Wife has an affair with and wants divorce but is not giving the baby to husband what can be done to get the baby.

i visited the court premises today and got the civil certified copy form but need help in understanding how to fill this form and also, how much fee i would need to pay for get these details

I live in Pune, India. Got married in December 2021 in Delhi and moved in with my wife in Pune, 5 days after our marriage, as part of marital responsibilities I agreed to pay out 80% of my salary for expenditure while I have a educational loan, LIC payment & Parental responsibility as obligations, due to the obligations though I paid the said amount for two months but was short of money due to debt payoff, though I have agreed to pay 1/3th of my salary amounting to INR 20000 (my salary is INR 55000 (in hand)), wife denies that and sought what we had agreed to pay i.e. 80% of the salary, she has a business and takes INR 2 lacs/month. With the obligations, I have not been able to sustain my own needs and if I continue paying her the 80% it would be tough for me to pay off my obligations, let alone even buy a new T-Shirt for me and I have not been able to book a flight ticket back home as after I pay her and my obligations I am left with just INR1500 or lesser every month. Also, she has said that she can't cut down on any spending or whatsoever and wants to pay 50-50 share if I want to stay with her or she would throw me out of the place as mentioned rented on her name (constant threat), I even paid the electricity and gas bill over the amount she asked. How much can I legally give her as she threatened to throw me out out the house and call police (we are staying in a place which she has rented out before marriage in Pune and refuses to stay with my parents). Once she had also threatened to commit suicide over a video call by showing me to cut her wrist which I later on got to know that she had just acted out as she did not have any bandage or anything the very next day. As of present she moved out of India for one of her Diploma Courses in Dubai, she had paid for everything by herself. Now even after her course is over she is planning to stay back and apply for work in other country (I am not against that but we have not even spent a month together post marriage). There is constant nagging from her on me for not able to take care of her and her needs and that I earn less and she wanted someone who can take care of every needs of hers (she herself confessed over phone call that she seeks a man like that now) I am totally shattered by this. As a matter of fact I cant go back to my home as I ran away from home. My parents did make me come back and they managed to marry us. But with all the mental stigma overlooming I am mentally broken. I have started recording her calls now as she has a new way of nagging me everyday, I know this might be a criminal case against me for recording calls without her knowledge but after so much as explained above, I am scared she would put up false cases against me and my family, it has jolted me and I am just recording so that I can save myself if that can be permissible in court.
I have been forwarded with a helping hand from one of the lawyers in other forums (but i could not explain the whole situation due to word limit). I want esteemed LCI members to suggest what can i do, it maybe stupid now to say I dont want a divorce, hence seeking advice how can i legally counter if she does something to me).

Respected sir, I gave legal notice to my mother and sisters for partition of movable and immovable properties which are on my father name.There was no any veelunama or any other.according to my notice I got reply as I have no objection to give house with site (item 1)after the death of my mother subsequently sisters are ready to pick vacant site (Item 2)as theirs share.Now I can give another notice to partition all properties as soon as possible,because of my health conditions, financial condition and my family members better future.Can metion as it any damages to my shares and my family then are responsible.Give better advice

Conjugal rights
Hi all,
I got married 3 months back, and after a month of our marriage, my wife moved to another country for her studies. It was told to me before our marriage only as she had taken up admission back in 2020 but due to COVID, the sessions were not taking place, this being a 2 Months DIPLOMA COURSE in MAKE-UP. While in India she has her own Salon Business too, which even though was in existence since 2019 wasn't doing great due to COVID related crisis. Now, the thing is I am a MBA and I had forwarded my help in Marketing and Sales related issues for her business, which she duly declined (it being her own business I also complied to the same). My wife had no intention before to sell her business, but pretty recently she had expressed to sell off her business and move out of India to settle and work in UK (which she got from her college where she got a placement opportunity). All this being said, she had not told or discussed with me nor does she want to talk to me regarding this. This just being 3 months into our marriage. She had pre-planned her studies hence it was not within my rights or her's to talk about it, but now with her plan to just take up a job without even discussing it is somewhat not within my conjugal rights, I would quote some,
Under section 13 of the Act, cruelty and desertion are grounds for divorce. These are grounds for judicial separation as well. In cases where the wives' employment at places other than the husbands' place of residence and job has led to marital disharmony thereby leading the husband to file petition for restitution or divorce, the issues raised have been:
(a) does the wife's withdrawal from the husband's society to pursue her job, "without reasonable excuse", entitles him to a decree of restitution of conjugal rights against her?
(b) does it constitute 'desertion' within the meaning of section 13 so as to entitle the husband to a decree for judicial separation or divorce?
(c) is such a wife guilty of cruelty to her husband, under section13, thereby entitling him to seek judicial separation or divorce?
In one such case, viz- Gaya Prasad v. Bhagwati ,AIR 1966 MP 21, case, the trial court had conceded the wife's right as it was necessary for her to work because of financial circumstances, since the nature of her job required her to stay at a place different from her husbands' it could not be said that she had unreasonably withdrawn from the society of her husband, according to the trial court. On appeal against this by the husband, the order was reversed and the high court held:
Merely on the ground that the husband has small income and the wife if she is allowed to serve at a place away from the marital home can substantially augment the family income, cannot be held to be a sufficient reason to deny the wife's society to the husband. Nothing in Hindu law warrants the adoption of such a course.
In continuation, in my case my wife has herself chosen to work outside after selling her business without even trying to consult me on this while I am left in the dark and deprived of any conjugal rights, also I have forwarded my own help in terms of my knowledge to help her but she refused to do so and without consulting has taken up the job, while I may not have a very high salary but is enough to take care of her, while she reasons that she doesnt want to stay with my family nor does she want to leave all her lifestyle.
LCI members, can anyone guide if I can seek to revoke her passport against violation of my conjugal rights.
P.S. - I am not taking up any case against her as of now.
