Hello Experts
I had posted this query in anonymous section and was told to post it again. I request only senior advocates only to reply please.
Kindly help
A case was filed against me and it was dismissed by Honble High Court Andhra Pradesh.
The opposite party tried to file review petition. But I understand from internet that it has not been admitted till date it shows pending status.
.
.
I also want to change my advocate to represent me once the review petition is admitted.
.
.
Till now No notice has come to me from high court regarding the review petition but my old advocate recieved petition copy from opposite party and he is not sharing the copy with me.
.
.
My queries are
1) Will I get notice copy once the opposite party review petition is admitted
2) Do i need to file any counter before the high court before the review petition is admitted

I have an account with Oriental Bank Of Commerce with cash credit facility of 4.5 cr . In the sanction letter it is mentioned that prepayment charges of 2% will be charged one time in case of working capital loan is prepaid by the borrower for shifting to other bank / FI .
In this case my limit due date was for 26th April. I did not renew my limit and in advance gave a notice to the bank not to renew my limit because I will switch the bank. When today the other bank is ready to make payment of the used limit to my existing bank, OBC says that there is this clause and you need to pay the charges.
Please clarify the term of pre- payment in it. Right now they have stopped my DRAWING POWER.
So is it not wrong on the part of the bank to ask for charges. Kindly help me with the solution as I do not have to pay the pre payment charges

My Query is When and Why PSRP filed for Rent, Possession under Section 41 of Presidency Small Cause Court Act?
Why not Claim for Rent and possesion filed in City Civil Court?
I mean to ask What is Psrp(Section 41 of presedency small cause court) specially provisioned for by the Indian law?

I signed a LOI with a prospective lessee and he deposited cheques towards the 3 month security deposit. Upon repeated reminders the lessee did not sign the lease for one reason or the other and after 1 month of signing the LOI he informed me that he is not interested in taking the property on lease and asked me to refund his money. I agreed to this but told him that I will deduct amount equivalent to one month's rent as that is the time my property was engaged with him by the virtue of LOI. He is disagreeing and now he is threatening to take me to court and get a stay order so that I would not be able to lease my property to anyone else. My question is (a) can he get such a stay order from the court and (b) is it not fair for me to cut the rent for the amount he kept my property engaged and purposefully did not sign the lease.
Please provide your expert guidance. Thanks.

I own a house in a CHS, about six months ago i had asked the house owner (member) staying above me to do repairs of his bathroom because my bathroom ceiling was leaking and a lot of paint and some cement had come off. The owner asked me to wait for three months as he will carty out the repair works. Now its been six months he is not willing to do any repairs citing excuses. Even after repeated reminders and intimation by society secretary has gone in vain.
Because of his delay i am not able to carry out renovation work in my bathroom and kitchen which has got damaged by this leak. What should i do?

Dear sirs and madams:
What is the role of the bench clerk in a consumer forum?
As per my understanding it is calling out case number, party names and announcing date given by the president.
Other than that making entry into confonet is another job of the bench clerk.
Taking the files back to cupboard in the office. Taking the files from the cupoboard in the office to the court hall.
Is the bench clerk a counsellor appointed by the consumer forum? What authority has the bench clerk to do counselliing of the complainants and give advice to them?
What can be done to stop this.
Can RTI be of any help?
