My client Petitioner filed a M.C in the 1982 against her husband and she has been getting maintenance from 1982 enhancement petitions filed allowed and going on.. But the Respondent will retire from the service who is a Govt. servant in Road & Buildings Department (Attender)in the month of September, 2010. Can the Petitioner attach the gratuity, Provident Fund and other benefits of Respondent? If yes, is there any case laws reguarding this case. Please kindly suggest me case laws and how should we attach the respondent benefits. The petitioner is very poor old woman.

Hi Sir,
1. I am muslim, got married with muslim girl on Nov 2007.
2. Filed RCR in 2009. Noticed served, gazate publish, no one appear. In 10 march 2010 got RCR disposal in the light of Talak.
3. Got talak certificate from Imayat Sharia. Three witness present for talak.
4. She filed 498a on 08 March 2010 against all family member. This month expecting to have congiance from court.
5. She filed maintenance under 125.
Please advice.
a) Is 498a can be quash at highcourt with RCR ground?
b) Maintenance should be under muslim protection 1986?
c) Any complication since talak already done?

sir,
i filled a divorce pettetion against my wife on the ground of cruality. divorce has been decreed by family court meerut. my wife filled 1st appeal in high court allahabad. in appeal i appear in proper court in allahabad. justice award 5000/-per month to my wife durind appeal on 19-03-2010
so i wants to know
1- can i chalange the order of high court in supreme court and is it a legal order mean can during first appeal justice can award mentinence
2- how can i get legal aid in supreme court for chalange the order of high court 19-03-2010
3- my wife earn 2500/- per month from tution

i am a 17 year old girl...i will be turning 18 soon...my father is extremely abusive towards me and my mother...he mentally tortures us...we both are financially dependent on him and he takes full advantage of that...we dont have other relatives who can help us...recently he told me he wont provide for my studies anymore...i cn manage by college fees...bt i wont be able 2 provide for my other necessities lyk food...clothing...shelter etc...since i will be turning into an adult in 2 months will he be able to turn me out of his house? in that case can i take any legal action against him? please help as soon as possible

In given case I m representing husband/respondent in which wife has seek decree for declaring the marriage null and void on the ground of impotency.On the asking and in the presence of wife's parents My client/husband was (privately)medically examined and doctors opined that husband is potent and normal.Now case is fixed for petitioner's evidence,kindly suggest me any citation etc. in support of my case in given facts.Thanks

after desertion of my wife of one year i filed a rcr petition in court.she wants to put a 498a case.before she filing a case is there possibility to get anticipatory bail.because if she put on my brother, he is a private employee he could face the problem about leave(108).

One of my friend's father died last year without writing a will survived by mother, son daughter and his mother. Then this year his mother too died without writing a will. Now all the properties belong to the father and there is no inherited property. What would be the share of his grandmother(deceased father's mother) in father self earned property and what would be daughter's share. Please guide

I got married in 2008 but I was subjected to immenence Mental and physical Torture since then. Now I can not bear any more as I apprehend danger to my 6 months old son. I have decided to be separate. I am working Lady dont need maintainance. Already have arranged a rental house and yesterday moved there with my son. After leaving the house my called my husband and informed him that I am now separate. Now my husband is not allowing me to take my all furniture which are bought by me. He is also not allowing me to take any of my personal belongings. Yet I have not initiated any legal action against him.
How can I get my furnitures and personal belongings in quick & easiest way?
Whether my husband can claim custody of my child? (6 months old son)
