fed up with a cruel and domineering wife.expecting 498a etc etc soon….
pl answer following queries:-
(a) what option is better?...going for divorce on cruelty straightaway or first give her and her family a last chance for marriage counselling...which they will never agree and come up with lots of excuses to avoid that.
(b) i have a mobile phone with inbuilt sound recorder and mem card...does recording valuable admissions of wife in that memory card help?...what are precautions to be taken to admit that as evidence?..like if sound clip is recorded and stays there in memory card but some ringtones etc etc are frequently deleted or added...will it tamper the memory card evidence?...also if some sound clips of her are deleted from mem card and some are kept which are useful..will it be considered tampering...and can it be retrieved by forensic experts later?
(c) a cheque of rs 20000 was given by father of wife one month after marriage saying pls keep the money...u have spent lots of money on marriage...buy some items...take it as my contribution.....Now that good man saying that i demanded that money and harrased my wife...and be prepared for an FIR with evidence of that cheque which u encashed!...Is that damn 20000 a gift or a dowry....what effect of that on my future case?
(d) me residing in different state from my wife who is in haryana. What delays can i expect. how easy is for haryana police to come to different state to arrest or interrogate?..or will the case move at a snail pace...with letter writings by police to me requesting me to join investigation?
(e) Streedhan at my home rt now...except jewellery which is in her father's bank locker...what to do?...ask her to collect these items or send them by transport to their house......or to local police stn at her place?
(f) what is actually happening in AB cases in haryana...since all 498a, 406 cases similar....what are the grounds for AB?...actual streedhan is always disputed.....she can say jewellery is with u....blah blah blah......what are the facts which favour grant of AB?..or is it just plain luck and attitude of judge?
(g) I have been alloted a plot of land 5 yrs back...not taken possession of it but paid yearly instalments of its cost from my own salary and loans and now only 2 more instalments left....what to do....do i sell it imdtly to avoid that allotment getting struck in future Dv case and also since marriage (property distribution) law likely to be passed in future....please give only practical and sure shot advice.
(h) also such sales do provide some money in black to the seller(like premium over the registered price of the plot)...how to conceal that amount from preying eyes of wife...and her good father...do i buy gold from that amount or dump that money under a tree!

Having submitted all income proofs of daughter in law-court has advised both the parties to submit income tax returns for the past three years on the next hearing.
Is it a positive sign for quashing maintaince case against a working DIL earing approx.45k p.m (net salary as per bank statements).

Hi,
My wife is asking me to add her name as 2nd owner in my own flat which I have purchased on loan with my father's help and initial down payment from him. He is also a co-applicant and have no share in my flat.
In this case what can be done to add her name? And as a wife is it necessary to add her name? I also want that if anything happens to me then my father should get his share of money from my flat. Me and wife are now shifted to another city and said flat is vacant. What legal necessities I have to make so that my both the parties will be secured. However my wife's explanation about her ownership is to show some address proof for banking purpose if any occurs. Kindly guide me on this.

A person previously married having children entered registered marriage with another lady , suppressing the fact of his first marriage now second wife have taken divorce . Second wife has 3 children, second wife filed maintenance case and court ordered 2000/-Rs. PM . Now husband seeking cancellation of maintenance on ground that marriage is zero . Whether husband will succeed ?

Dear sir,
The court imposed interim maintenance of Rs 8000 with effect from date of filing petition by her ( my wife ) which 18 months ago, it means Rs 1.44, I have to pay and then Rs 8000 per month.
01 I paid Rs 49000 to her thru bank.
02 There was FD of Rs 75000 in both name, first name was her, she have taken that money, but she was housewife, I deposited from my earning.
03 She got issued one cheque from ICICI Bnak from Joint Account and withdrawn total amount of Rs 30,000.
Total amount is Rs 1.55 lacs which she received from my source of income.
Please guide and give opinion, whether this amount can be adjusted against Rs 1.44 lacs, if you can help in this matter.

Sirs....
I meed ur valuable suggesstions to save my sisters life....
Her name is mary sherly 24. She is a physically handicapped by post polio attack. Last year september our family arranged a marriage with one. Who was purchased a land by her money only but he registered that land to his name only. While her marriage her would be agree for following conditions 1. He will stayed in my fathers house. So we gave two laks rupees in hand and 320 gms gold. After his marriage with out knowing any one he taken one bangle and he put in brokers shop. While we asking he replied i wants to pay the interest for five laks rupees mean while my father arrange the money from some else and paid for him. But he didnt pay interest for six months. When we wasking he was saidi sell my house and giv money but he didnt. When we told ok dont sell you register that in my sisters name first he agree and fixed the date to register. When date will come hr wont come.....wat we can do legally to save my sisters future and get money from him i seek a help from pls giv ur valuable suggestiom as soon as possible.....

Dear sir,
While giving interim maintenance to my wife under domestic violence, the court today removed the condition of 23.12.2010 that the respondent ( S P Goel ) is restained from creating any third party interest in the house in name of respondent. She was given Rs 8000 per month from starting of petition, she demanded Rs 10,000 total in her petition sir
01 I wish to know whether I can sell house now.
02 In future hearing, maintenance may be increased up to Rs 10000 which they demaned or it may be even more.
Respected sir, your guidelines and opinion give me ready to face the situation patienly.
