Wife filed divorce case on the ground of cruelty.
Main fake & frivolous allegations are Dowry, non provision of food & physical as well as mental harassment by respondent, mother-in-law and father-in-law.
No 498a or any other police complaint.
Written statement is filed by respondent replying every allegation in detail and no allegations on wife.
Issues determined by judge.
Wife filed list of witness containing herself, her mother and uncle (mother side).
Respondent has no allegation so not filed list of witness.
Query
Whether wife’s advocate insists for presence of Respondent’s parents for cross examination? Father is not able to walk and undergone Joint Knee Replacement surgery.

My surname was mentioned by mistake in my X Class Certificate which was different from my original family surname.It continued the same way in all my certificates.Even my passport contains the same name.
My question is
1) what are the consequences i am going to face since i have not travelled abroad so far but planning to travel soon.
2)Should my son continue the original family surname or my surname.

My grandfather runs a family business and now he is not well. He owns lots of houses. He has two children , a daughter ( my mother) and a younger son (my mama)
The problem is, my grandfather is biased towards his son and he wrote most of the property he owns 80% in the name of the son , not even to his wife (my grandma)
My mother is a single parent since 20 years and depended on grandfather for financial needs
To make the matters worse, my mother and grand mother are tortured in the same house and fights happen to the extend of dragging my mom and grand mother out of the house by my uncle's family., since the house we stay will belong to my uncle after grandfather.
Could we do anything to settle this issue. Is that my mother or my grand mother claim any property though the will is already written ?

do i have to pay registrar fee for applying maintenance , if i am not working , my current assests would be in tune of 8 to 10 lakhs whereas my husband grooss income would be 4 to 5 lakhs monthly.i had obtainted an order for same in 2004 but had let go of my case but made my husband pay the same amount of interim maintenance which the court had directed , in year 2006 30 k seemed like a decent amount which i my husbant increased to 5000 more , it barely covered our living exoenses as court had directed him to pay the same while we co habited.if i file for maintenance will court look into this matter also that he never maintained us in accordance to his status, how much can i expect as maintenance from him and how fast will be the relief given to me , i am planning to seperate from him after 13 yrs of abusive marriage.

My Fiance is from Goa and I am from Chennai. We are planning for marriage registration in Bangalore under Special Marriage Act since both of us are here right now.
My fiance’s paternal grandfather had left a property for his children and this is under litigation. The problem is with respect to the percentage division of the property. My fiance’s dad is currently fighting for this.
a. Is it true that if we get married outside the state of Goa – my Fiance and me automatically lose the right to this property or fighting for this property after his dad - Does Goa have separate Portuguese/Goa property act? Or can we get married in Bangalore and it does not make a difference with respect to the succession/property law?
b. If we have to get married in Goa, does the Special marriage act apply here or is it a different act for inter-religion marriages?

Domestic Violence & maintenance.
Sir,
My wife has filed a case under DV Act 2005, in 2009 Feb. After delaying the case with various reasons/applications, she has now claimed an intriim maintenance of Rs.20000. She was working in a college and now(Jan2011) claiming & mentioning that she had resigned the college as I had send a request for her salary request under RTI and college authorities asked for the same.
Kindly help on -
1. What stand should I take in here.
2. Can I go to her college and ask for the reason of her resignation in Written ?
