sir nite i received one reply regarding witnessbox. thank q sir. sir actully is would have asked in the same query another doubt, but my mistake i have forgoten to ask. what is my doubt is:
sir i said na sir the respondent did not enter the witnessbox in both the cases that is OS and OP which are matrimonial issues. But the respondent filed Written arugments in both OS and OP though she did not entered the witness box.
sir as you said that court will not consider the chief affidavit and counter filed by her as she did not entered the witness box, sir my doubt is whether the court will consider or not conisder the WRITTEN ARGUMENTS IN BOTH THE CASES THAT IS OS AND OP as she did not enter the witness box. sir plz provide any sc citation regarding the above two reasons that is when the respondent did not enter the witnessbox and her written arguments filed by her not valid.

One house was made by my grandfather. my father and my uncle each got 1/2 share in that house. Pattas [documents of property] were made separately for each portion of house. There were some other joint properties with my father and uncle. my uncle dead, then my father and widow of my uncle entered into an agreement for all joint properties. With effect of that my father became owner of entire house. My father executed a will in favor of me but my brothers filed a suit for partition claiming their share in disputed house. Their pleading is that house in questioned was built by our grandfather, my father can not execute will for that.
Experts are requested to tell whether one can transfer his share in partitioned property by way of will.
Please tell the relevant citations.

two matrimonial issues are going on in the same court. one is OS and OP. in both the cases the respondent is same. respondent is lady here. she filed chief affidavit and counter in OS and OP. Plaintiff and Petitioner have aduced thier evidences. but when the respondent's turn has come she did not attended witness box in both the cases that is OS and OP.
sir now my doubt is :
what is the gravity of Chief affidavit and Counter filed by the respondent filed by the respondent when she did not attended the witness box.
The pleadings taken by the respondent in chief affidavit and in counter are valid or void when she did not entered into witness box. will court will take the cheif affidavit and counter into consideration.

sir in love marriages generally parents of both the parties will not attend. bride and bride groom will go to temple and perform their marriage. bride and bride groom clicked their marriage moments in a cemara. now the girl is not accepting that marriage. husband fild OS in the court. husband filed thier marriage photos along with nagtives in the court. will court will ask that husband to call any person who eye witnessed the marriage or court will satisfy with the photos filed by the husband. photographer closed the shop in this case what court will take the decision. generally in love marriages bride and bride groom will be there and even it is difficult to call the parties to the court to give thier witness who attended the marriage. in this case how court will take the decision.

WIFE FILED DIVORCE CASE. NO PRIOR DV CASE OR 498A CASE. HUSBAND SENDS SMS TO WIFE TO COME BACK AND RECONCILE. WIFE BEING AGGRIEVED BY SMS SAYS THAT I AM LIVING HAPPILY WITH MY WIDOW MOTHER HUSBAND'S SMS ARE CREATING MENTAL TORTURE TO HER AND HENCE WANT TO FILE DV CASE. WIFE LIVING SEPARATELY SINCE LAST 3 YEARS AND SHE HAS TO FILE AFFIDAVIT OF EVIDENCE BUT SINCE LAST 5 DATES OVER A PERIOD OF SEVEN MONTHS SHE JUST TAKING ADJOURNMENTS ONLY. HUSBAND DON'T WANT DIVORCE. THEY LIVE 3 MONTHS TOGETHER AFTER THEIR MARRIAGE. CAN SHE FILE DV CASE NOW ON THE BASIS OF SMS ONLY? OR DV CASE WHEN COURT CASE IS GOING ON?

As you know all finally my wife cheated and not to come with me.here my doubt is
1)If do not attend marriage nullification case will it bring problem to me?
2)The have not said any materiel evidences but only oral by my wife in the petition.
3)Must i defend the case.
4)will the court issue warrant against me.
5)If i go for medical checkup how much money is needed.

sir a complaint in police station was entered in General Diary of Police station. Now my question is sir whether general diary entry of police station is valid or not. Generally i heard FIR is having validity. are there any court judgments relating to divorce issues based on general diary entries.

sir wife filed a complaint against husband and inlaws in police station. it was not FIR, it was entered in general diary. now the matter between wife and husband is in court. now the third party who is applying for those copies under Right to inoramtion act from police station comes under Public Document?

Dear Experts,
My 498a wife did not attended any of the hearing for RCR which i filled, we submitted Petitioner evidence and then Written Arguments for the same. judge accepted those and give one more date.
I am not sure, what is that next hearing is going to be?
my layer said it is going to be Judgemnt that Ex-Parte? is this correct?
I have DV Case running in Other city, next date should be cross examination i hope?
She lied in the court that she is not working although working?
I am trying to get her employement details.
when and what stage that i should use these envidence?
