her to withdraw the case? If yes, than I don't want that court mention in its order that petitioner is allowed to withdraw the case and she is directed to join the society within one year. Can I pray the Court not to mention such direction in its order?

parents aged 58 spent 4 days in jail for judicial remand due to false 498A. in another one year he is going to retire. he is continuing in his job now. after his retirement, will he get his retirement benifits (if his name is in charge sheet, and case is running)?. please tell me whether he gets his retirement benifits or not?.is there any judgment on the same kindly reply

Hello experts ,
We have been separated from last 1.5 years. Child is 1.5 years now. Husband files RCR Wife filed complaint of 498A files reply to RCR and demands maintenance on note that she doesnt have source of income to sustain. I will file Visitation shortly. However can i file custody at this age of child ? (1.5year) What are the chances of getting child custody ? Child has hardly stayed with me for couple of days till date and hardly recognize me .
Please suggest.

I and my wife have filed application for mutual divorce in the court 8 months back. We are living separately for tewlve months. On second date she did not appear in the court. What if she does not appear again in the court.

i am working with a multinational company and presently my posting is at Canada. my wife is also highly qualified and working as a professor in a college in Mumbai. i've a younger son age of about four years.he is living with my wife. since last more then four years my wife staying with her widow mother and divorcee brother at her parents' house admeasuring about 800 to 900 sq. ft.
under influence of her mother and brother she filed a petition for divorce. after 2 -3 dates of filing the petition she filed an application for interim maintenance. in those application she demanded the huge amount of maintenance. in support of her claim she produced a copy of a leave license agreement of flats (might be combine flats as in the address, the flat no. mentioned as 104-105.)admeasuring about 1000 sq. ft. as a shelter for herself and her son!, then she produced the bills of purchase of furniture and household items, receipts of international school"s school fees stating that my son studying in the said school. then demanded maid servant's salary for care-taking of child and for many more things she demanded about a sum of1,50,000/- p.m. as interim maintenance from me.
in support of her claim she produced the salary slips issued my company. i was shocked seeing that the said salary slips are of the years of prior to my marriage!
she also made false allegations against me that I'm alcoholic and living luxury life etc. she also claimed that i am having many bank accounts (mentioning with banks' name), credit cards, debit cards etc. but the fact is that i am living simple life. i do not have any bank account accept my company has opened for payment of salary. i do not have any credit or debit card.
my question is that weather my wife is entitled to get such a huge amount of maintenance as she claimed? can i sue her for breach of trust as she has stealing my salary slips. can i sue her for defamation as she made false allegations against me in the application? what should i do? plz. help me.
plz. give me citation in support of my defense if any available.
