sir,
what are the rules and formalities regarding adopting a child for hindu couples who haven't any child? Is there any new rules , regulations or modifications other than in the Hindu Adoption and Maintenance Act of 1960? my parties having age of 50 (hus) and 45 (wife),Is that create any problem? Please help me

Divorce and Cr.P.C 125 Petitions in two different Court?

Case Details:

1.Husband Filed Divorce petition at Family Court for Desertion and Cruelty.

2.Wife Filed Cr.P.C 125 at her home town while attending the Divorce case at Family Court.

3.Husband not contesting the 125 thus it would go Ex-Parte in favor of Wife.

Que is while Divorce suit not disposed and Cr.P.C 125 is disposed off Ex-Parte from other CJM Court in such a scenario CJM Order would of Interim or Final in Nature?

Is there any possibility to appeal in Lower court of AP for getting early date in an OP case.
Since the next date they have given was somewhere in third week of July?

restitution of conjugal rights

Dear Sir

I got married in feb 2008 and my wife conceived in april 2008. In june,2008 her brother came to take her away for delivery and my aprents allowed. Since then we are not living together. Certain confusion started created by her elder brother that she didn't ccome again. I tried a lot but she refused. In the month of Nov. she gave birth to male child and I tried to make the things easier but she refused and said she will not stay with me. In Jan 2009 my father went to take her from her home and she came for one night. next day her parents came and forcibly thet took away her daughter. In March again i went but she refused to come. In April her younger brother aske me not to call so I stopped. We waited for 4 months and we sent Pleader's notice in august but she refused to come. In october again we sent the pleader's notice she again refused to come.Her elder brother tried to threaten me on phone and he also talked to my lawyer. My lawyer talked to my wife and requested her to live but she said she want to leave me.After that my wife called me twice and threatned me to file dowary case against me.In Jan. 2010 I filed Sec. 9. 3 notices have been served but they have not responded. Even they have left their home at Noida wher i served the notices. No one knows about whereabouts. Kindly suggest me what shall I do? I think Women are not longer sati savitri any more. They are misusing the dowary law. Kindly tell me what shall I do

Ancestral Property

Hi,

My Great grandmother had a property which was passed on to my grandfather, he being the eldest son. My Father and me being the eldest in the family after my grand father in our respective generations. However without our consent / knowledge my grand father sold the property to his brother.
Can this be challenged legally?

which is better rcr or divorce?

this is two year by my wife desertion with pregnency(male child)for only two months of cohabition.she wanted to leave my old father and come to her home town and give to some money to her parents.i am a govt employee.i tried to get back her many times.but things are gone very worst.they apphrehending me "u r a govt employee.u cant do any thing"but it is clear she dont come.i alsodont go there bcause its slave life.i need divorce if she did not come.
1)in my case which is better rcr or divorce petition?
2)in view of maintanance which is better?
3)how many years of child can i get complete custody of child,if she did not marry?

remarriege

Hello sir,
I get divorced 2 months before. I have one daughter. I registered my name for remarriage on site. Few days before, I got one proposal. He is interested in me. But he is not divorced yet. He told me, his wife has extra marriage affair. They separated 1.5 year before. First she was ready to divorce. But now her boyfriend is getting married. Now again she is interested in marriage. But the person is not interested in her. He strongly wants divorce. He also sends notice to her. She not replied. What should next be the next step for him? His parents are also not agreeing for divorce. Just want to know how many days/ years it will took for divorce maximum? What should he do for faster process of divorce? I have 1 or 2 years of time for remarriage (before my younger brother I should marry again). Should I wait for him or not?

Need a Divorse

Hi,
I am 25 yrs of age and have been married since 1 and half year.My husband who pretended to be a very good person before marriage has changed suddenly after the wedding. He is not earning a penny from the time he got married. He said he would be starting a business and took all money and gold from myself and my mother. Also he has borrowed money from many of my mothers friends.I have been staying with my mother right from the time i got married.I work in MNC. My mother has a tailoring shop.So whatevr money we are earning he used to take from us for his expenses.Now it has been high time because the people from whom he borrowed the money have been harrasing us to return the money back.He has left the house and his phone is also not reachable. We are really very tensed as to where to search for him and how to solve this problem. This has been going on repeatedly and i really dont want to stay along with this person.Please help me to suggest how should i proceed to get all the money and gold back from him and also whom should i contact to get divorced.

Whether D.V. Act has prospective effect or Retrospective

I represents the respondent..... the ptr & respndt living separate since 2002.. later in the year 2009 the ptr filed a case under D.V. Act since they are living separate since 2002 itself i want know whether the D.V. Act applicable to this case or not.... i will be grateful if any citation is provided......
