Meaning of sworn affidavit with ref to perjury

Respected Experts,

What I understand is Perjury can be filed only on sworn affidavit. Now what is the meaning of Sworn affidavit ? Normal reply with affidavit filed by wife can be considered sufficient for filing Perjury if she has lied in it or Husband should wait for her Examination in chief ?

(I have been suggested by lawyers to wait for examination in chief. However, i wish to file it at earlier based on her written statement which is also on affidavit.)

Kindly suggest.

Incompatible marriage

We got simple married in Court in 23Oct'18 as girl was from single mother.When we met before marriage, i had joined as Scientist at Australia, good salary in july'18 but after marriage girl showed abnormal conduct, shouting loudly in public, insulting me. She left her matrimonial home, on many occasions, after fighting with me.This disturbed my life as I could't focus on job, so my services were terminated in November. On one occasion I rang up at 100.My family reputation spoiled. Had recording, where she telling I should leave my elderly payment.She left home after fight on 17/3/19 and had not returned back. She had celebrated New Year, Holi, My Birthday without me.She's not returning.home. Insisting shall come, when I get job and leave parents. I have come to know She getting treatment for anxiety. In 2016 She attempted suicide, MLC registered, got treated at Hospital Please advice.

Incomplete and biased chargesheet in 498a

In my case, IO has submitted an incomplete charge sheet before court. He hides important documents/evidence that can lead to discharge all accused.

Now I and my lawyer is planning to move an application in concerned court that IO has not done proper investigation and he hides essential documents submitted by me during the investigation which is clear by observing charge sheet.

There is no doubt in the fact that based on those document entire case can be proved wrong and accused can be discharged safely at the time of charge frame. I need expert advice about what would be the best move for me. What are the things we need to keep in mind while drafting the application? Is there anything else we can do at this moment. My date of charge frame is in August.

Marriage null and void case

As before I file a case, my husband filed a null and void case. We attended the councelling and I showed the msg he sent me by accepting his fault, so the council person told me to file a counter on him. But on that date my advocate went on vacation.so he arranged for another lawyer to change my counter date. Judge was leave on that day, so we changed the date. But opposite party lawyer called my lawyer to speak in front of me. she asked him what I decided , and no need to file a counter by wasting time, we can file a affidavits of non consummation of marriage in court. So the case can end soon. But the new lawyer does not know anything about the case details. So the lawyer asked me to give me my lawyer phone number.so she talk with him and come to an decision. I really don't know what to do.please advice me my advocate is answering properly regarding the counter. Please help me regarding this matter about counter. Thanks in advance.

125 crpc betrayals

Hi,

My wife has filed maintenance case under 125 crpc. If lawyer cheats you by making you sign papers where you agree to pay maintenance.
If he files any papers like that how can I verify & get them withdrawn from court.
My relative took me to this advocate & he is not available or in contact now.
Lawyer told me it is vakalath/ permission petition but I don't see her name as respondent's advocate in 125 crpc.
I verified in ecourt, Could you help me with it.

Legal heir

Dear Sir,
Iam purchasing one independent house, actual owner has died and 4 sons have provided me one certificate on 100 rs stamp paper its called as ' Affidavit in Lieu of Legal Heir/Family Member' and I have applied for home loan with that certificate.

But Bank legal adviser is telling that certificate is not actual legal heir certificate and it is like a notary from lawyer. that will not be treat as actual Legal Heir certificate , they have to obtained legal heir certificate from MRO or Court.


Iam not understanding what is difference.

And also what is variance between legal heir and legal succession.

Request you to please clarify.

Reg divorce certificate

Hi Sir,
I got divorce(EX-PARTY) 40 days ago. But still the certificate is not ready.
Usually how long it will take to get it?.
My lawyer said he will let me know once the certificate is ready.
I would be thankful for any suggestions on this.

Succession / probate certificate

Hello,

i would like to have some guidance. my mother's brother's son has filed a case in high court after he lost his case in district court vadodara for succession certificate. as my mother's sister (worked with railway) died before 5 years without any will etc. in Ahmedabad high courts case is still going on. i want to know what should my mother have to do as my mother's brother's son already lost his case here. and he again appealed in high court for succession certificate. now one of lawyer has advised my mother that you file a appeal in district court vadodara for succession certificate and compromising with brother's son with equal portion of benefits, you will get succession certificate. i dont understand if i file an appeal, why we have to give anything to brother's son as my mother has already other two sisters and three brothers (they do not interested in this), only mother's brother's son is appealing. but as he already lost, can i mother file an appeal and get a succession certificate for herself only? or what are the others steps she should take? Pl advise.

Will/registry of residential property transfer

My previous question seemed to be incorrectly put on this forums, I apologize for that; I'd like to ask the question again, stating it clearly hopefully as best as I can.

Q:- My grandmother recently passed away. She had a will naming all her son(s) in it, dividing property floor wise.
Now, how to proceed in order to register the property according to the will? I meant the whole process (and preferably the approximate charges as well).

Edit: Its a residential plot in North Delhi.

I want to get divorce from my wife

Hi, I am fighting a divorce case with my wife from past 2 years, on the grounds of mental cruelty, she has filed, RCR, 498a and Counter-file for divorce case on me, I am fighting since a long time, but she keeps delaying the process by coming to the court and begging for a new date every month, I tried pleading in the court, but no use, the court keeps giving her chances and if I miss to appear even once I am threatned that the case will be judged in her favour, I am not sure what should I do next, I have been waiting for a long time, i want to go abroad but I cannot because of these cases, this is creating a lot of mental pressure on me and I am having suicidal thoughts, my lawyer says we will have to wait,Please advise a better solution
