i am married to a girl and she is above 18 years of age.We both are hindus.but now she and her parents are denying the marriage.i have already lodged case under section 9 of HMA.BUT they have not taken my case seriously and her parents are again remarrying her.How can i stop her marriage?My marriage was not registered but it was done in a temple.i have got the priests certificate,2 witness,and marriage photograph.Please help.

I am staying in US. I got married in India on 24th July,2008.
After marriage I did not take her to US as I had plans to comeback to India Permanently.
After marriage often I used to come to India but we never had good time together.
She never talk to me. I lost interest in her and in marriage.
Last time when I came India we both lived together for 1 month but there was no change.
I told her if this is the case I can not live with her.
Then her family memberrs threatened me that
they will file harrasment case and seize my passport and they will make sure that I will not leave country as I am US citizen.
I have dual citizenship. so I left to USA immediately in July , 2009.
After that she filed case 498A,10C against me , my parents and 3 brothers.
Date of charge is 15-3-2010.Case has been filed in tirupati, AP .
We are basically from tirupati, Andhra Pradesh.
But After mrg we never lived in tirupati , we only lived in Chennai. Later on my parents also moved to chennai.
Two of my brothers are staying in Tirupati now.
Now she is demanding 1 crore to give divorce.
I want to come to India but she filed cruelty case on me in May of 2010 in local police station and they sent a look out notice
for my arrest in all airports in India.
We have a record of her saying mediator that we really do not have any problems in marriage life.
And also when she filed FIR she gave wrong dates Where I was not even in India.
Locations and dates she mentioned in the FIR are all false. We have proofs for that.
Now case is in court. But, not even one session happened till now. It is keep on getting postponed.
It is really false case but I need to come to India to prove that.How can I come India in this situation.
Can I put any case on her? If she is not ready to give divorce without 1 crore, is it not possible to get divorce from her.

Dear Subramanian sir, thank you very much for the kind suggestion. Sir I need further suggestions from you.
Sir recently on 25th Nov. 2010, my parents had discussions with her parents among the sacred mediators in my sister and brother-in-law house (it is the same town of wife). During the discussions my parents brought the issue what I am suffering and my family suffering with her attitude and her talks with me in telephone conversations (like she do not like in-laws and wants to separate me from my parents and demanding my salaried to transfer into her accounts instead of my parents etc.,). And my parents requested o stay with them coming to my home in my town, and also requested assurance bond from her parents and from her, that she has changed completely and behave in good moral value girl and mingle with in-laws and co-operate with our well reputed (in my town) family and system.
But her parents denied and moreover threatened in an abused manner that, their daughter won’t come to our (husband) parents home and also they denied to take the chance to keep their daughter with my parents home for the betterment of her change in mentality. Moreover they immorally demanding that, I (husband) have to bear all her tortures and behaviors as I had tied the sacred thread to her neck. But sir really speaking she never co-operated for the costumed family way of living in the days I stayed in India after marriage, and even not behaved in a decent wife way of talks in telephone conversations. Sir I am severely suffering with her behaviors as my profession highly needs a peace of mentality.
Further her parents also threatened my parents that, if I (husband) do not obey her (wife) all desires (which are actually abnormal) they will do dharna in front of my sister-brother-in-law home and demanding my(husband) immediate return to India. If not they will files cases on my family and myself. Also her (wife) father called to my mobile in Italy and threatened me the same on the same day after the unfruitful discussions and warnings to my parents by them (wife parents).
Sir immediate to the next day (26th Nov. 2010) her (wife) uncle (age is around 45) intimated to our relative at my sister and brother-in-law home that, they will file a petition in the court against my family and myself.
Sir here I once again request you to keenly observe her and her family behaviour and talking’s and their moral values and the way they resolving the issues (very immoral and arrogant and torturing way) in the discussion meeting with my parents. All these things highly disturbed me mentally and all my threshold limits were broken. Being my self cheated by her and her parents and her family non moral values and their tortures since last 14 months. Hence now I decided to get separation from her from the marriage bond, otherwise it (wife and wife family) will totally spoil my mental piece, bright scientific future , totally me and my well reputed family system . Hence kindly suggest me further.

My wife filed a 506a against me 3 months ago. I got bail.Now we are not staying together. The address in charge sheet was her address.
When they will file charge sheet?. How i will i come to know if my wife doesn't inform me?..usually how long police will take to file a charge sheet.

