My estranged wife sold a flat which was bought in her name by me through my earnings. Can I claim sale proceeds from her? Can I stop sale? Can I approach Court for recovery or stay sale? Under what law & which section. I HAVE NOT GIVEN DIVORCE TI MY WIFE.
Resp. Sir,
in my Domestic Voilance case my wife has made some false alligation on oath . and afterward she has
1)denied some alligation and
2) some she cant give any evidance
can i file a PREJURY CASE against her
what will happen if she cant prove
1) denied alligations and
2) alligations where she cant give any evidance .
3) when shall i file this case as DV case will be ending within 2 hearings.

My husband, his two married brothers and one unmarried sister, mother and father are residing at the same house and are running a shop jointly. They are assessed as individuals in income tax. I want to prove that it is a HUF family and the property belongs to joint family property.
1.What proofs I would require to prove that this family is a HUF family.

As we know second marriage in Hindu Act os void if either of the spouse is alive.
my querry is- whether dere is any section which provides strenth or legal right to second wife if first is alive.
I mean to say, is dere any thing which would go against first wife?
whether she can claim any share in husbands property?
when husband is alive or after his demise?
pls advice sir.

Sir My advocate had argued 1st time facts on interim maintenance
He submiited judgement of desertion,crpc 125 of 4.No wife shall be entitled maintenance. If she refuses to live without any reason.
she was not driven out by matrimonial house.There is no proof of it means she left by her own decesicion.Judge had not passed an Order against me and he was transferred.
Again new judge came and said He wants new hearing,
as a result this point i.e. about her desertion is not said at the time of 2nd argument with new judge,as result interim order passed against me.
My point is Can I say to judge my advocate has betrayed me and not mention the judgement of desertion submitted on record with previous judge regarding what he said earlier which submitted to you.Because the judgement is still on record.
Can I say to Judge about Order of interim maintenance what he has Passed against me.
This is only because my advocate fault so that I GET CHANCE FOR MODIFICATION OF ORDER
The reason is I m not going for appeal because now the arear amount is too high and again if I move to high court or session court arrear will go on increasing.
Can I put telephonic recorded conversations as evidence in family court with postpaid bill showing date and time of conversations.
If yes then give any case law for reference.
Harrassment from inlaw
My mother in law is a tyrant and used to physically abuse my husband and his sisters, after our marriage she was creating problems for us hence we moved to a new city. we give her 5000 rs per month. Now she has gone ahead to women cell and her friend working at the woman cell calls us and inform us that she Rs.5000 is not enough and she needs more money or else she will go ahead and file a case. My husbands sisters are also mentally harassing us, One of his sisters stayed in our home for a year and did not pay light bills.Now all the sisters and mothers are troubling us to extract more money. whereas currently my husband is jobless from 11 months.Also we have a small child and 2 homes to maintain. How can we safe guard ourselves against such a case and also how much is the minimum maintenance one is bound by law to give parent.
