Hello
My brother was slapped with the false 498A back in 2014 and my entire family was dragged into the mess . It's been a long battle and somehow we have been able to exert some pressure to get those goons to a negotiation table where they are demanding for a divorce and the custody of my brother's 2 yr old son.
However my brother being immensely attached to his son is unable to accept the proposition And let go off his son.
But these people are unbelievably notorious and have been mentally harassing my brother every time he goes for the visitation of his child. One time that woman slapped him and other time framed charges that my brother tried to poison his son.
All these developments have deeply impacted my brother and he is unable to take any affirmative action or decide. He loves his son too much but the mother of the child doesn't even let him be near to his father even in a 2 hour visitation once a month . Moreover now they have failed to come on the decided date of visitation for two months in a row.
What is the right thing to be done now?
Is there a way to bring it up for contempt of court?
Also how can I help my brother from slipping into depression . Is there any counselling that he can avail?

I was married in mar 2016. It was arrange marriage. Her character is not good. We have physical relation only one time. She is ready for divorce but her parents are not ready for divorce. I want divorce. What should I do???

This s suganya from Chennai, my husband has filed a false complaint against me and my mom at the women cell and they called me for the enquiry but he didn't come telling some reasons as medical sick and again they called twice for tat also he didn't come , though he has hired a lawyer he s afraid to come ; it been 5months since the complaint has filed but there s no response from him , i called the women police station several times but they said they can't move further since the person who filed the case has not come to the station, what should i do now ,should i leave tat complaint against me or can i file a dv against my husband and his family, my husband and father in law are torturing me alot for more and more money from my home; at present am in my parents home , he himself dropped me in my parents home saying he was going for picnic and then only he had filed the case against me , i need some serious advice regarding me , since my family members are not taking any action considering my life and my son life my husband is making use of this advantage, we got married on Feb2014, he doesn't lead a good marriage life with me , we had intercourse just for few weeks tats all and till now its a no from him, he doesn't take care of any expense for me or the baby , everything is taken care by parents only since my baby was born, my husband needs only the dowry from and live happily , moreover i recently found tat all the details furnished by him and his family before marriage was an complete lie regarding his education, job ,salary nd family, i came to know he never went to college; till now he had never given me a penny of his salary ; am totally devastated by this life, my father in law s using most abusive languages against me and my family though i don't talk , i really don't know how to overcome this problem; i can't tolerate them anymore, pls i need some legal advice, if any affordable lawyers s there to help me ;pls do help me, i don't ve any financial support, thanking you

My cousin filed child custody case and Interim application for visiting rights for his child. But his own lawyer didn't remain present on the first hearing.
1) Suppose in the 2nd hearing also same thing happen, can my cousin request Judge to proceed in absence of his own lawyer ? ( Or Judge will discourage such request ?)
2) If respondent remain absent, how to get ex-parte order or prepone the hearing date ? Its already 4 months of application.

i left my home 6 months back after a lot of fights and torture from wife. My 3 years old son is with her.
she has also filed 498a against me. we have filed quash in high court. no other cases filed by her yet.
i also do not wnat to initiate any separation and divorce proceedings right now.
she has not allowed me to meet my son. can i file only for visitation rights in family court without initiating any separation or divorce proceedings.

My sister married to a army officer in 2009.It was an arrange marriage.All was well till the birth of their first child but after the birth her husbsnd started issuing with her, complaining on small issues becomd his nature, he started asking divorce from her and started comparring her with other ladies and started living in separate room one night he beaten her up and through her out of the house with small kid, after thr interferance of elders and his seniors they again started live together but again her husband started the same thing, one day my sister found out that he has registered himself on matrimonial sites and dating sites, after that he has started taking to other girls in front of her when she object he again physically abused her but this time he did it publically. Now she has left his govt accomoation and come to our parents place...Please suggest us what action we can take against him. And please tell us the max time of period till then we can take action against him

I have married on 01/06/2014. on 03/06/2014 my wife said that we was married forcefully by his parents she love with a other caste man. as per his willing on 07/06/2014 we "notorised" a tlaknama and also filled a 13B mutual concern in family court which was rejected on the basis that it is not completed one year sepration period. her parents and brother sister beaten her in my house. finally on 07/06/2014 she went with her uncle. as per lawyer advice i have not done anything till one year than my parent with some relative went her house for mutual consent divorce. her father threateing us for false case and abusing us. after lawyer concent on 15/06/2015 i have filled divorce case but till date 07/07/2016 she not filled answer of petition and taking time again and again.than she filled a case for 125 interim maintanance. i have replied for interim maintanance. than she filed sec 24 of hma application against divorce.after argument of u/s 125 of crpc judge dismiss interim maintenance plea on ground that she is well qualified. i have not give answer of her plea u/s 24 of hma till date. today her lawyer saying to my lawyer that if i can ready to pay her a lum sum alimony ( amount not disclosed) she ready to take divorce. my query is :-
(1) what should i do. accept her offer and go for a divorce ( as per lawyer within 6 month i will get divorce).
(2) wait some time in hope that her plea u/s 24 will also dismiss than without paying alimony only giving her stridhan back i will get divorce
