i got your reply but i would like to ask you that how can my father get remarry if he has not got a legal permission for second marriage and how his second wife and his childrens are legitimate. what about my birth right? there were no legal sepration between my mom and him? has he guilty infront of law? my mom got married after 12 yrs of my birth but he got married when i was just 3 yrs. how his second marriage is valid if it was beyond the hindu marriage act. pls let me know whats fact

my name is Sandhya i am 20 years old and i would like to consult about myself and my succession in fathers property. my mother and father got married in 1990. they blessed a girl child in a year 1991. ( its me) but after my birth they got seprate due to their some personal matters or mismatching of their thoughts. My mother and her family (my grand mother and grand father ) has been looked after to me. they gave me love and education since i was one year old. my father got married (1993) with another women and didnt ask about me and my neccesity, even not spent single rupee for me , our financialy condition was not good so we couldnt take any action against him. i was minor and i was not aware of lawful things. In 2003 my mother got married with bachelor person i was also agree with my family decesion , i had no objection for my moms second marriage because according to me she had done her duty and was doing. i am still staying with my grand pa and grand mom but as per my colege record still i am using my fathers name. father have two dougther and one son fro second marrige. Now i am feeling that he only gave me birth nothing done other than this. i wish to file case against him for my compensation and succession in his property. can i get my rights in his property? or can i get compensation? or can i proove himself as a fraud? can i send him behind bar? i am a college student now and its very defficult to complete my education as wel as my marrige because our family condition is not strong. kindly guide me for my future as you think suitable to me and my family. one more thing my father is government servent.

can a complaint against the mother-in-law be filed as PWDV Act,2005 specifies protection of women. i would like to know the for and against arguments for this statement as my understanding about this is limited . please do help as quick as possible.

pl explain me interpretation of sec 16 hma.it say if a decree of dissolution is passed instead of decree of annullment then children begotten are legitimate.
is there any scope in this section whereby we can say children are not legitimate.

MY GRANDFATHER(PATERNAL) IS OWING A RESIDENTIAL HOUSE WHICH IS INHERITED FROM HIS FATHER BY WILL AND BEFORE PASSING AWAY MY GRANDFATHER HAS WRITTEN A WILL (IN 1982 NOT REGISTERED) STATING THAT THIS PROPERTY WILL PASS TO MY WIFE AND LATER ON TO THE DAUGHTER (6) ACTUALLY MY GRANDFATHER HAD 2 SONS , 6 DAUGHTERS AND I AM THE SON OF ELDER SON , NOW THE PROBLEM IS CAN I CLAIM RIGHT ON THAT PROPERTY AS THE WILL STATES ONLY DAUGHTERS HAVE RIGHT AND ALSO 2 DAUGHTERS AMONG THEM HAD ALREADY EXPIRED (ONE AUNT HAS GOT NO CHILDREN AND ONE AUNT HAS GOT ONE DAUGHTER ALREADY MARRIED ) WILL THESE TWO DECEASED MEMBERS GET SHARE IN PRPOERTY OR NOT MY FATHER WHO IS ELDER SON ALSO EXPIRED ?? Dear experts,An order for interim maintainance by Hon'ble court EXCUTABLE ? in a OP filed by wife for DIVERCE.The husband already filed RCR before filing the DIVERCE petition by wife.Any citations please.2.The Hon'ble court did not taken in to consideration documents filed by husband in Diverce petition as respondent such as legal notice etc;before filing RCR.Is it a good ground for filing for CMA in the High Court? or is it a better to file REVIEW petition in the same court?Kindly advice with citations.THANQ.

Just want to know , my wife leave me 4 month back and after 1 year if I will go to court then what kind of proof I need to prove that my wife not leaving my home last 1 year. So that court will know we are not saying lie to court and in real she is not our home last 1 year.

Hello Experts,
Greetings for the day.
My uncle was convicted on 498a charges 2weeks back, Knowing that he was a fits patient the police have arrested him. On the same day he was sent to jail. And on 14th July 2011 he got bail. But before releasing him on bail he went into COMA in jail Premises. The jail authorities immediately called his relatives who where standing outside for him to come out and handed over him to his relatives on the stretcher itself. They immediately taken him to Osmania hospital in jail van itself. There treatment was given to him but his condition was in critical position so his relatives immediately taken him to Private Multispeciality hospital. Where the doctors have confirmed that his condition is very critical as there was a Sevier blood clot in his head and done a critical operation immediately. The operation was successful but the patient is still in COMA. While the doctors have confirmed that there was a Sevier injury on his head that’s why there was a blood clot and basing on that he got FITS. Currently this person is still in COMA and is in ICU currently. In the FIR my uncles 3 brothers and 3sister names are mentioned. Where as all these people live seperately. But she has mentioned all these names in FIR stating that these people and her husband have demanded her for more dowry and sent her to her parents house.
Now my question is we have not taken bail to 3 brothers and 3 sisters as all these people are in the hospital with my uncle looking after him as he is in critical come stage fighting with death. This is a false case. So these people have to take the BAIL or they can directly QUASH the case in high court.
And who would be responsile for my uncles condition the jail autiorites, or his wife or police who have arressted them.

Last year i Made a querry that " Whether a adoption can be made through attorney", to which i got all the responses in negative. But now i thoroughly gone through the Hindu Adoption And Maintenance Act and find out that Sec 11(vi) allows it. As the words "Under their authority" used in this clause clearly permits.
