Mental cruelty on phone

Husband is in India and Wife is in abroad country. Husband told angrily to take divorce in disputes with his wife while they communicated on telephone. But, his statements during quarrel were only because of his anger, not seriously.Wife has filed divorce on the ground of Cruelty, Section 13(1)(ia). She has stated in petition that her husband is not interested to live with her and asking for divorce. But, in real, Husband wishes to live good family life with his wife and does not want to take divorce. now, If wife shows in court the recordings of telephonic dialogues in which husband was telling that to take divorce then it is tends to mental cruelty? Can court grant divorce decree on this matter? Husband was not asking any dowry and not uses abusing word during their communication. Although wife alleged about dowry demand and using abusing word.

My grandfater want to sell huf property please suggest

Dear sir,

my grand father and my father purchased one property in 1983 on the name of my grand father and my father as a karta of huf. in 1984 due to an accident my father had expired. right now my grand father want to sell this property but my uncle (my father's real elder brother ) creating problem in sell property .. i want to know who is the actual owner of this property and how my grand father sell this property and , my uncle if claim then in which term they can claim and how much they claim.

Husband and wife dispute

Sir,
One of my friend married 18 years back and having a boy of 15 yrs age. My friend was a NRI and immediately after the marriage he has taken his wife too and she was also employed outside India. AT the time of marriage her family was financially poor and my friend has not taken a single ruppee suppport from her family. Her younger brother who is gone to USA on employment has arranged an employment for his sister and my friend has agreed for her to travel along with their son. The mother and the child lived there for nearly 6 and a half years and are back in India now. Expenses for the visa process from outside India where my friend lives was everything met by my friend. Moreover 4 years back e paid their Airfare by cash to make them a trip to India and go back.
Now after coming back to India second time she is finding some difficulties in re arranging her visa to USA. She now lives with her parents at their house and having no communications with my friend. Their family now is throwing 110 complaints on my friend now. My friend is in a real dilema what to do?. He is thinking of a legal separation. He is looking for sincere advises from the experts.Kindly advise.

Termination of pregnency

sir shilpa is my client,
and shilpa get married with shayam on jan 2000.now dispute arise on dec 2000.her husband shyam wants divorce on the ground that she terminate her pregnency thrice since 2000. and shilpa said that in the earliar years of her career and looking to the nature of her job she may b not able to look after her child properly. so plz sir tell how i defence my client shilpa

My name was wrongly mentioned in the Birth Certificate of my child, how can I rectify this.

Correct Name is:
Bandi Prashanth Kumar

Which is Mentioned is:
Bandi Prashanth Kumar N

they have included "N" in the last, it is purely their mistake, what should I do now?

Claim by spouse on transferred property through gift deed

Dear All,

One of my friend had booked flat in Mumbai. Though he has not received possession letter from the builder and society is not yet registered, builder has allowed him to occupy the said flat as all the internal and external work of the building is already done. He has already repaid loan amount to bank and made title cleared for the said flat. Now he wants to transfer the said flat to his brother out of his responsibility towards him who has also shown consent. Transfer of the property will take place through Gift Deed and will be registered at Registrar Office after paying stamp duty & registration charges. My question is whether builder can charge him transfer fees on the flat transferred through gift deed ? Whether his brother will have absolute ownership on transferred flat to him ? Can anybody make claim in future through any law / court on the said flat including friend’s spouse as friend’s wife is living separately and may be in process of divorce to him in future. His wife lived with him about 4 to 5 months only and property was purchased / booked before marriage.
