Appellant side argument

Dear Learned Lawyers,
Against the lower court judgment / decree, a fraudulent respondent made an appeal suit in the next appellate court and dragged the appeal suit for more than a year. It is just to drag on the suit and the advocate engaged by him did not appear in the court though the court called for appellant side argument. When the last chance was given by the court, the appellant changed the vakkalat and sought for extension of time. What is the way out in our legal system to come out of such vexatious issues ?

Ancestral property

We have a person who has a different name, but takes an 'alias' name of my father & tries to grab our ancestral property, stating that he got it by virtue of partion among his brothers. The person is not at all connected to our family, has no document to prove the 'alias' name, has no deed to establish the partition as claimed.He also has a property with a different survey number, with his first name in the ROR & no records of the 'alias' name.
How do we establish our ownership of our ancestral property, since ownership in the ROR's was in the name of my grandfather from 1952 & my father's name from 1989. The mutation mentioned in the 1989 ROR is "by virasat". Other than this, what documents should be provided to the courts to declare the ownership in my father's name.Identification of my father as the son of my grandfather is available by Ration Card / Voter ID / Service Records / Passport documents. Kindly advise.

Regarding society issue

sir , we are registered CHS in Mumbai one of our member is providing Lodging & Boarding facility under the B&B scheme ie bed & Breakfast on commercial basis he has not taken any NOC from Society nor any intimation to the society any time the guest comes and goes using Lift ,water and other facility etc pl advice can he do so if not under what law or Rule he can be question to stop these activity pl

M - 20 indemnity bond

Dear Sir / Madam,

Good Afternoon,

The undersigned resides at CHS located at Pune, MH. It has come to our notice that none of the Managing Committee Members have filed M - 20 Indemnity Bond within 45 days from being elected as MC Members. What action can be taken in this respect ?

Law of limitation

Hi, a civil suit related to the property has been filed against me in 2016 in High court...the fact that the other party was aware of the agreement of the same property way back in 2008 and didn't contest the same for so long, and they decided to file it in 2016, does this fall under law of limitation and what are the chances that the suit will not be entertained

Section 12 of d v act

My self and my parents received notice from JCM court as my wife given case under above act.She left the home last 2 months back with my daughter of 3 years old when i am outstation on duty with her office friends and quarreling with my age old parents.After continuous efforts from elders,she not responded to turn back and even not allowing me to speak with my kid.She is a egoistic person with sadist attitude.She don't want my parents to stay in my home.After going her parent home, she left the job giving health issues.What are the course of action i can do in this case.

Private building given to govt.

In U.P. my grand father had given a building to the government to be used as a police station.

About 10 years ago, the police station was shifted to a much larger new place. Since then the old police building is lying vacant.

In RTI query, they admit it clearly that government is not the owner of the building but it was provided to them by Mr. X (my grandfather) for official work i.e. police station.

At the same time they say that they do not have any lease deed/ rent... deed of the building.

Neither i have any document to prove that i am the owner.

The RTI reply is enough to sue government for possession?

regarding right of property to adopted child

Dear sir when I was 6 month Old my mother died and my biological father given me to his uncle and aunt for bringing up in my school certificate from class 1 to graduation my father name is mentioned of grand pa .Now I want to know whether I am legally hair of his ancestors property or not please advise . thanks

Judge not allowing take denial of allegation in cros-examination

Defendant filed the WS denying all allegations of Petitioner. Petitioner filed evidence in chief repeating all allegations. While cross-examining Petitioner Defendant asked questions ".....allegations are not true?" Those questions were not allowed by the Judge by giving the reason that denial is a part of pleadings, not evidence. Can the judge be said to hold right stand? What are the legal provision or case laws?
