Dear Emminent Lawyers,
I have just seen one of the anonymous blog and was trying to help that person. however since I am not a LLB or experience into Defence Law, I am unable to help that anonymous person.
This is the case of deserters in Defence i.e. Army/Airforce/navy as per the policy, Air force dismiss the personnel after 3 years of desertion. It is also mentioned that Dismissal is one of the most severe punishments given by court martial(court of airforce/army). however it seems that even after the dismissal the personnel can not lead a normal life. in this case the deserter's NOK is also given the Dismissal order that clearly states that the personnel has deserted without any arms and ammuniation and committing any serious offence.
The point here is since the personnel is already dismissed for being deserter for 3 years and has not deserted with arms and ammuniation and has not committed any serious offence. How can the personnel can be punished again for the same crime?
if this is the rule than there must be some genuine exceptions to it... request the help of experts...

I believe post independence it was Jury system in vogue in this country.What happened ? Why it was changed to the present system which has collapsed (almost)?Why JURY system is not being re-introduced? Who will benefit and who shall loose and in what way? How this Jury system is being practised to perfection by our colonial masters as well as USA and such others developed countries? are YOURLORDSHEEPS the bottlenecks ? Or are the lawyers themselves are the roadblocks? Can someone provide some honest answers?
I get quite upset whenever I pass by some Police Station in the neighborhood.Hunderds of two wheelers , 4 wheelers including cars , trucks , ambulances can be found lying in dis-use in such car ponds under the able super-vision of our police staff.
I am told unless court orders its release or auction govt at the state or the police deptt is not empowered to auction those vehicles.
In a country where justice is delivered after 22.3 years on an average what could be fate of those confiscate vehicles?
Can't we be little more innovative? Can't we dispose of the vehicles within 3 months?

When magistrate in a court is on leave
On a date when Magistrate is on leave and no reliever is arranged who is delegated in that court to give next date and based on which parameters? Is there a procedures that information is to be made available to those accused, witnesses etc so that they are not unnecessarily inconvenienced?
