Defamation

Sir, i want to ask a question in regard of my friend whose x-wife lodged false cases on him and his family, she did 506 294,498 and DV the case took almost 4 years finally my friend & family won the case The cases were dismissed as it was not proved. My friend spent so much money to fight these cases, so he want to file for defamation against xwife, I request you to plz provide information on defamation case and how long it takes and is it worth to spend time for this kind of cases?

About restitution of conjugasl rights

sir i was married last year december my wife hardly stayed with me for one month and went to her parents place without intimating me nor my parents now its hardly 10months completed she never returned to me whenever i call her she complaint me about my sister and mother though they are innocent towards her. in the period of one month she use to quarrel with me and my family on one issue or the other and also she use to take depression tablets every day which i dont know and when ever i called her to come and stay with me she make an issue of my mother and sister but as i am the only son to my parents i had lots of responsibility towards my parents abd my sisters and now i approached a lawyer and he suggest me to file restitution of conjugal rights.my doubt is that i stay in anantapur,andhra pradesh and she stays in indore,madhya pradesh is there any chances for her to transfer the case to her place where as the marriage was performed in my place only and last residing also in my place only. It clears that juridiction comes to my place only plz let me know clearly whether she can transfer the case to her place and if she transfer the case then what are the [possibilities to stop the tansfer of the case to her place plz reply.............

Alimony from wife

I am 40 years of age staying in a flat owned by my parents. I am staying with my parents, wife and son. I am suffering from paralysis of both the legs. Due to this I find very difficult to work and earn and I keep on leaving jobs and remain jobless for months. Currently I am earning around Rs10000/- pm. I do not know how long I can do this job.My wife is also earning around 7000/- pm. My wife wants divorce from me. Looking at my low earning potential and at times jobless for months together and paralytic condition, do I have to pay alimony to my wife after divorce. Looking at my paralytic condin and low earning potential can I request the court to grant alimony to me from my wife? Please advise.

False reply to plaint ..........perjury or ?

If respondent denies working in written reply w/o affidavit, in section 125 case and has to file it later on order of court,which section can be attracted?

MY GRAND FATHER HAD THREE BROTHER.ONE BROTHER HAS NO CHILD
HE WAS OWNED ONE HOUSE.
DURING HIS LIFE TIME HE WROTE A WILL TO THREE BROTHERS.
MY MOTHER AND MY SELF WAS BUYIED THAT FROM REMAINING TWO BROTHER AND REGISTERED IN REG.OFFICE.
REMAINING ONE SHARE IS MY MOTHERS FATHERS
MY GRAND FATHER WRITTEN A WILL TO MY MOTHER.
NOW MY MOTHER GIVEN SETTLEMENT TO MY NAME.
MY MOTHER HAS FIVE SONS ALL ARE MARRIED
MEAN TIME MY ELDER BROTHER MOVED THAT HOUSE AND DIED SUDDENLY.
HE DID NOT PAY ANY RENT
BUT MY BROTHER WIFE (WIDOW DAUGHTER IN LAW) ASKING SHARE FROM THAT HOUSE.
I CONSULTED THE LOCAL LAWYERS THEY SAYING THAT THE WIDOW DAUGHTER IN LAW (NO CHILD)
HAS NO RIGHTIN THESE PROPERTIES.
BUT THIS IS VERY SENSITIVE ISSUE .SHE GATHERED SOME LOCAL PEOPLES AND HER RELATIVES AND THERETENG ME.
TO SETTLE TO HER NAME. NOW WANT THAT HOUSE
IT IS NOT ANCETRAL PROPERTIES.IT IS COMEING FROM HIS GRAND FATHER ‘S BROTHER.
ONE SHARE IS ALSO THAT IT IS MOTHER ‘S FATHER PROPERTIES.HE WRITTEN WILL CLEARLY TO MY MOTHER

Recovery process

Dear sir,

Its a humble request to provide any judgment of Supreme court/high court which says that 498A/406 is not a recovery process.This shld not be a problem in confirming the anticipatory in to a regular bail.

Cruel nature of mother towards 2 years old child

Respected lawyers,

i would like to ask for your valuable suggestion regarding any provision of indian Law where a case can be filed against a mother who tortures a 2 years old child and uses him/her to mentally harass her husband.Can the husband provide evidences in court to get the custody of the child??? The wife continuously and persistently beats the child mercilessly.

Judgements

Respected Sir,
I would request you to provide me judgements on:-
1) Visiting rights of father every month.
2) Asking court to provide Receipts to Husband for maintenance expenditure by wife and child. This will reduce the maintenance amount misuse, specially when court case is running.
3) Can such receipts be asked in court under Right to Information Act. (RTI).
Is there any Law or Act which gives such powers.

Maintainability of fresh allegation in decree execution court

Kindly advise whether in decree (ex-party RCR decree) execution court fresh alligtion is maintenable if these raises by the judgment debtor? In such situation JD did not appreaed in the main RCR case.
