Difference between section 13 & 13B.
I would like to know about the difference in section 13 or 13B or which section is applicable for mutal consent divorce and which section is best for divorce petition.
Kindly help and reply urgently.

Dear Expert,
Kindly let me know the process of mutual divorce.
If I will prepare the paper and get the signature both husband and wife then submit to the court its fine or we both go to court first.
Please let me know the details. I want just prepare the paper with the help of lawyer and get the signature both and submit the court. It is possible or not?

A was head of a family. B is his wife. C is his mother.Father is no more. 'A' committed suicide.a lot of debt is on A's property. B took all insurance claim with her. B also demanded rest money after auction of A's property by bank.Now B did second marriage within an year.How a widow mother can get her share from B.Please anyone can help for this case at Ahmedabad/gujarat? Respected sirs crpc 125 trail came in family court.normally they are giving date for every week.how many dates will take for disposal average.is there chance to delay the matter for opposite party wife after passing the interiam order?how to expedieate the matter?.thanking you sir.

Hello Experts,
Kindly help me out with the power of your knowledge.
We are 2 siblings, younger brother and myself, both married. Both parents are alive and we stay in my father's house.
Parents seem to have an inclination towards my brother and want me out of the house. They have indicated so on no less then 3 ocassions (albeit during heated arguments).
Father is retired and runs the house on his pension. I contribute more than my share in the household and other expenses.
Though the house is in his name, I have spent a substantial amount in the construction of a few parts. Younger brother hasn't spent a penny though he and his wife have a steady income.
Inspite of all this, if the intentions of my parents(specially mother) are any indication then I will most certainly be deprived of any share.
Do I stand any chance here of getting my rightful share. I have no evidence of me having spent money for the house. Though, bsnl bills have been paid using my debit card, I doubt if it means any kind of evidence.
Please help me out. Let me know if there are any options available.

Dear Expert,
I was married on Jan 2009 after few months my wife creating problem because of her ego and she is not trust anyone and very shaaki type of girl. we have a lot of misunderstanding and a lot of day to day issues. I try a lot but she not ready for anything.
My in-law also help less cos they told me we can’t do any thing because she not listening to any body not even her mother.
Because of her my life is hell and she is not ready to stay with me and not give me divorce at any cost. She flirt also with other guys. I have seen that on her mail id now she deletes all that mail also.
She is working and told me I will not give you divorce at any cost and her mother father totally help less she is out of control now. She fights with her mother also and with my old parents also.
Now in this situation what should I do how can I get the divorce because she give me threat I will stuck you and your parents false case like dowry DV 498a and even torture and for that she want to die this kind of false case. She threat a lot.
Please advice how I come out this situation and get the divorce so that I can live my life peacefully
One other question any video recording by detective which proves she has relation worth other guys it is valid in court. ( but we can’t prove even she has physical relations also cos I know she has but we can’t prove that because this is something nobody do openly )
Please urgent advice want to live peacefully and need divorce this kind of women. She threaten and not ready for divorce at any cost and i don’t want to spoil my life with this women.

Hi Sir/Madam,
My Name is Mahesh. I got married on June, 2010. Till the day I got married, I have been facing problems with her arrogance nature. Her family is some how richer than us. I came from poor background and have family responsibilities. I have take care of my older parents and my sister's marriage. My wife always relates the love with the money. I tried to convince her somany times. But she never understood. She always compares her life with her sister who was married with a rich person. She complains to their parents in her favour. They know her attitude but they are supporting her and trying to threaten me to make her happy. Please give me a solution for this. Now she is pregnent. Still she finds the ways to fight with me, sometimes threatens me by saying that " You are not caring me, I will commit suicide". I cant live with her. Can you plese suggest me what can I do now.

1) Under which section and circumstances arrest is possible under DV.
2) Are there any ammendments in DV 2005 and 2006 recently in support of husbands.
3) Is there any punishment for false complaints.

In DV act is it possible to get exemption in maintainance. (wife+child(less than one year old)).
The wife is highly qualified, UG+PG, but not working at present and residing in the house of parents.
D.V. case
Legal and expert guidance needed by aggrieved husband who is a advocate in the same court where the Domestic violence case filed by estranged wife. .....
1) Wife working with private hospital and accepted that she is drawing salary Rs. 22000=00 and left husbands home 2 years back and went to her parents house.
2) she has illicit relations with ex-colleague and very late night phone call details and her actions proves that.
3) she also filed complaint in CAW women cell and after hearing both sides ACP, forwarded the case to mediation cell.
4) couple have one 6 year old daughter, presently daughter living with mother.
5) she filed domestic violence case 3 months back.
6) Husbands father and mother disowned their son and daughterin law, when it becomes unbearable to see fight between husband and wife during the presence of daughter in law and wrong treatment meted out by d -in- law.
a) Can wife seek maintenance for herself as she is working.
b) Can the names of fatherin law and mother in law can be excluded from the case,due to legal disown.
c) Is there any advantage to go in mediation. Are they biased or fair?
d) what other precautions can be taken by husband and his parents to save from unnecessary harassment.
