Divorce

Dear Expert

Last 8 months back I got married. Now my wife is pregnant. But she doesnt want to live with me.

But I dont want to loose her. I want to live with her.

My father in law and brother in law forced my wife to take divorce.

Will she succeed?
She is class-1 state govt employee.

Sir, I have three children and their marriage took place on the following years:

Daughter: 1999 (living separately since 1999)
Son : 2004 (living separately since 2004)
2nd son : 2007 (lived with us for 3 mths only

My second son's wife filed a DVA in July 2011 against my second son, me, my wife, my daughter, son-in-law, first son and his wife.
as if we were all living together jointly, which was totally false. The Respondents have separate proof in the form of Ration card for living separately. The petitioner has filed interim petition seeking repayment of dowry and 75 sovereigns of gold, while the fact is that no dowry was paid at the time of marriage and what was given to her in the form of jewels by her parents was known to us. Further, in her petition, she quoted two or three false incidents, which were totally false, after going separately within three months of marriage. We have filed counters for all the 7 respondents and the inquiry will be commencing at the end of this month. As respondents 4, 5,6 and 7 (daughter, s-in-l, first son and d-in-l respectively) are not willing to appear in the court for the sole reason that they were no way connected with this case.
How will the judge go in this situation? i.e whether he will order for compulsory appearance or he will accept the counsel's submission for non appearance in the court. Please explain

Adoption of my sister's children

it is not her father's property it is her mother's property and she is my sister. if yu check I had put a query of father's property without will. Where my sister is no more. I need the property of my sister to be shared among her daughter's. The truth is that the second is not born to the same man. My mother thinks that the property will nt go to her.

I would like to know if I can adopt her.
I am ready to let go my property for her.

Hello Everyone,

I’m Asghar, married 2 years back. Now I’ve a daughter who is 1 year old. My wife has applied for Khula (Divorce) in local Jamat (Mosque). She had mentioned in her petition that I’ve illegal relationship with my sister-in-law (Brother’s wife) which false and baseless.
According to Shariah (Islamic Law) she should provide 4 evidences who should be eye witness and those guys should have seen that when I was indulged in illegal relationship with my sister in law. She’ll not be able to provide any evidence because that allegation is completely false.
Jamat (Mosque) had 2 discussions with me and my wife to reconcile and cancel my wife’s Khula petition; however, my wife dint agrees for that and she clearly told that she need separation. In fact Jamat (Mosque) asked me to take separate home near by my in-laws house and keep my separate family.
Finally Jamat (Mosque) asked us to submit the petition from both (Me & my wife) the side that we want to live together, so that Jamat (Mosque) can cancel the Khula (Divorce) petition and keep the couples in separate family. As per Jamat (Mosque) instructions I submitted the petition; however, my wife has submitted the petition that she need Divorce and she don’t want to live with me even in separate home. She clearly mentioned in her petition that not to force her to live with me.
I’ve all the Jamat’s (Mosque) discussions as recording in my mobile for proof. As per the suggestions from the legal experts of this forum, my wife will not be able to get any alimony even if she approaches the court legally, because I was ready to live with her and she’s the one who doesn’t want to continue this relationship.
My question here is, according to Shariah (Muslim Law) what and all my wife has to return me and what and all I should return to her after Khula (Divorce)

Adoption of my sister's children

HI,

We are three sister's. My second died during her delivery. I am the last. she has two daugther's. Her husband only speaks to the elder daughther and not the second. Me and my mother have the custody of both the children, my mom being the primary guardian and being the second guardian. I am married and I have a son. I want t adopt the second child as she thinks that I am her child. My husband also wants the same. My mom is saying that it is not possible as the part of the share which she would receive will not go to her. she changed her name and taken guardianship of her. I want to know will she able to get property if she is adopted by me of her mother's.
Please give me solutions as I don't want to lose my her. her father is married and is having two children.

DEAR SIR,

MY WIFE HAD FILED A DVA AGAINST ME & MY FAMILY FOR MAINTENANCE & RELIEF. AFTER THAT I FILED RCR FOR RE-UNION WE HAVE A MALE CHILD AGE 3. THE ALLEGATIONS SHE HAD GIVEN ARE FALSE. THERE IS A STATEMENT OF HIS FATHER STATING THAT "ALL THE ALLEGATIONS IN THIS CASE ARE FALSE" WHICH WE HAVE RECORDED IN THE CD. ON THE PREVIOUS HEARING WHEN WE PRESENTED THE CD HE SAID HOW CAN I USE IT & SAID BRING THIS WHEN THE TRAIL BEGIN.NOW THE JUDGE TOLD US ON THE NEXT HEARING IT WILL BE EN-QUERY .

1. When the time of en-query can she include more allegations which is not given in the Main DVA petition.
2. Is me & my family should go to the court every time.

Payer not paying the amount

sir/madam
my mom gave an hefty amount of rupees two lakhs fifty thousand to a person, she made an agreement that she would requite the net amount after 3months, after which my mom called her and said that the duration to pay the amount is lapsed and asked her to pay the amount immediately to which she borrowed a verbal attack with my mom n said that i need another 6 months etc etc,but we came through different channel that sheis emigrating to a different country in a month, but she is frauding us by telling that she will give back in 3 months,my mom lost the genuinty in her words and wanted to file a suite, i would like to know whats the procedure to file a suite and also any means to block her passport till she requite us our net amount... as matter of solid evidence v have a promisorry note drafted and signed by her and also two bounced cheques...please do assist us the proper legal channel and how to resolve the case as early as possible

Maintainability of dv after 1/2 years separation/desertion

Hello Experts,

I am looking for Judgment and your reply towards the situation in which Husband and Wife not living together since last 1 Year.

Is Domestic Violence Case Maintainable in above Situation?

If YES, Is there any judgment of Supreme Court relating to above situation?

Before marriage

If say in the court that I had intercourse with my wife even before the marriage Will i be punished?Before marriage she was minor so i am confused so pls reply me.She was Sixteen years old when it was first.
