Dear respective experts,
I have many false cases on and quary about those answered by experts here previously, i am really thank full to all of you for your valuable opinions nd guidance.
Here in 406 they are denying to take back the articles even i got to know they r ready to give in writing the same as she wants to live with us. But my question is whether police can seize those things by their own. Or what is the strategy behind not taking those things after filling 406. What will be advisable for me to do?

My divorce case is pending and hma24 is running in hwh court(west bengal), is it ll b better to file child custody case in punjab ,since i m in army and posted in punjab now.
Home town is hwh only, pls tell it ll b gud to file custody case now or not ,if yes thn in hwh or in punjab.

My divorce case got dismissed as we got married in goa n lived in bangalore at time of separation I filed divorce case in 2011. It was told my case doesn't come under bangalore jurisdiction. My lawyer said he wl appeal in high court. I am separated since 2007. Will I get divorce thru HC. Pl advise. Thanks

Sir....I have a very serious problem.....my cousin sister did second marriage one year ago....she got seperated from her first husband with a stamped notary paper by mutual consent of jaat khaap panchaayat.......at the time of second marriage my sister showed that notary paper to her second husband and he was satisfied with them.....after marriage her second husband started torturing her and then he filed a case in family court under section 11/12 of Hindu marriage act ...anullment of marriage.....and now he is putting false allegations tha he has cheaten by ourselves.......he did not know about her first marriage....Her first divorce is not legal....
Our case is running in court....what can we do now? My sister have a psychiatric problem since 4 years....she also have a certification documents of her mental illness....can this illness is used as a remedy for protect from the legal issues......Plz guide and solve our problem.....

Can I convert the appeal(divorce case) pending in HC court in to mutual divorce(13b) without my physical presence in court during 13b proceedings? I'm ready to give power of attorney to my advocate or someone else to convey my consent during 1st and 2nd motion of 13b.
I know its not normal procedure but would like to know whether the HC judge, in his discretion and based on my request, can give the family court such a direction while converting the appeal into 13b taking in to consideration that both parties had already gone through those conciliation proceedings.

Dear all...My wife has filed the case of 125 and interim of 8000 is decided by the court and I was giving the part payments as he filed execution for arears from the filing date. Due to some reasons I could not pay the maintenance AMT and court issued the conditional warrant as I had not presented in the court as I was not having the AMT. Now My advocate is saying that you will be given the sentence of 1 month and the execution will be over as judge can not sent me in the jail for same AMT which is pending for more than 9 months. Now my qyuery is if I will not pay the maintenance then for how much time judge can sent me in custody is it for one month or for 9 months as I have read that one month default one month Jail judge can take the decision pls clear my query

Deserted and false allegations
Hi, I have been married for last 2.5 years but my wife was with me hardly for six months later. She often goes to her native with some reason or other and never return for 3 to 4 months, she has left the house on three instances before. Because of her this attitude I had initiated a legal notice but took back as I wanted to give her a chance but now she has deserted me for good reason she wants me to leave my aged mother and in married sister. My wife recently delivered triplets I tried to get her back but she has refused to rejoin. I have now filed for a divorce in court. My wife has sent me a lawyer notice as dowry harassment and wants me to pay the maintainance. I will not pay a single rupee to someone who has deserted me and falsely alleging dowry harassment. I still love my wife but just cannot continue after going through all the pain. I love my kids. I am ready to take custody of my children and take the responsibility but will not pay a single rupee if they are with my wife. I am read to serve jail for failing to honour the verdict. What are my chances of getting divorce. How long will I have to server prison for dis honouring the court.
Please advice.
