Can any asset reconstruction company (ARC) file the case in DRT against the borrower if the loan is taken from the bank? does the DRT issues summons to the defendent? If the summons is not received by the defendent & if the defendent is completely unaware of this proceedings & hence due to lac of knowledge if he doesnt appear before DRT, can the registrar of the DRT pass the Exparte order against the defendent? Or the matter is put before the presiding officer by the registrar for the Exparte order? In such case , before passing any exparte order or recovery certificate, Does the presiding officer issue summons against the defendent again so as to enable the defendent to appear & defend himself?

Dear Lawyers,
I want to run a rental website all over India where Those who want to give anything on rent on hourly or monthly basis will post his product with rent amount and those who want to take rent will contact them and take the product on rent.

Its owners duty to take all docs, but he doesn't take and will I be facing legal action.

Dear sir,
I have bought a site in Bangalore in a layout developed by BDA, initially they had marked the site in a particular location, but now the BDA engineer is saying that the site is shifted by around 40 feet ...But there is no change in the actual layout plan by BDA, the engineer is doing this to do a favour to another site holder . Please advise how I can fight this legally. Thanks

Wish to know whether it is mandatory under any law for a newly elected Committee of a Co-operative Housing Society in Mumbai to adopt the Model Bye Laws of 2014 in place of the existing registered Bye Laws of that Society.
