I have filed written statement last year on 16.11.2022 through advocate hired over phone to send signed ws and affidavit executed in ghaziabad through speed post. This year in February 2023 my advocate in connivance with the opposite party and her lawyer, shown me appeared in Darbhanga, Bihar but the truth is that till date I have not visited Darbhanga, Bihar due to danger to the life and limb. Since 16.11.2022, the case is at reconcilliation stage. As I kicked off cheat lawyer, presently I want to defend my case in person. The court was vacant from March to July. Now on 02.08.23 judge has joined and my case is fixed for 22.08.2023. Kindly suggest me in this regard. can I request through application to dismiss the petition u/s 9 and grant divorce as same request was not made in ws because divorce case was already pending in Ghaziabad.
Further more my divorce case which was filed on 11.08.2022 in family court, Ghaziabad , got transferred to Darbhanga, Bihar vide supreme court's order dated 19.07.2023. Kindly suggest me what should be my strategy to get quick divorce.

I got exparte divoce in July 2022 after proving but my spouse came from saudi and set it aside..and he is not attending court neither his lwyers on hearing and recently got to know that he went back to saudi, and now in last hearing in july 2023 court mentioed that his appearance is mandatory, what happens if he won't appear again in court? And court grants me exparte again and , does court consider his set aside petition again, like this is harrasing me from getting divorce,. I have filed for divorce in dec 21

Hi, I have remarried and my son from ex husband is being sponsored Dubai Golden visa dependent sponsorship by my husband. Since My husband's and my son's details do not match in the passport, we are advised to go for an affidavit that calls out that my son's biological father gives his consent to my son's step father as a legal guardian to proceed with processing dependent visa.
Could someone help share the process and if there are any templates that could be used to prepare an affidavit, and incase there is any other petition to be filed. Thank you in advance

Hi everyone my house help is a girl from a village in Maharashtra who is married to a Nepali man and has 3 children with him . This man has left for Nepal 4 months ago and hasn't come bk. I think he will not return as he doesn't not even call her or his children or send them any money. There is no marriage certificate only pictures of a temple marriage. They ran away and got married when she was a minor. Does she have any rights ?? Can he be held accountable and responsible towards providing for his family ?? Please advice as i really want her to get some help.

I had filed for divorce from wife few years back and last year court asked to furnish assets and liabilities details.
I had submitted my bank and employment details in the court.
My wife qualified as BA had a bank account but did not disclose in the asset form. Job details also she said not working and is a house wife. I am not sure if she working or not before filing the asset form.
Court awarded her a handsome maintenance.
After that she has taken up a new teaching job in a school which I am aware of.
What are the legal ways to prove in the court that she is working now and capable of earning for herself.

Married in 2014.
My 7.5 year old boy child is with me at mumbai.
And 5 month old boy child with wife at Indore.
All means of contact and mediation has failed.
It's repeated, because she did same in 2018 when first child was just 2 years old. Wife Filed divorce. I filed marriage petition.
But, settled after 4 months.
lawyers suggest to go for RCR marriage petition again.But, I am fed of her repeated insulting behaviour. And want to go for divorce
I understand that it's impossible to get 5 month old child custody from mother.
So, I am ok if elder child remains in my custody. And 5 month child with mother. And we both get visitation rights.
So, if I file divorce first, can I ensure child custody of 7.5 year boy with me.
Or if I file marriage petition then also, elder child custody will remain with me ?

In my case ex-party order has passed due ,to my lawyer negligence and after that sec 128 order has also passed in ex- party, now we come to know about these as we have also not received any notices for that,
Now what is the solution, what can we do now we have filled for recall of sec 125 but it date is also very late
Can we file the case in high cout

Query on validity of ex-parte evidence.
As in my case , summon was received by the respondent on 07.09.2022 and she was continuously absent on the hearing dates and thus on 11.01.2023, ordered for ex parte evidence on next date i.e 01.03.2023. I presented ex-parte evidences. Now the respondent got case transferred to other family court. So far she has not filed ws. will ex-party evidences/ witnesses already presented in absence of the respondent be valid ?
