in the year 2008 i had taken loan from icici bank and given two cheques as security. i had paid only two instalments and defaulted afterwards. two years have been passed i have not made a single payment afterwards...what can a bank do now..........they have not presented my cheques till date in the bank and not taken any action for sec. 138 also...............what do i think.....

Is it possible to diagnose a person of psychiatric problems through blood test? If the person is taking antidepressant or anxiety medicines.
What is the accepted evidence in the court of law to prove a person is having psychological problems from few/many years?
Are there any advancement made in forensic/pychiatry, in getting such evidence in our country.

Is it possible to get detail conversation record from telephone company?
If the talk has taken place on mobile and land line.
Generally the phone companies provide with bill- outgoing calls with time duration. Can we get the "conversation record" of talk taken place during that particular time?

FIR's u/s.420IPC were filed in march 2010 and may 2010 though offence occured on the same date with an intention to cause harassment. Till date charge sheet has not been filed. It is known that the Police office has been influenced with money by some local people to cause harassment to an accused by not filing charge sheet and who is no way related to the case. Kindly advise if a writ can be filed to have FIR's quashed.

In my FIR and chargesheet the case filed by my FIL he has claimed many items and submitted a list that we have not handed over many items that is not true. How will the charge be defended in court by us can there be a search warrant for our lockers or house.
How to defend and no one collected her clothes and Double bed from us that is true item stated in the list that I would accept in court and can return so how does the case progress on such charges of Sec 406.

Myself , married in july 2010.
My mother in law has thrown me out of her house within a month of our marriage, my husband didn't help me at all, my MIL completely controls him and my husband is scared of his mother, and my MIL doesn't want me back, from the last 5 months iam trying hard to save my marriage, tried counselling, sent messages, phone calls emails, but no response. my MIl is forcing my husband to file for divorce and get seperated from me, she keeps saying him the same, i got to know this from my husband's relatives. My MIL is not ready to listen to any relative , she is adament to break this marriage. My MIL has harassed me alot, and i think she wants dowry but she is not saying directly on my face, moreover she curses me whole day that her son is handsome and she did a mistake that she choose me.
Atlast i had to file a maintenance case under 125 crpc. Summons were issued, my husband accepted the summons, and when police went to their house with summons, my husband and inlaws told them that they will appear in court and they don't have any problem in accepting me back. And they had signed the summon papers and gave the summon copy to police. Then on the following date of hearing , my husband & inlaws didn't came, they were absent. Altough their home was locked, and they had told their neighbours that they are going for a case hearing. Before that he had escaped from accepting the summons, by tricks, and due to this my case dates extend, and i keep going to court . 2 hearings havebeen passed. But now i think they are cheating & fooling me. From last 5 months iam trying so hard to save my marriage but now i feel these people are just cheating me, iam shattered . They just don't want to come to my place in court or accept me back, and now after all this i cannot stand my MIL, because she is a threat to my marriage. They are inlficting nasty alligations, iam getting disgusting calls on my landline, from pco's abusing and all.
Now i want to file a PWDVA & i also want to register F.I.R, for F.I.R i have ample proofs, and consent from police station ( From city- where my husband resides) in written that i should file FIR against my husband. Because i know he will continue to make me fool and won't appear for PWDVA summons also, as they are constantly cheating me. So i will file FIR, Now i want to ask what happens after Filing FIR, can my husband still escape himeslf from appearing in court even if i file an FIR ???
He will be arrested or not ??? please tell me

And what is FIR , i want to register FIR on harassment basis, because my husband has cheated me before this,and he is not accepting me & is breaking this marriage without my fault,he has plans for remarriage. he is just not telling his intension properly.
1) If i file FIR will my husband be arrested immediately or after investigation ????
2)And after filing FIR ,if the case reaches to court, will i have to appoint a lawyer or court will provide me a lawyer ???

in a case of of 138n.i.act,accused admiteed, that he has given cheque to petioner, but accused not receved goods,petioner has only bills carbon copy, jisme accused ke delivery recipt main signatyre nahi hai, accused ne sale of goods 1930 ka havala diya hai, va kumar export vs sharma carpets supreme court ke faisale ke aadhar par case khariz kar diya, faisle main likha hai ki sirf cheque dena hi paryapt nahi hai, varan mal delivery bhi sabit karni hogi, aapki kya rai hai

IPC 420
Dear Sir,
My close relative was booked for IPc 420 & 406 in October 2009. Charges were framed in
December 2010. I think next stage is Evidence and next date for hearing is in May this year. I have three queries.
1. Should we appeal to Session Court against the charges before the next date or we wait till a few evidence taken place in trial court
2. We have settlement in back of our mind. Can this be done at this stage or is there something that once the case is gone in evidence the settlement cant be done.
3. Can we request Court to settle the matter.
