About marriage proof

Hi,

I and my husband got married in a temple but no one were available so that it proves that we are married he has married to me only front of God. So can you let me know what type of documents it can be proved that we are married. Because my husband is not ready to do register marriage so can you suggest if I can take a letter and signature from him stating that he has married to me and will not cheat me some thing like that. Please suggest. There was no pandit when we got married I really dono what to do

Mother after remarriage stopped the money necessary for livelihood of the daughter

There is a girl aged 23 or 24, her father died few year back & mother started receiving the pension. Couple of years back girls mother has remarried. The girl leave separately. Now Her mother has stopped giving her money, she wants to complete her education and also wants money for livelihood, what can be the remedies. If any case be filed, where it can be filed and how, please tell the complete procedure and remedy

Marriage certificate

Hai everyone. I am a resident of Hyderabad. I married a girl one year back without knowing our parents. I want to get a marriage certificate now.The issue is we won't fall under prohibited degree of relationship but our surnames are name.when we apply for a marriage certificate under Hindu marriage act can we obtain it or else they will reject our application just because our surnames are same.Under special marriage act there is a possibility that our parents might know.we want to let them know only after getting certificate because they will not accept our marriage and might take my wife away from me.if there is a certificate I can sue them legally.so please please help me in getting my marriage certificate

Mental harrashment

hello all. I am married since 3yrs and i have a baby boy who is 7 months old. now i am living in my parents house for post delivery care. since i moved to my parents house my mother in law has a very bad influence on my husband. before having a baby she was completely against a girl baby and she always mentally tortured me saying girls are tension, they run away when they reach their teenage. after having a boy i thought she will stop but now she has taken a different turn and asking my husband to leave me.. 15 days back my husband sent me a threatening message saying " your worst times have started, i ll dig your grave, and claim my son, may your soul rest in peace" because i sent a simple forward msg to his mother saying "daughters are not tension, daughters are equal to ten sons". from 15 days me and my parents tried contacting him, but he s not responding nor picking calls. my father in law is a Rtd.ACP, i spoke to him too but he is keeping quiet in support of his wife and his son is not turning up. i want my husband back. how do i deal with this sitution. pls help me

Registry marriage of marriage registration

sir,
myself suman, a banker, belong to ST community by birth and follow HINDUISM by religion.i want to marry with a ST girl with registration,so what is the act apply for me whether it will be hindu marriage act or special marriage act? after the registration what are the possible surname can be used for the bride? bride paternal or husband surname or mixed of both. after that should affidavit or notice needed for the change of surname from court? please reply with your valuable suggestion..thanks expert panel.

Bank loan

Father acquired ancestal property through an registered partition deed, till today property revenue records stands in his name and he enjoying property with his children's, schedule property consists 3 individual house's, later father availed bank loan mortgaging the property for the well fare of the family and for the same his children's stood as guarantors and executed necessary documents, such as children's paying rents to his father in respect of the property. Now father failed to pay the loan amount and bank issued final notice. Children's are not at all bothered to repay the loan amount.

My clarification from your side is
1. Whether children's are equally responsible for the loan amount?
2.Father is aged 70 years and he have no income, loan is sanctioned on the basis of the rent returns shown, which is paying his children's.. actually with out rental agreement by mutual they paying rents to his father. now how to collect the rent from children?
3. Now for the loan purpose father can rent out the property to third person, now how to evict the children from property?
4. What kind of case can initiate against the children's?
5.yours any suggestions regarding the same.

Rti information

HISTORY THE MATTER

1) My Daughter-in-law had filed a Domestic Violence case in CAW Cell which is pending/under process. CAW had earlier refused to give copy of the complaint to my son in the counseling process. But they gave a copy of the complaint under RTI request only.

2) IN THE ALLEGATIONS, SHE HAD MADE ALL OF US PARTIES INCLUJDING ME; HENCE I AM ONE OF THE DEFENDANTS.

3) (a)Before making complaint in CAW cell as stated in para-1 & 2 above, She made a complaint in the Womens’ helpline, against her parents which is clear from (b) below and also a telephonic conversation with my son – already recorded.

(b) I have in my possession an RTI reply from the Police Control Room [PCR] which reads as: “lady callerko ghar me band kar diya hai usko sasural jane se mana kar rhe hai –ND PCR”.

IT PROVES THAT THERE WAS A CONSPIRACY & SHE HAD BEEN INSTIGATED AND/OR FORCED TO FILE A FALSE DV CASE FOR EXTORTION.

4) Further, with regard to the second part of my RTI request to PCR as to: ‘details of and what action was taken by police against the complaint’, PCR informed that it had been referred to local police station.

5) Now I received a reply from local police station denying 3rd party information u/s 11 of the Act.

QUERY:

Needless to say as per the Act, I can file RTI appeal against para-5 above. As I am Defendant, can they deny the information to me on the grounds of third party information?

As defined in Section-2(n) of the Act, "third party" means a person other than the citizen making a request for information and includes a public authority. I feel that there are some judgments that defendant cannot be considered as third party.

IF EXPERTS ENLIGHTEN ME ON THIS POINT AND ALSO ANY OTHER POINT(S), IT WILL BE MUCH HELPFUL TO ME WHO IS A VICTIM OF FALSE DV CASE.

Return of 498a complainant to matrimonial home

My daughter in law married to my son for 9 years filed for permanent custody of our 5 year old grandson in Sep 2015. Before the petition could be heard, she filed for interim custody in December 2015. She was doing all this, while stationed in Germany where she had gone on a job assignment. During her absence for 14 months, we the grandparents took care of the child along with my son. Because of the impending school admission of the child early 2016, the sessions court granted her 10 days interim custody in December when she had come down to India on leave, when she took the child for a holiday, along with her mother. She returned permanently on 1st April 2016 and started to misbehave and abuse my son in front of domestic help, the child etc. On the 5th April, she forcefully and unlawfully grabbed the child and filed false charges against my son and us (in laws) for torture (mental and physical) and also filed a 498a complaint in the local PS.

The next day, we filed a petition in the court against this unlawful snatching away of the child defying court order of January 2016, wherein it is clearly said that the father is the legal guardian of the child.

Now, the court, has decided to grant joint custody to the parents (4 days with father and 3 days with mother, etc) .

My question is can my daughter in law return to her matrimonial home along with the child, even after she has filed 498a charges against the same husband and in laws?

The police have come and visited our home on several occasions earlier and have found nothing wrong with the family. They have not initiated any inquiry against this 498a complaint also?

Want to stay with my husband

I am 31yrs old govt employee. We married 2yrs ago. After that i used to live with my mother as she is widow and no where to go. My husband used to come at my house only at night. But during the last 1 year, i felt that my husband is ignoring me, he began to pick up quarrel on a small issue, started to use abusive words to me. 2 months ago on 11th Feb. he picked up a quarrel and left my house permanently, till then i called him several times, sent him msgs, but he neither picked the phone nor gave any ans of my msgs. I told him that i want to stay with him...even i am agreed to stay with my in-laws. But he is ignoring me, he said he is not interested in me anymore, he says that i am a psycho...i have to go to psychiatrist to prove tht i am mentally fit. I said that i am agreed to consult a psychiatrist to prove that i am fit. But now my husband has came to the point tht he is not agreed to lead a conjugal relation with me anymore. He is unable to show any proper reason for it, but he just dont want me as his wife. What should i do? He has not made any divorce petition till now, bcoz he has no proper ground
