I am the petitioner/husband, who filed a petition for divorce against wife/respondent on the ground of desertion . The family court hearing was fixed on 18/6/2012. I was present on that day at the court, but could not hear my name called by the court. Perhaps , I was not alert at the time of calling my name. Afterwards , I approaches the magistrate and informed that I missed my call. Then another date 20/7/2012 was given for hearing. On the 18/6/2012, my opposite party/respondent was not present at all. Now kindly let me know, what may be the final result? Will that case go ex-parte? Will I win the divorce?
Please help me sir, I have to get rid of my wife.

Dear Sir, My sister got married in 2008 and suffering alot from her husband & in-laws till now with one boy child. Now for more than 6 months she is in our mother's home. No calls from his husband or in-laws. They are not responding her calls also. He is in Gulf Country. His parents are in the Village. He insisted her wife to stay with his parents in the Village. She was born and brought up in Chennai City. Though she obeyed his word and stayed with his parents for a while. His parents always complain something about her to him and induce him to act against her. So there also she received no calls from him. If received also he will speak one or two words about the child. She was like a servant to his parents only to cook and do houehold chores. Before marriage he promised to take her with him to Gulf. In the beginning he kept her with him for nearly a year and sent her back to India. We tried to get him on phone many times, but failed. When we sent any emails also we are getting replies with third rated words. What to do? Pls help us. She want to live with him. What is the Solution?

Dear Sir,
My Friend name is Madhav working as a Constable in AP Police. He got married one year back but his wife has Pregnency problem, she never get pregnecy because she has problem in her uterine. This was not intimated before marriage. Docters confirmed she never get pregnacy and she get severe pain when she get DATE.
This was intimated to her parents and last month she went her Father's home and Her Father is saying it is not his responsibility He need to take care of her.
But My Friend not interested to continue his life with her. Now she is thretening him that She will suicide and write the a sucide letter against him, His Father and Monther.
Now Friend JOb is Govt job he is totally confused what he need to do.
Her Parents and she not interested to leave him, they want to continue the relation. But he is not agree.
Could you please tell us what actions we need to take care.
1) He is Govt Employee.
2) He dont want continue the relation
3) She si threatening him now.

if a person want to adopt a child apart from rules prescribed under act is there any legal process to legalize the adoption i.e suit for such in dist court or registration of such document???? kindly tell if any.

I am the Administrator for all the properties of my deceased husband.
All monies from movable assets are being accumulated but we do have debts to be paid. Moreover, our house is on loan and we have to repay the loan to the bank.
We are 2 legal heirs myself and my husband's son.
We want to repay off the loan and divide all the assets and part off.
Can the son and I jointly appeal to the court to permit me for the sale of flat? Should we prepare an affidavit and give it to the court? Please let me know the procedure.
Or the son only has to give a No Objection for me to proceed further with the sale?
He has already given me a Power of Authority a year back so that I can sell the flat and settle all debts. Can that be attached and permission sought from the High Court?
Please advise.

I have changed my mind and decided to bring wife at home due to some reason.
Now A Lady of NGO gave a shock and asked my wife to make an agreement and go back to my home.
My wife is not living with me since 1 and half year.
I got to know from somewhere that My wife has settled her job at her place. There are very less chances that she will again leave a job and come back.
What would be impact of that agreement in case in future, We cannot adjust and I approach court?
Note: I haven’t seen agreement yet but I suspect, it will be something against me. She may refuse to join me again even after making an agreement and get it signed by me.

I am Amit(28).I have a query regarding family issues.Actually We belongs to Hindu family and our family have 6 members including mother,1 elder brother,1 younger brother,me & two sisters(married).My father was died before 4 years.Our all properties are owned by my father itself & in my knowledge father don't left any will.I have done intercaste court marriage with hindu girl & my families are against us.My question is that "can our brothers and mother have the right to deny me of my shares in father's property".I'm so depressed please reply me..

Hi, I got arya samaj wedding done this April'12 and got registered in the court the next day.And we did this to apply my international visa as my guy stays abroad.The ceremonies were planned for later this year and then we would have officially stayed with each other, so till now I have been staying with my family. Now we are facing a lot of compatibility issues and have decided to not to carry on further and have planned to not to stay with each other in future too and want to end this marriage.What should be done in this case? whether annulment can be applied since we did stay with each other for even for a single day ? Or what should we do?

Respected sir,
My dad remarried a few years ago and the person he married is absolutely horrendous. I'm 17 and she has been emotionally torturing me and my family since last few (3 or 2)years. She also tends to call anyone who opposes her opinions "pagal" and has frequent aggressive outbursts where she starts screaming at all of us sometimes breaking stuff.During my boards earlier this year she used to start screaming in the middle of night and disrupted my hsc exams refusing to make any food for me and my family, which was ok because we kept a bai to do so but she insulted the bai on purpose,and left for Nagpur. Also during this period my dad was suffering from hernia. She frequently without notice goes to Nagpur stating any reason and she states that she has to suffer even though we had a maid for everything and cooking, which she rarely does. As stated earlier, she insulted the maid who was working at our place for 10 years and I had to do everything since and my percentage fell.Now we kept a new maid. My dad is very supportive of me and my sister but he is very troubled so as what to do. He also doesn't want any legal matters but is prepared for it just in case. The thing is she SLAPPED me today and started screaming again. Her son who is nineteen shows absolute apathy towards me and my sister and dad.She is extremely verbally abusive. She also says that she will kick me out of the house and denies to make food for me. What I wanted to ask is just in case she hits me again, Can I get a restraining order against her? knowing her anger and her sudden moods, I'm extremely afraid so as to what to do now...
