Respected Members of LCI,
I am a really troubled man. My wife has given me a very hard time after 3 years of our marriage. We were incompatible hence I told her that we better separate. There were regular fites in 3 yrs of painful life.Wife attitude and her greed for money not even caring for her husband has lead to the misery. She was just interested in money spending lavishly. I am a techie and build my career after 4.5 yrs of stay here of which my 3 yrs were wasted by that women. She took money and sent it to her parents account. I had opened an account in her name and also a joint a/c. She used to regulary put money to her parents a/c. These beggars have even bought a plot and a flat out of my earnings on loan. All my earnings have been looted by goons. When I discovered this there was abig fite nd she left me stating u ll ve to pay 4 this. I will wipe u completely 4m US and destry u nd ur family. My family never had anything in this.They are in India.We visted only 1ce in India 4 vacation for 25 days. thats it. She took away all my savings and my blind faith in her lead to this situation. She went to india and ha sfiled false cases of DV, Dowry and 498A on me and my family. Shes really ruined us from society. She has prayed for hefty maintenance and asking 4 me to buy her a Mansion in Hyderabad. I am sucked up completely. Shes not stopped at that she has written some false story to Indian Embassy here. i am really worried. i am an Indian citizen and Indian embassy is threatening action against me. Kindly let me know I am in foreign land for 4.5 years
1.Does Indian Embassy have right to take action against me here ?
2.Can they book me under false DV/498A/Dowry case filed by my wife ?
3. Can they take legal action against me in US for fake DV case ?
4. Do they have right to ask my employer for my salary ? My employer said that they have recieved a letter 4m Idian embassy ststing that there is a case against me in india and his wife has alleged DV against me. With regards to that they need to know my salary.
I was shocked since tis happened all of a sudden. I was served with summons here. I did not have any clue as to what this women was upto.
5. What are the Powers of Indian Embassy in US if they have to do something against me ?
6. Can a wife be favoured by Indian Embassy just based on her false allegations as one of her prayers is that i shud be brought bak to India for trial criminal proccedings.
7. What legal action can i take against Indian Embassy as I think they have crossed jurisdiction by approaching my employer. Am not sure if they can do so.
8. i am yet to appoint a lawyer and our case hearing has not yet started.
9. Even be4 any hearing can indian embassy take action against me and try to deport me back to India ? since they have already contacted my employer
10. In case if there is a court order in future then what is the role of Indian embassy ?
11. How do I file for divorce ? I do not need such a wife who has ruined my life.
12.I have been advised that if I fly to India I would be arrested at Airport with passport seized. Is this possible ? I was further told that there could be RCN/LOC against me in India with police waiting to jail me.
I am an innocent man I have very old parents in India and 2 younger sisters to look after.
I am really distressed. Indian embassy is harrasing me without hearing my side of story. It looks as if they are in India and doing all Gundaraaj here in foreign land.
Request the forum members and renowned lawyers to kindly bail me out of this situation. I am completely broken down.
Pls help.

Story in brief
Male married a female as per hindu religion, and male working in pvt firm and female working in call centre, after 1 year of marriage huge querrel between both, male resigned his job and went to village (rural place) female went to her parients house but still working in call centre.
Male filed a MC Case in Family Court in 2007, male (Petitoner) wants his wife to resign her job and stay with male in his village, female (Respondent) makes false alligation against him as Extra Maritial affairs so she dont want to stay with him, but she wants Mainteance and she dont want to give divorce without maintenane. how would be the justices for male.
NOW today 31.05.2011, the family court of mysore has passed the orders as such.
The petitioner's request is allowed subject to make a house in mysore city except the two areas specified by the respondent within 60 days. and also mentions in the orders that the respondents allegation made against petitioner's extra marital affairs can not be disbelieved.
My request: I am really innocent how to prove ? and i am staying in my village, now can court order me to make a rented house in mysore city limits except two areas as specified? what to do next, pls pls pls kindly advice at the earliest.

in my divorce case after 6 months also my advocate telling not numbered to my case. today morning i went to court and enquired in court dairy, there is no case and my advocate not yet filed. i went and asked my advocate to return my case file. he told ok come on evening. at evening he returned my file and vakalat no objection and SR number. he filed case today only hurryly. i lost 6 months time and rs7000 money . sir now i want file a case against advocate in state bar council. now i have only vakalat paper. is it enough to complaint on my advocate in state council of ap sir?

can the sons aged 11 and 13 yrs file a suit in court against mother for neglecting them and abandoning them and requesting the court to come back home? The mother left them to suffer one month before their final exams. They did not have proper food and were living alone at home as the father had to go to work. The family returned only last year from abroad to settle in India and the sons cannot speak the local language. PLEASE ADVISE

My father married my mother without divorcing his first wife. my father expired 28 yrs ago.
when my father died i was 5 yrs old and my elder brother 10 yrs old. we moved to the city and never returned back to our village till now.
My step brother wud send us some money by money order initially and then later on he wud come and give us cash. He stopped giving us money after 2001.
Im 33 yrs old now and my elder brother is 38.
We had always known that our father had left behind some properties.
After my fathers death my step brother got all the property transferred in his name.
Questions
1)Does the 12 yr time limit for filing the partition lawsuit applies to us since i turned 18 yrs old in 1995 and shud have filed the partition suit by 2007?
2)can we still file for partition?
3)If we cant file partition suit, what else can i do?

My name is Ashish Joshi. My age 27 years. I love one girls last 2 years. She is 25th years old. There parents are not ready for this marriage. My parents is ready for marriage. We dont want to marry in court. We want to marry in arya samaj. Can this is possible. After marriage it will take some issues in her home. We are not denyed for registration of marriage. We will register our marriage through registrar.
Is this valid. Arya samaj marriage ceritifcate is valid.

what to do ?
hi everyone.
i was married to a girl without knowing to any of our parents and the same was solemonized and registered at register office. i got the certificate and we lived seperate since it will take for our parents to accept our love. but, in between, we got some prob and we are seperate now. she is engaged now to a different person.she has totally hidden all these to him. we did not apply for any divorce and still she is my legal wife. what to do legally ? is there any way that she can deny our marriage ? will she be able to ask for any compensation , during divorce case?
