father purchases land ®istered on 2nd son name.

We are 6 brothers,My father purchases 81/2 ac land during 1970 and registration was done on my 2nd brother name ,who is minor (6 years)at that time.Now 2nd brother was expired and his wife is claiming that land in addition to the other family land.My father is saying that,it is purchased by me,hence it shall become joint family property & all should have equal rights.Please conform that ,this property is belong to her or belong to my father or belong to all brothers.

EXECUTION OF A WILL

Dear Sir,Pl. let me know how a will is executed ? Whether all the persons mentioned in the will have to give their consent as to the property allotted to them ? Who opens the will ? Within what period the will should be opened ? If the will is not opened within 3 years of tha death of the executor of the will whether it can be challenged after the expiry of the three years on any matter pertaining to the will ? What is the procedure for challenging a will ?

Claim cheque will be in favor of?

Last month my younger brother died in an accident. He was married last year, no kid. His mother is the nominee of his insurance policies, but his in-laws are claiming to insurance companies that only his wife is the legal heir, so claim cheque should be in favor of his wife only. Is it possible for insurance companies to release cheque in favor of his wife, instead of his mother, who is the nominee?

guardianship certificate - reg

Sir/Mam

One of our staff died in service. She left with one minor son. Now we have to disburse the settlement amounts to the minor son. Meanwhile one person claims as guardian of the minor son and requested to disburse the amount in his name. We advised him to submit guardianship certificate from competent authority. The person approached the City Civil Court and got the guardianship certificate by filing a G & WC case. Now the person has submitted the judgment copy appointing him as guardian for the minor and requested to release the settlement dues. In his circumstance please explain whether City Civil Court is competent to issue guardianship certificate?

gifting of ancestral property

Sir,
My father inherited agricultural land in Up from his father(ancestral land). i am away on my job and staying in Gujarat. Indication are that my father may gift or transfer otherwise the land in by brother's name in my absence. Can I stop my father from doing so? What have I to do?

498a

I was convicted by judicial magistrate in 498a but divorce was granted in my favour on cruelty and desertion by district judge.Allegation of dowry etc. found to be false by district court.She filed appeal in HC that has been admitted.

1. Are the findings of civil court binding on criminal and I should be acquitted by Sessions court in appeal in 498a? Any judgment in this regard.
2 Has the divorce order automatically been stayed?

Succession

This query is for my friend Ramesh(only son).
He stays in an independant house with his mother. His father has passed away 2 years ago without leaving any will/succession certifcate. The House property(Ind House that they are staying) is in the name of deceased father without any nomination.

Now my question is
1. Who will be the legal heir of the property . Wife (100%) or wife and son 50% each?
2. Also how will they be able to sell this property since its owned by his father and he is no more there?

own's father have right to take kid? after divorce

Sir,
am sameer from Hyderabad i have a one problem
let me share with you my daughter got divorce in 2006 due to Dowry harassment reason.
she have a 6year old son she taken a divorce from as per Muslim religion rule(Quazi) after divorce my My daughter's son is living with her past 5 years,
she got a second marriage, now she is very happy with her husband finally a small kid got step father.

just imagine in future his own's father have right to take a kid?
a small kid can't live without his mother In this situation what i can do? give me suggestion plz

I had Filed Divorce Petition in the Family Court after hiring a Lawyer and Signing the Vakalatnama,But why is that my Divorce petition is Showing as Party in Person at the end of Suit, what conclusion should be drawn from this tact of my Lawyer any Fowl play can be expected in Future?
