Can I be prosecuted for defamation??

Someone gave me a cheque, pro-note and a written agreement for the repayment of a friendly loan of Rs. 20000/- only . Now as he has refused to pay me back my amount,I feel it impractical to waste my time and money by sueing him for a small amount of Rs.20000/-.


I planned to make small posters and pamphlets declaring ----


यह व्यक्ति एक नंबर का बे-ईमान व्यक्ति है. जिस से पैसे उधार लेता है वापिस देने का नाम नहीं लेता है. पैसे वापिस मांगने पर लड़ाई झगडा करता है. अगर आप ने इस व्यक्ति से गलती से भी डील किया तो आप को घाटे के अलावा कुछ नहीं मिलेगा. यदि आप को हमारे कथन की सत्यता पर कुछ भी शंका हो तो आप हम से संपर्क कर के अपनी शंका का समाधान कर सकते हैं .

Here below ,I would give my cell phone numbers.


If any body challenges my claim,I would show him all the documents and cheque given by that defaulter friend of mine.


Please tell me if I use this technique ,can I be prosecuted by that defaulter friend of mine for defaming him ???


Or can you suggest me some other tips to recover such small amounts without entering into a court cases??

1) I Have Heard that a word "Public Prosecutor" can be used in criminal cases or procedings only & not in the civil case why so ? (1a) In civil cases the opposite advocates is called out by what name if not public prosecutor ?

2)Can anybody send me the copy of the belowmentioned case law which explains the meaning of non - obstante clause in details.

SC In South India Corp Ltd vs. Secretary, Board Of Revenue (1964) 15 STC 74.

Also more opinion required for non - obstante clause.

3) Can anybody can say why we write doctrine or maxim for the words ? How do we know that we have to write the doctrine or maxim before the particular word or a sentences . Every precise meaning of word doctrine & Maxim used why ?

Pls Answer the abovementioned query .

injection suite

sir we have 1 acre of garden in the middle of servey no, and we have to go to our patch of land through sorrounding land. we also have two irrigation pumps that irrigate other our lands are situeted in this land. pipe line are laid in land of neighbering farmer. but my neighbering farmer is angry with me taking bad langage and also disterbing my farm activity. this water pumps are very importent to me, and know he threatening me that he will destroy my pipes in undergound.
so i am afraid of every thing that will hapen in future.
regarding this mater if i can file any injection suite that will protect my soul,farm,motor,pump and my labour

can legal heir can release their rights from fathers property

we are four brothers my father had made a will still we have not probate the will the same now our two brothers want to relase their rights in one of property whether release deed is vaild or not and also whether we can registered it or not today by reference of will . they are signing on stamp paper of rs 200/- whether it can vailld without registered.

resignation through email

please member suggest me.

our is a It Company having its office at Chennai, "A" was appointed as I.T. Head at lonavala and later he was relocated to chennai, he resigned from the company without serving 3 months notice, company claimed and send notice for 3 months salary in lieu of 3 months notice. later i came to know that he send his resignation through email, at the time of his resignation he was in chennai and send his resignation through email at lonavala.

1. whether sending resignation through email is valid, the company has not issued releiving letter to him

2. where to file a case against him in chennai or lonavala. what sought of action to be taken against him.

please suggest me.

criminal offence in a civil case

If somebody produces a false evidence in a service matter before high court and the case is dismissed on behalf of that false evidence, Can we make an application before the same bench under section 340 for production of false evidence and if it succeed,s can the case be reopened on its behalf?

How to indemnify the market vluae from the Vendor?

Plz. Clarify my doubt.

I purchased some lands for Rs.10 Lakhs (Market value) and whereas the Government value is only Rs 60,000/- and accordingly I have shown the value of the land is Rs.60,000/- in the Registered Sale Deed. It is mentioned in the Sale Deed, that “ the vendor has to indemnify the liability to the extent of Rs.60,000/- in case of any defect of title or what so ever”.In such a case, if I want to recover Rs.10 Lakhs as damages or etc., what I have to do.
