hello experts,
my name is raj and have been married since 2001,have 2 kids,my wife has been ill treating me and has done the same with my parents and brother too from day one,I reside abroad as Im employed there,my wife had never treated my parents well and as I had bought a house on her insistence in the same buldg in 2004 but just staying above my parents house she never gave access to my parents of my children,she's been dominating,agressive,voilent in nature,hurling filthy abuses which no one does in our house hold,she even let her boss sleep for a night in my house in my absence which the immediate neighbours are testimony to,shes fought with most of the building people on some pretext or the other,nobody is in talking terms with her,she is schiziophenic in nature, then my father expired in 2008 fretting for his grand children and mother expired in 2011 bearing this womans atrocities, during all this phase she never took care of my parents and when I asked her about it she said thats the way she is and on the contrary she asks me for money only,even when she used to phone me she never inquired about my health or my sufferings the only sentence she manages is when would I be sending her the money for expense so I thought that when she has been a total failure as a wife and a daughter inlaw why should I send her expense and stopped sending her expense thats almost 2yrs now,so lately she tried to lodge a NC against me in a police station saying that Im not paying her expenses and as I reside abroad the police called me on my mobile and asked me to reconcile with my wife which I dont want to,to be frank I love my children but because my wife is taking undue advantage of my love for my children I stopped sending her expense,her family is supporting her and shez working too,now the query I want to put forth before all u esteemed people is when I come down to india she may file a case against me for not giving her expenses and probably she may go further by putting false cases on me,but to my knowledge as I dont reside with her so DV is out of the question and 498A doesnt apply as we being catholics theres no dowry system entertained in our caste,so what are the probable allegations she can file against me legally?thirdly will my passport be confiscated?fourthly will I have to be in india till the case is over as I get only 40 days leave?my only say in all this is that till 2yrs back Ive fullfilled all my responsibilities as a husband and father but have been cheated,but if I file for divorce I may have to give her alimony which she does not deserve in any way.so please guide me with the factuals regarding my case,thanking u in antisipation,

Hi,
A residential order has been passed by the magistrate in my DVC.
I need to pay my wife rental money starting from coming few days.
But my advocate is away for some time and I need to obtain the order copy.
How do I get it? Can I go to the court and ask for a copy?
I live in a separate city and my whole family are respondents in the DVC. Can any one of them go and get a copy?
Will it be sent to me by post?

The divorce judgement was ordered on April 1, 2013 by the Hon'ble Sessions Judge
Can you kindly advice, if the divorced person after waiting for 60 days (till 31 May 2013) and if no appeal is preferred till the completion of the 60th day, can he proceed to marry on the 61st day i.e. June 1, 2013?
Judgement: April 1, 2013
60 days: May 31, 2013
61st day: June 1, 2013

Dear Experts,
I have a son of 5 yrs out of 6 yrs marriage life.I live in kolkata for employment in a reputed concern. My parents live in my native place in a semi town area in W.B. Being only one son I always insisted on my wife's living in my native place with my parents and I visit them at every weekend. But my wife was against my will from the very begging and always created artificial problem.So, there was a tension in the relationship.In 2009 I took her kolkata again.Here in kolkata when I discovered an extramarital affairs and insisted on her going back to my native place. But She went to her parents house and remained there upto Dec'12.She convinced her parents that I tortured her mentally.They also kept my Son and 1 year of schooling .I send Rs.2000/- P.M. as per my lawyer's advice.In Jan'13 she again requested me that at least one chance she should be allowed to rectify herself.I agreed and rented a flat in anew area.My son is also admitted in one of the best school of kolkata. But That was my blunder after two months we went to our native place and stayed one night and collect the remaining 3 sets of her jwellery and went to her parents. and informed that she did not want to continue the conjugal life anymore.Againn another one year spoiled .
My questions are:
(1)If I should start sending money again to show that I did not want to neglect her.
(2)They are using my soft corner to my little angel.How this dirty tricks to ex tore money be stopped? If there is any way to continue my son's education immediately with legal help.
(3) How many days I should wait to rouse their 'Soobooddhi"?.Now school is asking the students status.
I want to do everything for my beloved son.Is there any way to get back the child custody.he is just 5 yrs and 5 months.

After sending 3 talaaq notices , the talaaq is completed as per Islamic law.I have mentioned the same in the query

What document artifact(legal document) can i get and from where, which would say that the divorce is valid ? Just like the registration of marriage is done, can there be a document saying dissolution of marriage, considering the talaaq occured is NOT by mutual consent ?

Hi all
Under hanafi law, if only single daughter survived her mother along with a predeceased sons son, wthether predeceased sons son gets any share, will he comes under residuaried if not explain. As sons son cannot be excluded by daughter under sunni law as sunni law is male dominated.
Hi Sir,
who are all the quranic heirs, If Quranic heirs already dead then can there childrens be qualifies as Quranic heirs and preferred over predeceased sons son..

My name is MUDASSIRKHAN i am a Muslim.....
My granpa have expired in august 2011 he is served by only son & only daughter
He has gifted a part of his property to his daughter during his life.... Now the remaining propety he has gifted to my father by "HIBA NAMA" in the year 1999 with two muslim witness duely signed on the Stamp but my father did enforced the "HIBA NAMA" & did not get the property transferred to his name....
My question is can that HIBA NAMA be enforced now for property transfer or it stand cancels as my grandpa is expired now..
As of now my Fathers Sister is agagin demending her share.. does her claim is justified
