Effect of dismissal of contempt petition

Does dismissal of a contempt petition constitute a bar on filing an OA on grounds including inter alia some of the grounds on which the contempt petition was filed in the CAT? Any case law on the subject?

Karnataka Stamp Act - Art 20(1)

Whether the Stamp Duty paid on the Lease Cum Sale Agreement executed by Govt body (refer Article 5(d) of the Stamp Act) is adjustable at the time of Conveyance? - the party has paid 7.5 % on deposit amt in the lease Cum Sale Agreement. Now at the time of conveyance the Sub Registrar states that only 6% on the intial deposit paid under lease cum sale agreement can be adjusted and not the entire duty paid on lease cum sale agreeement. Want to confirm whether SR is correct in his intrepretation? As per me the entire duty already paid has to be adjusted as Art 20(1) states that only difference duly is payable. Pls advice and let me know if any recent case law is available in this regard

Date of adjournment-Supreme court of India

Respected Experts,
I have a SLP which is pending before Supreme Court of India. On the last occassion, the Honourable court was ordered to post the above matter on a non-miscellaneous day for hearing of the said case. Accodingly the same was posted on non-miscellaneous day ie., onTuesday. Since the Respondents have requested time for filing their cournters in some I.A.s, the Hon'ble court granted 3 weeks time for filing their cournters and another 3 weeks time for filing our rejoinder if any. And hence the said case is posted to 28/03/2011, which is a miscellaneous day.

In this, is there any possibility to post pone the said matter from miscellaneous day to non-miscellaneous dayie., on 29/3/2011.
(Monday & Friday are the miscellaneous days and Tuesday,Wednesday & Thursday are the non miscellaneous days in Supreme Court.)
Plz. advise me.

Charges for appointing of executor ?

It has become necessary for me to appoint a executor for disposal of property in which I have 20% share. Pl. advice on my following querries:

1) How to ensure that the executor does not dispose off property at throw away price ? Can I fix a floor price and public auction route ?

2) What will be cost of execution and can it be deducted from sale proceed as I am forced to appoint executor as opposite parties are allowing me to sale the property as per consent term order of City Civil Court ?

URGENT Need case laws on section 17 of Limitation Act

Sir,
My service matter on the issue of limitation will be decided by the CAT in which the respondent has concealed the status of result by not notifying it. Kindly provide me some case laws on section 17 of limitation act-1963 in which the fault lies on the employer side

Injunction

I have filed a suit for injunction. My client is in the possession over the suit land as on the filing of the date of the suit. The pahanies also filed. The suit land is acquired from my client's father after his death. The defendant is claiming that the property is purchased from my client through a simple sale document, which is unstamped and unregistered. The alleged document is forged one. The Tahasildar is colluded with the defendant. The defendant is influenced person and supported with local surpanch. The defendant and his associates created a false panchanama and local inquiry, without giving notice to my client i.e., the plaintiff issued a proceeding against my client i.e. the plaintiff and entered the name of the defendant in the possessor column of the pahany patrik. The injunction application is heard and injunction is vacated. The court is not considered the principles of natural justice the doctrine of AUDI ALTERM PARTEM. Are there any suitable judgments with regard to the my case. Thanks to one and all gnrsharma@gmail.com

Order 26 Rule 9 Court commissioner for inquiry as to possession of the land and four boundires

A case is filed for cancellation of sale deed and plaintiff have pleaded that possession is retained with him though in sale deed transfer of possession is clearly mentioned.
Plaintiff have filed application for appointment of court commissioner for investing / finding who is in possession and to asertain the four boundries.

whethere court commission can be appointed for finding possession?
