Small Causes Court Order

Sir,
In a matter of eviction suit filed by an landlord against a tenant who is an Eligible tenant as per Annexure-2 and the land belongs to MCGM also the tenant is paying monthly rent to MCGM please consider following points:

1) The landlord obtained permission from Dy. Collector Enc./Rem. to initiate eviction suit against the tenant which is mandatory as per section 22 of slum act.

2) However, The Dy. Collector has no right to issue permission as the land belongs to MCGM.

3) The tenant aggrieved by Dy. Collector's order preferred an appeal u/s 35 of Slum Act. the appeal is still pending before the Addl. Collector i.e. Appeallate authority.

4) But irrespective of the appeal the small cause trial court has passed order of eviction.

Please guide that how can the tenant restore his possession.

Traffic challan

I was challaned by Traffic Police at Dwarka (intersection of road nos. 224 & 201). The police confiscated my D/L citing Supreme Court ruling for such violations and posted the case at Dwarka Court for necessary disposal. What are my chances of getting relief from court being a govt servant and due to mitigating circumstances such as presence of a big bus ahead of me which hid the traffic lights and the timer was not fuctional on that day. Does the court listen to the plea of the defendent in such cases ?

Tata docomo loka adalat notice

I received a notice of lok adalat from tata docomo photon for rs 1500 which not paid by me.Now that I have passed the date of lok adalat as i was not aware of mail being send to me can i settle this amount now and escape from judgment?

Vacation of the rented premises

respected sir's

i am staying in a rented house since 8years,i am very prompt in paying rents though bank a/c.
now the land lord asking me to surender the flat immedietly,i am also interested to vacate the flat but i am unable to get the alternate.

kindly suggest me the suitable steps to be adopted in case of forceble vacation.

Respondents chose not to respond

Dear Experts,
I have a case against the GOI, who are the main respondents. There is one more person as respondent. Both were given 6 weeks to respond in Mar 2016.Both have decided to just not reply to the notice(s) from the Tribunal based on my application. What is the procedure wherein I could get timely justice? Can I drop the name of the individual from the list of respondents (basically to hasten up the case) as his reply is no more relevant to the case? Can the Tribunal proceed ex-parte if the GOI does not respond? What would be the time-frame for such an action? Any other advice for hastening up the process?

Dear sir, Greetings of day! As per sme law 2006 msmes (micro small medium enterprises)are exempted from paying tender form fee, tender E.M.d amount without any upper cap. WHILE PARTICIPATING IN CENTRAL GOVT. TENDERS, BUT GOVT OF MAHARASHTRA HAS PUBLISHED A G.R. DTD 30-10-2015 OF LABOR ENERGY INDUSTRY DEPT. It states that emd below RS. 25000 is exempted. Which is to be followed by state govt officials. THE LAW OR G.R.?

Certified court order copy

Sir,

I had applied for certified court order copies as an party in person on 16.06.2016 on 24.06.2016 record room people sensed to copying section, but copying section people told me that they haven't received the documents from record section, they advised me to go and an quire with them, i went 5 times from record section to copying section, at last they record section people sanded on 30.06.2016.

But till today i am unable to get the copy and again they are stating that they had not received from record section and go and ask them.

Simply they are wasting my time and sending to copying section to record section.

Without taking money it seems they are not serving the people.

In these regard i would like to give compliant against these people, so please guide me to how and where i should give compliant.

Is the maintenance order valid?

Dear respected experts,
Wife filed maintenance case under section Order 7 rule 1 cpc. Family court Judge was biased and always did favour to my wife from beginning itself. After my cross examination was over I requested judge to allow further witness. I planned to bring 3 more witnesses. But judge refused to allow further evidence and did not give a single day for final argument.
He asked us to argue on the next day once my cross examination was over. We could not argue on the next day. Judge passed maintenance order. Rs.10,000 per month from date of application. and created charge over my 3 properties.

My question is:
1) Is the order valid (he ordered without our argument without allowing further evidence)

2) what should I pray in my appeal in High court?

To change the name on death certificate

Dear All

My grandmother was died in 2011 and on the death certificate issued by Municipal Corporation mentioned the name "Godavari" and on the property documents the name has mentioned i.e. "Kuasalybai" now we will going for the change in name in death certificate they said we dont have a power to change the name on death certicate without direction of the court. In this case i want to know under whose jurisdiction power is vested to give direction to the MC. whether it is in the power of JMFC or Civil Court. Kindly guide us what action to be taken in this case.
