Section 169.

Section 169. Public servant unlawfully buying or bidding for property

Whoever, being a public servant, and being legally bound as such public servant, not to purchase or bid for certain property, purchases or bids for that property, either in his own name or in the name of another, or jointly, or in shares with others, shall be punished with simple imprisonment for a term which may extend to two years, or with fine, or with both; and the property, if purchased, shall be confiscated.

Query : So as per the above mentioned section a public servant as per the section 21 of the IPC, 1860 can't buy or bid any property.

Also what do u mean by certain property as mentioned in the above section. Pls Explain me in details or with any case laws on it.

Abettor.

Section 108. Abettor

A person abets an offence, who abets either the commission of an offence, or the commission of an act which would be an offence, if committed by a person capable of law of committing an offence with the same intention or knowledge as that of the abettor.

Query : Meaning of abets & Abettor as a layman with the examples. Pls

Memorandum Of Appeal.


Grounds Of Appeal & Memorandum Of Appeal. With the example(S). It is necessary to fill in civil case only or we have to fill in criminal case or only in any tax matters or only to revenue matters only any case case laws. Time limit for filing a counter for a Rejoinder

In a civil suit the Plaintiff files Rejoinder immediately after a government department files a Written Statement.

Now that Government department is not filing counter, it has been more than 120 days since the plaintiff has filed Rejoinder.

In this case what is the time limit for filing Rejoinder ?

How to deal with cheating brothers ?

My father died intestate in 1996 and was a member of BSE. Two younger brothers had managed to open two joint accounts with BOI in his name may be with his consent or without consent and have siphoned off large amount of shares and money. Addl. CP-EOW is taking his own time to investigate the matter since last few months on my complaint. Pl. advice how to move ahead. Should I file a civil or criminal complaint against them as now I have some documentry evidance of their fraudulent acts ? Awaiting your kind response.

right to way

My residence is in the heart of a city and adjecent to main road.But, the problem is that i have a narrow pathway , which connects my house to the main road. That path way is also a part of our property.That is, our property is 5 cent in area, in the shape of a square, which has a narrow pathway , leading to main road, just like a tail.it is not a right or concession given by neighbours.The pathway is so narrow that no vehicles can be moved through it. we have approached the neighbours to buy a small portion of their land , so that we can have road access to our property.But, they are demanding exhorbitant prices.Hence, we could not buy it. so, still we dont have road access, eventhough , being very near to main road.now , it is reliably learnt that a big shopping complex is going to be erected by the land owner, along the parellel side of our pathway. I am told that , for that purpose they require permission from corporation authorities and the corporation authorities will ,in turn, seek , whether there is any objection to the neighbours as to light or air and only on the no-objection certificate of the neighbours, the permission will be granted. is there any such rule or law ?
if not, is there any remedy for me to widen my narrow pathway , AS A MATTER OF RIGHT, as intend to buy a four wheeler vehicle very soon , even when my neighbours are not ready to sell a portion of their adjecent boundary land to me ?
