Hello Sir,
My husband has filed for divorce and I am planning for contesting the case because I want to retain my marriage but I dont have sufficient money for the fees of lawyer and to run my home on monthly basis. So in this case, if I apply for maintenance ( I am not talking about interim maintenance), then will judge think that I am ready for divorce but I want only maintenance and will grant divorce to my husband ? Because judge is nothing but a human being who can think this way too. Pls tell me the effect of my applying for maintenance on my entire case. Which section I should refer for maintenance.

In case of adultry by a wife is she entitled for maintenance from the husband under the hindu marriage act.
If the child she bears is proved to be out of the adultrus relation what will be the status of maintenance.
Some case laws which could be available on the internet in regard to Adultry and Cruelty as grounds of divorce to a husband under the Hindu marriage act

Sir wife agreed on a stamp paper that she has received the maintenance for whole life and shall not claim the same in future. Later on wife files application under 125. Sir what would be the effect of this agreement in 125. Wife says she does not know about the stamp paper, which she signed earlier. Such agreement was disclosed by husband on his Objection.

I am filed maintenance application and claim maintenance of Rs. 4000/- p.m.
Now I want to file interim application
My question is that what amount shall I mentioned in such application whether to mention Rs. 4000/- or less...
what the law requires

I have been married for 3 years but my marriage is not registered.Now i want divorce . I have marriage affidavit that was done when i had applied for passport 2 years back. So is my marriage considered legal. An do i have to apply for divorce ?Please help me out with this.

My wife is seperated from me for the past year and a half alleging harrassment by me and my parents(father is deceased since and mother is a confirmed epileptic for 40 years), have recently applied for restituition of conjugal rights after legal aid redressal failed as respondent did not appear after due notice.In the meanwhile my brother in law/wife have taken my son to a pshyciarist for evaluation and allege that my son has declared that he does not want to see me.Based on this alleaged declaration, I am not allowed to see my son(last seen my son on 22/11/2008).
Q. Will the courts allow an impartial evaluation to confirm if the child is brainwashed?If found true what action can be taken aganist the guilty party(any precedents)?
Q.Is this action by my brother in law/wife punishable under the penal code?(1.Subjecting the child to an evaluation-leading to brain washing of the child(aleination of affection)
2.Brother in law/wife taking the role of judge and executioner without recourse to law and not allowing me(natural father) access to the child)
Any help to prepare strategically to get child custody would be welcome.

Hi,
I got married two months back, and changed my surname after that.
I have marriage certificate to support this.
Now i want to apply for re-issue of my passport and want my surname to be changed.
which signatures i need to use to submit my passport documents?
Is it mandatory to change your signature also after name change?
Can I have my name as "original name + husband's surname" and Signature as "Original name+ maiden surname + husband's surname"? Is this legal?

Divorce
Respected Sir(s),
I do have one query. One of my friend seeking divorce as soon as possible. Please find complete detail of matter as below
1) Husband is working in ahmedabad.
2) wife is working in pune.
3) marriage duration - 9 years.
4) for 5 years they were not able to meet together because of job and problem between them.
5) Now relative of wife are saying that they dont want to talk on divorce for next 1 year.
Please let me know if more details are required to understand the matter.
Please give me appropriate remedy so my friend can be out from this problem as soon as possible.
