SIR MY FATHER PASSED AWAY IN YEAR 2004 HE MADE HIS WILL IN THE YEAR 2000. I HAD LOSTED THE WILL , BUT AS I KNOW THE VOLUME NUMBER SO I OBTAIN CERTIFIED WILL FROM THE REGISTRAR OFFICE. MY SISTER HAS CHALLENGED THE WILL . DOES THE CERTIFIED WILL HOLDS ANY VALUE . AS MY FATHER MENTIONED THAT SHE HAS NO SHARE IN THE SAID PROPERTY. AS HE GAVE HIM ALL THE VALUABLES IN HER MARRIAGE AND GIVING ITSELF.

Hello Experts,
I need your suggestion in particular situation. I am sure there would be many more fellow members who are suffering from this issue.
I have been separated from wife since 3 years and kid is now at the age of getting into school.There are 498A, DV and Child custody (filed by me, a husband) case between us.
There are almost no chances of cohabitating together.
In this situation how can we direct wife to put kid on particular school ? How can we prevent wife, if she is putting kid in not so good school ? I would request answer on legal front as mediation / mutual meetings have been failing since last 3 years due to adamant nature of wife.I expect that she would not agree on any of my suggestion even for kid and kid's future.
Please share your thoughts on this situation.

My wife had left me for the last approx 2 years in return of which I filed petition for Section 9 in reply of which she filed false complaint against me in women cell i.e. after approx 9 months of filing my RCR under section 9 ....Our mediation also got failed in women cell as a result I filed anticipatory bail on the basis of the complaint copy to the session court for apprehending arrest. The session court grant me 5 days notice to be issued to me prior to my arrest for applying regular bail. Now Sir the fake FIR has been registerd against me and my parents under Sec.498A,406 & 34 on dt.14.03.12. I want to know that its been almost three months of getting registered FIR against me so whether should i apply for the regular bail now on the basis of FIR copy or wait for the notice of arrest to be issued to me for applying of anticipatory bail?????????

A Mother has Property & Gold . She has 4 Daughters and one Son(Mentally Challenged) Husband passed away much before
Mother Mentioned in her WILL that
Who(from 4 Daughter ) ever take care of Her SON(Mentally Challenged) will be liable to get ½ of the total property & gold And remaining ½ will be distributed among the remaining 3 Daughter
BUT all the 4 Daughter Refused to take care of her brother (Mentally Challenged) & Some other person assure to take care of there brother
Now my Query is that..
Q. Is the WILL become Void as None of the Daughter take care ?
Q. Will the Other person (who is taking care of their brother) will be liable to claim ½ of the property & Gold ?

Hi. I had a love marriage after knowing my husband for 4 years. We have just completed six months of our marriage. My husband and I have issues because of his mother and sister. They are really problematic people and have been troubling me and he is completely under their influence.so I suggested him to think about us for sometime and they have completely brainwashed him. Can he file a divorce case considering it is just six months of our marriage. If yes, then on what grounds. I want ot save our marriage so I suggested him that I am ready to take responsibility of your mother and we stay very close to his sister so I asked him to move from there. He refused to do so. His mother and sister want to control our life completely. Please gpsuggest..

sir i heard that calling photographer as witness in the court will be more in Criminal cases, but marriage being civil case the evidence, calling photographer is not essential to prove the contents of the same. is it correct?
if so any citation i can get sir?

Hi, myself veena married to lokesh one year back, after 6 months of marriage my husband, mother in-law & father in-law started giving mental & physical torture to bring dowry, But I objected for it. Because of it my husband sent divorce notice & it is pending. Still I am staying in Father-in law's house but my husband not coming to home from past 6 months (My father in-law somewhere hiding my husband). Moreover my husband also not interested on me. I am daily getting torture. Still now no complaint filed againt them. Now I decided to give complaint to police. Please help me out how to file strong complaint. Thank you

On the date given for my divorce filled against mutual consent the councillor was not present and a new date was give. Want to know what legal rights i have when the divorce is filled with mutual consent and can i take any action against it.

Suffering from severe family problems
Respected sir/mam,
This is Rahul.I'm suffering from severe family problems.We belongs to hindu family.We are 3 brothers,3 sisters(married) & mom.Me the middle one among 3 brothers.My father was expired before 2 years.Our all properties and business are owned by my father itself.
The problem is that my elder brother is very cruel,selfish,dishonest..my father died before time due to him only.He always rule over my parents,torture them,argue
with them in every matter which results heart attack & death of my father.Now he is free from any boundations,he thinks himself the owner of all properties & now he do
whatever he wants.He kept all the income which comes from business owned by my father & he takes advantage of all landed properties also through rental income.He makes our life ruined.I have lot of tension & pressure of work so i don't believe in daily fighting like animals among each other for my rights.I'm married ,doing private job and suffering from financial problems.As i know talking with them for my shares will be only wastage of time so i want to proceed directly with law So please sir provide me your advice for the following queries & for the act of your kindness i shall ever remain grateful to you:
1)How do i get my shares with the help of law.
2)Will law help me in this matter to get my shares.
3)If elder brother or mother deny for separation then is it possibilities of separation.
4)Where i have to go to suit a file for my share.
5)If i suit a file for separation then how much time it takes to get my shares.
