We have an HUF consisting of My Husband, Myself(Wife) Two Daughters(Major-Unmarried) and has a Share Depository A/c with HDFC Bank where we hold shares. On the death of my husband,i.e. the Karta, we(three remaining females, mother-daughters) have reconstituted HUF with myself as Karta and two Daughters as members and have requested the HDFC to change the Karta and its signature in the account, which is denied and they insis on either succession certificate of my husband,or a registered will, or a Familiy Settlement(Registered) or a decree/order from the court.There is no will.All these formalities shall take long time except Family settlement.What should I do? if we go for family settlement and its registration, then who would particiapate in it , we all three or my in-laws also,? and shall I have to pay any duty on registration.The value of shares is around 4.00 lac(but always flactuating) Kindly advise.

My Husband had a Life Insurance Policy with Metlife Insurance Co for Rs.30.00 Lac, Full Premium Paid, Myself Nominee.My Husband Died in a Road Accident,Lodged Claim with proper documents.The Agent confirmed processing of full claim and insisted on new single premium policy for the totoal claim amount, which I refused.Thereafter the Insurance Company rejected the total claim on the ground that My Husband had concealed the fact of(while applying the policy with Metlife) a policy proposal having been rejected by ICICI Life Insurance prior to applying to metlife.Metlife issued the policy after complying all the required formalities including exhaustive medical check up.
On my making several request to Metlife for review of its decisio about claim rejection, the metlife informed that they can consider paying a lumpsum of Rs.15.00 lac to me as"Ex-gratia"(but not the claim amount)provided I comply with the documentations which included indemnity, no further claim certificate, NOC etc etc which the agent made/suggested to comply and accept with assurance of balance payment from metlife with more efforts.
I accepted and executed the documents which metlife insisted and received Rs.15.00 as ex-gratia in full and final payment.
Now it is about more than one year neither the agent nor the metlife is listening to me on the ground that nothing is payable to me.
What to do??

Hello,
Greetings!!!
In my society , General body meeting date announced and informed to all members by secretary. But due to sudden death 1 day before of meeting, they declared next date. This new date is not convinient to majority members. And requested to keep meeting in month of april and given in writing to chairman and secretary. But both are not agree and not willing to change the dates.The gap between both dates are 1 week.
What is correct approach / legal way to sort out this issue?

I HAVE UNDER PRESURE TO SIGN ON SELLDEED AND BUYER PARTY HAS PRESURE ON ME THAT IF I CANT SIGN THEN ANYTHING HAPPEN FROM POLICE WHO IS HIS FAMILY MEMBER SO I SIGN ON SELL DEED BUT NOW I APEAIL IN LOCAL COURT THAT CANCELL SELL DEED THROUGH MY CIVIL ADVOCATE.....MY CASE IS PENDING IN SURAT COURT
NOW I HAVE QURESTION THAT IT'S HAPPEN FOR SELLDEED CANCELLTION?

I foreclosed housing loan (from Non-Banking Finance Company) on 23/10/10 from 'own sources'. The loan was availed in 'individual' capacity. NBFC levied 2% foreclosure penalty, as per loan agreement. Then I got legal advice that in absence of RBI directive prohibiting foreclosure penalty, I had no choice.
Recently I learnt this NBFC actually comes under direct purview of National Housing Bank (not RBI); and NHB circular dated 18/10/10 prohibited collection of said penalty 'with immediate effect' if financed from 'own sources' by 'individual' borrower. On approaching NBFC, it refused to refund this sum. I got legal advice that I have already missed the bus (I should have approached consumer court by 22/10/12). Do I have remedy available; considering that penalty was levied in violation of NHB directive?

Respected Members,
I live in a building which has not yet received a completion certificate. Because of building issues my parents had arguments with other building members. Without any genuine reason there is a couple who are creating nuisance and talking in very intolerable method. This happened repeatedly thrice. My parents are aged above 50.
What legal action can be taken against such people.

I am a member of a cooperative housing society. The land of the society was acquired by the Government of Rajasthan several decades ago for a public purpose. However, when it did not need it for the purpose, it returned the land.
In the meanwhile, on account of another action of the government, a part of the land got into some dispute and the affected party (not part of the society) managed to get a stay. This stay has been operative for the past over a decade.
The Society in the meanwhile went ahead with allotting plots to its members and some of the members were on paper given plots only on paper as part of the land was under dispute. Rest of the members got title deeds. for their land from the government.
1. Was it legal on part of the Society to give some members land on a dispute piece.
2. Was the Government of Rajasthan/Registrar of Societies right in accepting such allotments - where some of the members have been denied their rights.

We made a proposed society in 1994 on open plot. It is still poposed society because there is EWS reservation on that soc.and plot is not NA plot. We want to sell this plot now in 2015. Can we sell this plot being a proposed society.
There is a Registered sale deed between Land owner and proposed society.