My friend wife (37Y)is not ready to give divorce and their case is on since 2006 at family court at Chennai. My friend(41Y) is working at hyderabad and his wife does not know where he lives . She is employed and no child and no maintenance .
In the meantime he developed relation with his associates who work in same company and she is a widow(35Y) with child(7y) and they are of same cast. The girl and her family knows the complete case history of my friend.
Both the families agreed for very simple marriage at temple and planning to take up their new life as live in relationship. Both the families are planning to go with some kind of agreement and once my friend get divorce , they will legalize their second marriage.
They would like to know whether any trouble can created by first wife. Is that any standard form of agreement is there for live in relationship. How to protect the girl and child . What kind of precaution should be taken . Kindly advice.

My mother has made a fixed deposit in Post Office and has made me a nominee of it. She has made me a nominee of her bank account also. She has not taken my consent for this. Due to family dispute I do not want to be the nominee. But my mother does not agree for the cancellation of nomination. So, in this situation I like to refuse / cancel / make invalid the said nominations forcibly with the help of law. What procedure I should follow?

I had done the civil marriage on 16th Feb 2010. it was arranged marriage and traditional marriage was planned for 28th May 2010. On 15th May i was fall sick, my wife and her parents came to my home. they took me to Doctor. i was asking them what happen to me, they were keep saying nothing. They told me to do CT scan of my stomuch , but actully they did my hip CT scan. I had already updated my wife that while playing cricket i have some issue with my HIP but i m working file, i ride Bike(ACTIVA). They Did my blood test, They come up with Blood test as Sickel cell Anemia, They didnt show me any report. they Broke my Traditional marriage, as we did the civil marriage they were telling me to go for NULLITY, I REFUSED, I HAVE TAKEN AROUND 2.25 LAC LOAN FOR MY MARRAIGE, I HAVE PAID LOTS ON MONEY TO THEM.i was asking them t pay back my expenditure then only i will give divorce. now its alsomost 8-9 months passed. i dont want to give divorce if they refuse. is there any possiblity that i can tell them to send my wife at my home or should i file pettion for her.

I am an husband married on 8th November 2009. I am suffering with my wife tortures like she want to separate me from my parents and want all her control on my earnings and also threatening from her and her parents that, if i don't come into her grip she and her parents will file cases on me and my family members. I am facing this type of mental tortures from her since the 4th day after my marriage. She also not agreed for sexual intercourse.
For the last 14 months she is residing in her parent’s home in Suryapet, with out taking visa to join with me in Italy and also not living in my house in Macherla in India with my parents even though I requested. She told that, she do not want to stay along with my (husband) parents and also she told that, since last 5 years prior to our marriage she loved a boy but her parents denied to marry her with him and her parents further searched for a rich orphan well settled boy to marry, after she completed MCA degree in 2004(this she told me within 10 days after marriage). This shows that clearly her cruel mentality and cheating nature of her parents.
I totally cheated by her and her parents as they told during marriage discussions that, she is good girl well co-operative and adjustable girl, and even i informed her and asked for co-operation agree during the engagement day itself that, my parents will stay with me only instead of my brother as my brother is economically week. Then she agreed but after marriage is over, she started the torture which is actually her real character. Even she did not tried to complete VISA procedure to get Visa in India to join with me after my several requests.
Now i am in very disturbed state of mental condition, and i am unable to do my research projects also not in a well concentrated mind in the university in Italy. Her behavior and threatening in phone conversations till the April 2010 end (later i stopped phone contact conversations with her cruel way of thinking and mental torture to me) made me totally mentally disturbed.
I am working on scientific project in Italy, these tortures are very much disturbing me and causing threat to my scientific future. I decided to take divorce as I think I am unable to continue marriage life with her.
She is staying till today in her parent’s house and and she only stayed 1 day in my home during marriage reception.
Kindly suggest me what are the grounds i have to take care in filing the divorce application in India to relieve from the tortures form her (wife).

Is there any way by which a girl can prove that she is not yet married if other person is wrongly alleging her status to be married.

my husband had applied for divorce under sec 13 i a, he is the one who kicks me and beats me always for silly reason, hence i had filed FIR on him as he is harrasing me physically. he was asking me to give divorce under MC, the tortures went everyday night, though he had physical relation with me also. we have a son out of our wedlock, son is with me. he has documented as i was not with him after 3 months of marriage, but i have the photo's with him on important ocassions. is this FIR and photo and email proofs or enough to deny my husband's case, i have filed RCR and i am not interested to get IM for me, but for my son he has to provide.can u please suggest me how many times of counselling are allowed.will court provide any mediators to explain him the fruitfullness of life.
