hello friends,
i m a educated, village girl. i got marride 2 yrs back, there was no relationship in between me and my husband, whenever i questioned, it turned into horrible fight. he used to stay out in night, and pressurize me to go back home, in laws were also ignoring me. with in 4 months i came to know that he spend nights with another women. i have proofs, it turned into big fight, out of mental truma and depression i went back my home. a whole year gone but he didn't came to me. at last elderly people of both families pressurized my inlaws to take me back. out of social pressure he took me. but now everyday he pressurize me to take divorce. i am not willing to give diavorce as being a village girl this will make my life hell. i am getting silent torture there, no body talks to me, try to insult in different way. sometimes try to convince me for mutual divorce. sometime threten to kill everybody including himself. i am fed up of this silent torture. i am living like lifeless object in his house. my father spent a everything on my marrige as per there demand. plz help, can law help me? what should i do?

My wife has been away to her matrimonial home after six months of marriage in Apr 2006,I had send her notice through advocate on Feb 2007 and Oct 2008 but she did not claimed the notice, after that she filed case under sec 125 for maintainance in Nov 2008 stating she has gone to her matrimonial home to see her sick mother in August 2008 and was drove away from her husband after she returned to her inlaw's house she also put severe allegations like husband being drunkard person,beating her severly and other usual allegations,after the same she also file case under sec 9 and application for maintainance under sec 24 of hma UNDER WHICH COURT ORDER TO PAY interim maiantainance of Rs 3000/- pm.after that another court ordered permanant maintainance of Rs.3500 from date of appli
cation i.e from Nov 2008 under sec 125 of crpc on 30July 2010 she had also ladged complaint under DV act in july 2009 but till date nothing is happended except an explaination asked by local police station,
The fact is that she had been away with her father in Nov-2006 has been with her parent since 2006 and is working with Max New york insurance Company as agent cum advisor and is also running private coaching clases,I had produced necessary papers of her working in the company with details of commission earned by her but cout did not take cognigence of the same,My self working in central government and was appointed on compastionate ground and heve to look after my mother and two younger brothers who is unemployed but court in its judgement stated that it is quite impossible that they are unemployed as they are of 28 and 26 years old, htey also produced before court statements of agricultural land at at my native place to show agricultural income but on the 7/12
statements our names are not maintained,it is in the name of my uncles including my late Father who expired in 2002.
So I Request you to please guide me how to carry on the cases,and the procedure to pay maintainance in two cases,I have file apeal for revision of the case,so how should I go ahead? pl. guide me on the above. Thank You

A illiterate lady has gone to a Advocate for filing divorce petition on her behalf for getting divorce from her husband and getting back her dowry articles and for maintenance and her advocate filed divorce petition u/s 13 of HMA. But when the respondent appeared, the advocate of the lady connived with the advocate of the respondent and respondent filed an application for converting the petition U/s 13 to 13-B and the counsel of the lady got thumb marked on the statement of no objection without disclosing anything to the lady. He also filed petition u/s 13-B HMA without disclosing any fact to the lady.He also wrote in the petition that the lady has received all her dowry articles and future maintenance in lumpsum without disclosing the amount. But the lady did not receive any thing from the respondent. The counsel of the lady also gave statement about this in the court without disclosing any fact to the lady. As the lady is illiterate she thumb marked the statement. And the judge without asking anything from the lady adjourned the petition for Six months.
Now the lady came to me and I inspect the file That fact came to the knowledge of the lady. She is totally unaware about these facts.
Now the question is whether I can disclose all these facts to the court when the statement is recorded in the presence of Judge. If yes what should I do? Plz reply

I was married and in Feb'2008 got a divorce decree through mutual consent. Now after the divorce my ex wife has filled a case against me under Domestic Violence Act, Is the law clear in this aspect as during the tenure of complaint period, i am not into any relationship with the complainant.... please advise

in cotinuation with my query section9 of HMA & divorce yesterday
in ur opinon court will set-aside the exparte decree of section 9 as she not received the summons knowingly & on ground that every person has right to present herself before court as she is being a lady just to pay small amount of fine

sir my family member got AP bail for 6 month from 22-february to 22 august after agreement bond b/w my father(on behalf of my brother,sister&mother)and my wife .she declared before the court that she will live with husband wherever he lives and not with parent-in-law.on the basis of this statement my family member got anticipatory bail.i have also got AP,but couldn't sign it due to continuous absence of my wife in the court.now when we appeared before court for continuation of AP bail on 23 august then it was not continued due to absence of appellant.my wife came with me but she fled to her sister home.she intentionally did not appeared in the court and she has threaten that she will make every effort to cancel our Anticipatory bail.she is demanding huge amount of money.next date in court is 18 September.i have two younger brother,one working in Hyderabad for past 8 year and one brother studying in Delhi for past 5 year.i am resident of Bihar and working in Maharashtra.my brother rarely visited home during my stay at home.even one of my brother was not present in my wedding ceremony,which took place in 2004.we are harassed in appearing in court since me and my family resides far away from my wife home.
what should i do now to continue AP.
can my brother get AP from their residing place and file complent against false 498a case.

Dear All experts
Please advise when can i file for divorce since she left me on in last week of April-2010.I want divorce from her as she is characterless and senseless also.
On what grounds i can file for divorce?
She does not want to leave her parents and her job in delhi.She straightaway refused my request to join me at Ahmedabad.
She also threatens me of dire consequences!
Please advice me as i am in a very depressed condition!

if mutual consent decree has been passed under special marriage act, can that be revoked later on finding out that one of the person had taken consent by fraud or by making representation.if so under which provisions of special marriage act. if there is any citation in relation to that than pls give citation for that
