Last week i filed a mutual consent divorce through joint petition at Bangalore.
I have few doubts which i wanted to clarify..
- The mutual consent joint petition was filed and we were told that in a week's time MC No. will be alloted.Can someone explain what is a MC No. and what is the significance.
- We both signed the petition and the same was filed by my lawyer.As my wife's lawyer was not available my lawyer filed as joint petition.
- I used to think filing the petition requires to be in front of the judge but i saw the filing is done in a small room where they ask some questions on why,when,etc related to marriage.
- Based on the above information can we conclude the petition is filed and first decree is done?
- Do we get any acknowledgment after filing the petition?
- What is the next steps??
Please advice in details.

Can judge grant a relief to petitioner which neither the petitioner nor the respondent asked for in the petition or counter? I mean, the petitioner asked for one relief in petition and the respondent just blindly denied all allegations without asking any counter relief. After the trial, the judge finds no merit to grant the relief asked by the petitioner but still finds merit to grant another relief which has not been asked by petitioner. In such a situation, can judge grant that relief to the petitioner by order/judgement?

Thanks for your valuable time to look my thread.
I have purchased 61 cent land -year 1976 from Mr.Muthu.
This land i have purchased with my own money as I was working in Army. when i done registration i clearly mentioned that with my own money i m purchasing land 61 cent.for that land registration my father given witness signature. but now he is no more.
Now a days My brothers are asking me the share from my 61 cent now... but i can not give my land to anyone..
My question is - if my brothers/sisters all together raise any civil case against me, is there any issue come to me or court will order me to give share?
I'm interested to gift this land proerty to only my son.
I'm a RC christian.. so Please advise me.

Please give your valuable suggestions; I am going through a lot of pressure.
Got married in Feb 2012, wife left in September and filed dowry case (498a, DP act3,4&5) in the month ofSep 2012 and got bail after five days of remand and
filed D V C demanding 30 lakhs for one time settlement 0r 25000 rupees for house holds & monthly 5,000 rupess for expenses
also filed Maintenence case for motnhly she needs 20000 rupees and Interm maintenence 8000 PM.
After Gap of 6 months April 2013 i have filed Divorce case because of her rude behaviour.
Their allegations in dowry case are
a) Gave 5 Lakhs at the time of marriage and we demanded for One lakhs of rupees and some house holds (these are false allegations) and
mentioned false statement they gave 15 tulas gold at the time of marriage.
My Questions are :
1) What evidences they require to show that they gave dowry and I demanded for additional dowry.
2) I am getting 35K per month as salary and she is non-working MBA Post Graduate(Before marriage she worked as software Engineer for 3 years - I tried to get that evidence as she is capable of earning but unfortunately that organization closed due to some reasons).
How much I will lose as interim maintenance/final maintenance in both the cases such as DVC and other maintenance case.
3) Can she get maintenance from two cases i.e. DVC and other maintenance case
4) Also i have voice recordings she mentioned need divorce and settle some amount and also stated If she stay with me she will sucide and write my name on the sucide note.
5) Also she mentioned in 498A and DVC files as a Private Employee.(Is it helpful for to reject the maintenence case.. ?) .
5) What should be my next steps? & Voice recordings will accept the court ?
> Wife filed 498a and warning me that she can take half of my salary in Maintenance .

I Filed for my divorce,after that my wife filed Domastic voilence case on me.In both there cases she had asked for interime Maintanance.In divorce case ,interim mantenance has been fixed,So now will i have to pay her again intrime mainatanance in domastic voilence case ? as i am already paying her in divorce case

i had met a girl 4y ago . when she met me the first day she said she loves me wants to marry me , and in 2 weeks she said she is going to USA and she will newer forget me , after she went there she use to to call me every day , atleast for a 2 year to marry me .
finally i gave up and said yes i will , BUT she had a condition that she will only get married in the court , i said no i will not , marriage will happen in the church, she said yes she will in front of my and her family , but for now she wants the marriage certificate from the court because she has some paper work . for she need it for some filing that she has to do for me .. my family denied and me too. but she convinced me and my family , that she will marry traditionally once we get her married to me in the court . we agreed for she was really looking genuine in saying it . she said she always use to say she needs court certificate and pictures of us together for she has some paper work in USA for me . and finally we got married in the court . her family and my family was there in the court as witness for it . that day was the biggest mistake of my life . it was 05/10/2011 . and she went to USA , and till date she did not come back . she use to fight with me for every reason, avoiding my calls .and started saying she will never come to india and she no longer wants me .cos her work is done and she is an NRI now .... and from last 1 y she has blocked me on all social web site. blocked my calls changed her address in USA . i tried to call her mom in usa, she says search her if u can , and her family in india say we don't know any thing dont come to us . i don't know what to do now and where to go . recently i found out that she is in a relationship with some man , my friend informed me and sent me PICTURES of her with an other man with whom she is in relation with being cosy and very comfortable . i feel cheated and for marriage and for she having an extramarital affair .... PLEASE I NEED HELP .... HELP ME . I AM CHEATED AND MY WIFE IS HAVING AN OTHER MAN . in a country where i cant go or even do any thing to her .. HELP

I have a following query and request you to clarify the same.
We are 4 brothers and 5 sisters. My late mother has gifted half portion of a residential house to me and half portion to my another brother via Registered Gift Deed some 15 years back. This property is actually in the name of my late grand mother.
Now other brothers/sisters are asking their share from the above property.
Although from another residential property, which is in the name of my mother, she has distributed equal share among her all 9 children including me.
Under the above circumstances, kindly advise if my siblings are again legally entitled to get their share from the property mentioned in para 1 as per Islamic Law, in view of the fact we two brothers already got the said property through Registered Gift Deed executed by our mother some 15 years ago. Can the Court nullify this Gift Deed if they approach the Court?
I shall highly appreciate your reply.

Shelter
Since last 3 years my wife is staying with her parents in another city. 1 year before I filed a divorce case and after that she filed a dv case on me. Now she is asking me to provide her shelter in the city in which I stay in the name of education of child. At present I'm staying in a house provided by my father and I'm financially very weak to provide her any shelter. I'm already paying her the maintenance with great difficulty. What can be done in this case?
