i have filed rcr to bring back my wife
i want to know after how much time the summons will be issued (she is in different state) as hearing date is nearing.
and can she file any case against me in her hometown without appearing for my rcr hearing?

Learned experts members...My brother was awrded high interim maintenance u/s 125 Crpc of Rs 20,000 per month by Ld JMIC in Januray 2014 from date of application ( December 2012) for children and I have collected the order few days prior to date of hearing and on hearing date the opposite party moved an application under section 128 Crpc for enforcemnt of order and the Ld JMIC has directed either to make payment of Rs 3.lakhs at the arte of 20,000 per month immediately or I ill take action and my brother will land up in jail..However we managed to get date for its implementation and reply....
Now as far as revision or challenging the interim order is concerned whether ist advisable that we should go for revsison before the session court or before the H.C UNDER 482 crpc...Since 3 lkah at one lumsump is very high..whether the judge can straight away send my brother to jail without exhausting remedy under section 421 Crpc??..Please advise with your suggestions ??

I am asking for my aunty ,she is living seperate from her husband
CrPc 127 is going against Husband during this.Husband got VRS (voluntiar Retirement ) & getting half pension up to 6 month as per pension rule because pension application require combine photo of husband & wife. but her husband requesting her for combine photo with her for full pension. My querries is following
1) what care should her take for dealing in this .
2) how much percentage of pension she ask for him. (how much she will get leagally)
3) where she go for proper & legal procedure for getting pension continuous from his department.

I and my wife use to work together. She was elder to me. We had an affair later got married on 7th july 2010. We did not disclose about our marriage in our families and use to stay at our homes. Later i came to know that she was already married with a kid. This i came to know after a year in march 2011.
When i asked her clarification she started abusing me and arguing with me.
Later i got her birth certificate and ration card xeroxed which had all details of her daughter.
Immediately i consulted advocate and filled a case of nullify our marriage.
She never turned to court when ever there were dates.
All the dates given by family court she was absent.
Judge required more details as xerox of ration card was not valid and enough document.
As her daughter name was entered after she was 4 years.
When we went to court for registering our marriage. She submitted her birth certificate but the age written was wrong.
Second she was already married but written unmarried at the register application form.
I am muslim and she is parsi by birth.
Since 3 years and 7 months we have never been together.
Last time i met her in 2011 June. Till now i have never met her nor kept any contact.
I want to know does Indian Law will allow me to marry as well as from the Islamic Law?
The case was dismissed and hoping to go further again.
Will there be any problem if I marry someone now?
will there be any kind of criminal charges against me my family or the 1 whom i will marry?
As we never been as a husband wife under one roof. Does the marriage gets nullify naturally?
What caution should i take for my future?

My estranged wife salary is more than mine, yet the court has awarded 40% of my salary to my wife for my 2 kids in sec 125 as interim maintenance.In the order, the judge noted that wife is earning handsomely, yet awarded such high maintenance stating that kids are joint responsibility. After 30 days of order, she filed for enforcement. Now the judge is saying to pay within 3 days in court itself otherwise she will attach my salary and put me in jail. I want to appeal against such high maintenance but the judge is effectively ensuring to close that option. How can I exercise my right to appeal because the order has been given only 31 days back ?

I am sunni Muslim from Punjab and got married in 2012. My wife started a dispute on 29-01-2014 and left my house & threatened to file a dowry case & beating case. Will you please guide me whether I can file a suit of restitution of conjugal right under Mohammedan law & also intimate me under which section of Mohammedan Law I can file the same.

Divorce situation
If the wife leaves the home without informing husband and his family and starts leaving at her mother's place. Even when the husband goes and brings her back after discussing everything, the girl again run away with 4 months old baby to her mother's house. what should the boy do. the girl wants to live separate from boy's parents..boy went to discuss it and agreed to find a solution but still she ran away..the girl's parents, brother or any family member are not even coming forward to talk, to resolve the issue..girl's brother is already facing divorce case..girl is not even talking..keeping the phone switched off, parents not talking, relatives, uncle, nobody talking to us...shd v file ncr, shd v write letter to girl with registered post to make ground for filing petition on restitution of conjugal rights. whatever we do, may bounce back on us coz all laws in favour of girl..she can reproduce the letter in different meaning and can throw common case of dowry or harrasment which is not true actually..so we will hv to undergo legal procedure although we will be able to prove ourselves innocent..its been 2-3 months..now wht to do...we want the girl and boy to patch up and live peacefully but there is no talk from their side.. so how many times v go and approach them...also, what's the guarantee she will not run again...since v communicated and discussed everything in front of her parents, neghbours..kindly advise...
